I wonder if TS has a history of being involved in other litigations and insurance claims.

Yikes, Owens keeps saying “what a nerd” to his witness when elaborating on his experience.

Now Owens is saying he was praising him when he called him a nerd.

Yeah, I head that and it sounded weird. Very disappointed in performance of these attorneys (both sides). Owen also referred to the documents witness received as "several pages of junk" followed by "just kidding"

Poor Doctor admits he can’t remember all of every single deposition and what was said. His attorney keeps hammering “what did ___ say?”

I guess if you can’t refute the opinion much then this is what you gotta do. Ooof.

Plaintiff's counsel harping on expert's lack of usage of the term executive function in his 4 page report. lol

Plaintiff’s attorney…the coughing one who never covers his mouth…always sounds so disappointed when these experts don’t recognize Dr. Goldstein (plaintiff’s expert) and then has to remind the jury who he is.

Plaintiff's counsel really doesn't like that defense counsel keeps mentioning references to dementia by plaintiff witnesses and experts and in the medical records when TS himself expressed concerns pre collision he might be getting dementia. we are at side bar now.

What does Terry’s previous career of military ophthalmologist have to do with the case today?!

He had severe hearing loss; he had a previous stroke, classified as a stroke event with his eye, had severe vision impairment, severe anxiety and depression all before his incident.

They’re talking about the man who was many years ago, not the man he was the day of the accident. JMHO.

None of this establishes GP’s fault or negligence. If he caused the collision it’s all moot. Defense is hurting their case by hammering “he’s doing it for money” and “he’s malingering”. Hammer GP DIDN’t CAUSE THE ACCIDENT!

This is clearly a case of the judge not being in control of the courtroom. The attorneys are strange but that’s no excuse for the judge not to be on point.

He has let them talk over him and each other. This isn’t what we are accustomed to seeing in trial.

Owens is more brazen than the other as far as his lack of attention to the judge. It’s disappointing to witness this.

witness agreeing with defense counsel that a patient can "throw" results of neuro testing. being a plaintiff in a lawsuit often leads to patients overstating their symptoms and "malingering" for secondary gain.

Good point. Fault has to be established in order to take the responsibility for loss and medical cost. I don’t know that anything so far has been proven 100% fault or negligence.

There seems to be alot more time spent on TS conditions, before and after. So is the case going to be decided based on TS conditions and credibility?

I agree with another poster ….did they not locate the “woman” skier that was uphill behind TS & GP?
“Woman” is in all the animations.Seems she could solve this. TIA if anyone knows.

IMO it should be. As the plaintiff he has that burden of proof.

Dr. Angela Eastvold is now on the stand.

she is here to refute Golstein's expert opinion. reviewed thousands and thousands of pages of medical records.

Qualifications: board cert neuropsych, specialty, VA fellowship, 2 years specialized training in brain injury and that has been her primary field of practice since. She has lectured, trained and provided CLE to other medical professionals.

Independent consultant to professional sports teams. 80 of her work past two years is concussions.

Her opinion is that TS symptoms are more likely explained by things other than concussion. (ie. the normal aging dementia angle)

she reviewed executive function table in Goldsteins's report. This is a self report measure that Dr. G designed and published. It is not commonly used by Dr.s outside of Dr. G. It is a quantification of subjective self reported complaints from the patient directly. This subjective data contradicts the more objective data available.

MOO She's good. I am reminded of the star witness for Depp who put AH in her place in the most professional way possible - and got to enjoy dinner at JD's house ;)

The court will be taking a break so the judge can handle a quick hearing on another matter - this witness will be returning to the stand after that.

Good that is what I hoped for. They should just end with him.
