PARK CITY, Utah (KUTV) — One of the civil cases involving Kouri Richins will be in court Thursday, but the Kamas children’s book author will not be there.

Richins is suing the estate of her dead husband, Eric Richins, saying she has a right to his assets.

Richins will not be in court. Her lawyer tells KUTV she's not required to for civil cases.
Thursday's hearing will focus on two big things. Both Richins and the estate have filed for partial summary judgements in the case. The judge is hearing several of those motions. A request for summary judgement means the party wants the judge to issue an immediate ruling on parts or all of the case.

The other big focus during the day's proceedings is a motion to stay the case pending criminal proceedings. If the judge grants this motion, the civil case would be put on hold until Richins’ criminal case is complete.

According to KPCW, attorneys were in court Thursday to argue who would control Eric’s ownership in C&E Stone Masonry. Kouri’s attorneys argued their prenuptial agreement outweighed the living trust and Eric legally couldn’t assign his business interest to the trust.

A judge denied both arguments in partial summary judgments.

KTVX reports the judge said all motions in question would be put on hold until Kouri’s criminal trial is over.

SALT LAKE CITY (AP) — Prosecutors will not seek the death penalty against a Utah mother who wrote a children’s book about coping with grief after her husband’s death and is now accused of fatally poisoning him.

She is slated to appear for a scheduling conference on Sept. 1.

Utah has not carried out an execution since 2010. There are seven inmates on death row, according to the state department of corrections. They are all men.

UPDATE, 1:47 p.m.: The Third District Court has set another scheduling conference for Kouri Richins after her lawyer asked for more time to get familiar with certain financial aspects of the case.

Richins will next be in court Friday, Nov. 3 at 1:30 p.m., where once again, attorneys and the court will attempt to set dates for preliminary hearings.

The prosecution stated that they have not amended anything in their charges or findings in Richins’ case. However, prosecutors met with the Utah Attorney General’s Office to get a better understanding of Richins’ insurance fraud allegations. That means additional information could be filed within the next couple weeks.

The defense told the court they would need additional time to look over any changes the prosecution may be planning to make.

Just so others don't have to wade through all that chickenscratch, here's a quick summary, although the writing is pretty disjointed and hard to put the pieces together.
  • Kouri wants Lisa, her mother, to convince her brother Ronald to lie for her and claim that Eric was sourcing drugs from Mexican ranch hands. This was what was detailed in the prosecution's motion.
  • There's something about gummies with fentanyl that Kouri hopes to use in her defense but her attorney Skye thinks could be turned against her by the prosecution
  • Skye also has a PI investigating some ranch (in Mexico?) that Eric stayed at (with Ronald?)
  • Once Kouri is out of prison, they will get "those d*mn b*tches" (Eric's sisters?)
  • Kouri tells her mom that someone named Lotto should not contact her. (Is that her reputed lover?)

Also, Kouri wants Lotto (the same guy she didn't want to contact her) to take out a home equity loan on his property and lend the money to her so she can get out from under the debt. There was a reference to his "hideout" that confused me until I realized Hideout is a town in Utah.
  • Kouri has some devious scheme of anonymously sending out photos of Eric's sister's daughters to media companies. This would apparently "get at" her sister-in-law. I couldn't make heads or tails of that one.
  • More scheming about an upcoming Good Morning America interview. In addition to Skye, more names are mentioned (Chelsea, Kelsey, Selma, Ali) who are all supposed to say that Eric never went to church and regularly drank and did drugs. Also that Kouri's sisters-in-law were jealous of her and her lifestyle.
  • Something about her mom working on gun receipts? This would be for her defense after the prosecutors refuse to follow up on it.
  • Wants her mom to get her Crest Whitestrips because her teeth are getting yellow. She would have to smuggle them into the jail in a plain white envelope via Skye. Although it doesn't seem likely that any decent attorney would willingly smuggle contraband.

Skye is saying even if the gummies have fetanyl in them the prosecutor will say i tried to put the fetanyl in the gummies so eric would have them. Stupid I know but thats what shes thinking. We will still test them though. However, she wants to link eric getting drugs & pills from Mexico so we need some kind of connection. Her private investigator is doing research on the ranch/carts(?) place eric would stay at. Here is what im thinking but you have to talk to ronney. He would probably have to testify to this, but its super short not a lot to it. He will need to tell Skye at the meeting next week.

Upon information and belief: (Just like they say) A year prior to Erics death, ronney was over watching football one Sunday and Eric and ronney Were chatting about Erics Mexico trips. Eric told ronney he gets PainPlus & Fetanyl from Mexico from the workers at the ranch. Not to tell me because i would get mad because i always said he just gets high every night and wont help take care of the kids (there are pictures in my phone of eric passed out on the floor or in the chair. Ronney should have texts from eric talking about getting high as well). Eric told ronney he keeps them in an allergy pill bottle in his work truck so wouldnt find them. Ronney never told me about the conversation. Eric finally told me and asked if Carmen could get him some. Eric never wanted anyone to know he had an issue especially get caught, he always wanted Kouri to go down for him. When they traveled, eric would put his drugs in Kouri's bag at the airlines right before they boarded. That way if they were caught, Kouri got in trouble not him. Once they got to wherever they were going, Eric would pull the drugs out of her bag and it would cause a huge fight. She was pissed he would risk her going to jail for his drug use. He just would laugh about it. Eric couldnt ruin his image that he had drug issues so he would do whatever he had to. Kouri has never done any type of pills, didnt like them. Rarely would she consume THC only if Eric begged her bc it was a special occasion.

*Reword this however he needs to, to make the point just include it all.* The connection has to be made with Mexico and drugs. Ronney will have the messages to prove eric confided in him about getting high. It can be short and to the point but it has to be done. Upon information and belief LOL. They never found pain pills or fetanyl in my house because he hid it in allergy bottle in work truck. And Cody emptied out work truck within a week. So they were never found.

When you talk to ronney about this, meet up with him in person. I worry sometimes your house and phone are bugged. Maybe drive down to SL and meet him after work without bri. Skye has to make the connection between eric and Mexico because that makes the most sense in her mind. If its ronneys information and belief about the conversation over football she can use that as a connection. Tell ronney dont overanalyze it. It was a quick 2 min. conversation LOL. Tell him I need him to do this, bring me home and then we will get those damn b*****s!

Also, please text Lotto. Or call. Tell him do not text me anything about us doing things together. Ever! like church, skiing, trips! Nothing that puts us together, it doesnt look good.

I saw a commercial yesterday Utah mortgage relief google them please. Its for people behind on their mortgage. Can you see if they can help at all on Marissas house please? We have to het hers, your, and Chelseas taken care of ASAP? Try to go to that place in Kamas. What about asking lotto to do a loan solely in his name and not have you on there. I know he can do a home equity line of credit on his house in hideout. Not sure if he would but I know he has like a million in equity. Maybe he just doesnt know about a HELOC (home equity). If he wants to help me, taking care of those loans is most important. I don't give a s*** about the yotels(?).

Remember I told you, one way to get at Katie, is going through my phone and finding a picture of her girls even with the boys. Print 15 copies and send them out annonymously to different media companies. Obviously dont email the pictures so its not traceable. She would be Livid if it got out to the public. You would just have to do it sneakly and be careful. She would try and trace it back to you. If not, no worries!

Skye is having the girls do the first interview with Good Morning America. Please tell Chelsea to bring up that he hasnt been to church in the 13 yrs she has known him. And Eric would brag to her about how much he drank and did pills in high school. Tell Kelsey to say "Eric always wanted Kouri to go down for him". For example he would put drugs in her suitcase when we would travel together so if anyone got caught it was Kouri. He would put it in her bag right before they left the house so Kouri didnt know. Then when he would land wherever, Eric would take them out of her bag and Kouri would be pissed and they would argue about it. Tell Kelsey to say how eric didnt care and would just laugh about it and say, "Well I cant get in trouble." as if it was okay that I got in trouble. Have Selma talk about Eric in Spain not being able to drink so he was looking for drugs the entire time. And explain the drink the waitress gave him. And how I called his doctor and went to the pharmacy immediatley. Have ali talk about how the sisters have always been jealous of me because anything they could do, Kouri could do better. Being a mom, College, Stay at home wife until she built a millio dollar company. A nice house, car, everything She had, they wanted. This comes down to jealousy, money, and erics partying that they dont want to acknoledge and sadly an accidental overdose.

Lastly, dont forget to work on the gun receipts. We want to file charges and let the prosecutor not do anything about it, to use in our defense.

Will you buy a box of Crest White Strips, open them up, put in an envelope, and have Skye give them to me. You can tell her whats in the envelope, im sure she wont care. On Friday, Richins 'had an incident' when given the wrong medication and was taken to the hospital after seizing up at Utah's Summit County Jail. The source said it was the sixth time she's been given the wrong medicine.

While she was recovering, her cell was searched and a six-page letter addressed to Richins' mother, Lisa Darden. In the letter, Richins' asks her mom to tell Richins' brother, Ronney, to repeat a narrative prosecutors say is a lie.

In the letter - included in a no contact order filed by the state - Richins says she wants her brother to repeat the link between Eric 'getting pills and drugs in Mexico' to the fentanyl that killed him.

SALT LAKE CITY (Scripps News Salt Lake City) — Prosecutors are claiming Kouri Richins engaged in witness tampering, according to new court filings.

The filings cite a six-page, handwritten letter to Kouri’s mother, Lisa Darden, allegedly instructing her to have Kouri’s brother, Ronald Darden, falsely testify that her late husband received drugs and pills from Mexico, causing his death. The letter was found when Summit County deputies searched Kouri’s cell block.

Richins faces murder and drug charges for allegedly poisoning Eric Richins with an overdose of fentanyl given to him in a drink the night he died. She has not yet entered a plea in the case and remains in custody, CNN previously reported.
