<modsnip: Quoted post was removed> ... The thing about consent is: the moment she says "no" and "stop" she no longer wants it and that IS assault. He is charged with it, period. Madelyn IS the victim.

Neither is she too old to be catfished. We don't know who she thought she was meeting. She may have been groomed for days, weeks, months believing it was a real relationship, to include harmless role-playing, and none of it, including the man who is now charged, was part of her expectation.

Absolute victim.

All blame belongs to the monster who held her hostage.

ADMIN NOTE:

Given the nature of this particular case, it is a bit of a tough one to moderate, but comments that are determined to not be victim friendly will be removed.

Discussing known victim behavior, good or bad is fine, but do so in a civil and constructive way, and only when such behavior is known to be relevant to the case.

In line with WS Victim Friendly policy, please tread lightly and try to err on side of the victim with your comments.

Thank you.

MA's case has a trial setting hearing this month.
Does anyone know why it’s taken this long to get to this point? Was defense getting continuances to go through discovery? Or what?

Not being able to find any media following these ongoing proceedings, I contacted the SanPete Messenger, which had some coverage in 2022. This was the response I received on March 16, 2023:
"Thanks for the tip on pretrial hearings.
I will followup today.
As a journalist, I'm supposed to be impartial, but on this I'm not.
The delays in this horrible case have been unconscionable."
Suzanne Dean

I'm not seeing any more recent coverage in any media as of today. Hopefully, this newspaper will have a reporter at the trial if BB continues to assert his innocence.

Now that the news cycle has passed and the media's attention has moved on to fresher salacity, Madelyn will probably be more willing to testify than had Brown invoked his right to a speedy trial.

Does anyone have updates on this case? I checked the Sanpete Messenger, but they don’t have any recent (2023) articles following the status of this case.

Wayne County man sent to prison for kidnapping, sexual abuse of Snow College student

KEY TAKEAWAYS
  • Brent Neil Brown has been sentenced to at least one and up to 20 years in prison for kidnapping and sexually abusing a Snow College student in 2021.

Brown pleaded no contest to the three charges as part of a plea deal. In exchange, charges of rape, object rape, aggravated kidnapping, aggravated sexual assault and aggravated assault were dismissed. o_O

When the mother learned her daughter was found, she said she dropped to the ground, thankful for the miracle. But she also talked about the years of therapy she has brought her daughter to, and the nights she has spent in her room.

"He manipulated her in ways that have had a long-lasting and devastating impact on her life even today," she said.

The victim said over the last few years, she has spent hundreds of hours in therapy and still has nightmares and flashbacks.

Brown has appealed his sentence, asking for a review from a higher court. His appeal was filed with the Utah Court of Appeals on Oct. 9.

Sounds like the parole board according to the Judge...

"If you're the changed person you say, then there's a lot of leeway for the board of pardons to let you out. If not, there's a lot of leeway for them to hold you," Bagley said when sentencing him on Sept. 30.

He said it was consensual. A Utah college student said it was kidnapping.

But now — just days ahead of that and after more than two years of trying to get the charges dismissed — Brown has signaled that he will take a deal to plead no contest to three reduced charges in the high-profile case, effectively bringing it to a quiet end.

He signed a statement this week maintaining his innocence but accepting a prison sentence in what is known as an Alford plea.

Kevin Daniels, one of the prosecutors on the case and the Sanpete County attorney, said it “was the deal that the victim wanted.”

The student had been on the witness list for the trial and did not want to publicly relive the events in the courtroom, said Daniels, who has been working closely with the family over the past two years.

“This was a very, very victim-driven case,” Daniels said. “And we are guaranteed a conviction” with this deal.

The Salt Lake Tribune generally does not name sexual assault victims. Although the student’s name was released during the search, she has asked not to be identified in ongoing coverage.

This is Utah's specific criminal code on pleading (not guilty, guilty, etc.)

I'm not a lawyer but my reading of it is that Alford plea is treated the same as pleading guilty. There is still a right (though I don't know how limited) to file an appeal. In my non-lawyer understanding, an appeal will only succeed if there is some new information or procedural error. I'm not sure what new information could change that.

Still, the range of the sentence being 1-20 years is not exactly reassuring.
