At the beginning of the hearing, the defense attorneys are whispering about “it’s her fault”. Any guesses what they’re referring to?

I missed any whispering comment and will need to go back and take a listen.

Focusing on the word "fault," I only ever hear the following before Kouri is escorted in:
2:34 "It's not...it's not your fault..."
2:55 "I mean, it was my fault..."

Schemes within schemes.
Greed destroys lives and it (allegedly) cost Eric his life.
Even if Eric put aside generous funds for the boys, if Kouri and co. are granted full custody of the children , it could very well be gone by the time they're of age.
Sad because Eric's family may not be able to protect the boy's interests.
Imo.
Bolding my quote to emphasize it was Kouri's greed.
I think Eric gave her much and did a lot for her and still it wasn't enough.

Please excuse my cynicism, but as they say…. Drastic times call for drastic measures. JMO
She passed the jail kitchen on the way in, and the trustees were cutting onions?

In Summit County, the jail is in the same building as the court.

I heard, “It was her fault”, and then they decided where to seat her. I assume Lazaro’s decision to seat her in the middle was so either attorney could pinch her under the table if she so much as squeaked.

Lazaro didn’t hand her an “it-would-be-a-great-idea-to-start-crying” kleenex this time, though? IMO she’s running short patience with her client, and a dramatic show of sympathy was not on the menu for this hearing.

It’s possible KR is crying because Lazaro simply told her to grow up and stop complaining, like scolding a spoilt child.

Lazaro told the judge the mikes didn’t seem to be working—a slight bending of the facts, ahem, since they could be overheard at the beginning of the livestream, and Lazaro had obviously turned them away from KR, by the looks of things.

Another option to watch the detention hearing.



The prosecution turned to forensic data to ask about phone carrier records, asking if they also confirmed C.L.’s testimony. O’Driscoll said there were several calls and text messages exchanged between Richins and C.L., though they do not know what those messages said. According to O’Driscoll, the messages were deleted from both phones, so detectives were only able to see timestamps of when the calls were made and when messages were sent.

Kouri Richins could be seen in the courtroom with a tissue, wiping tears from her eyes while Detective O’Driscoll recounted the initial call reporting Eric Richin’s death.
IIRC Lozaro dramatically handed KR the tissue as a cue before she started “crying”, or at least, when she wasn’t producing tears, to hide a smirk, or whatever.

There is still the option to appeal for bail. Not sure if defense will file the appeal. My guess is they (defense) have a due date of until July 12 to file the appeal. MOO

Maybe they’ll come up with some sort of health issue she has, and jail is making it worse. Would they propose house arrest, with an ankle monitor?

I'll bet they come up with something like that! I mean, why not? Nothing ventured, nothing gained. But then, would they have to do it live in court? That would not go over well in SM, and not be to their advantage.

By comparison, the judge did not allow Nancy Brophy to live in an Air B&B during COVID, although she said she had incipient diabetes, was getting old, and would almost certainly die. FWIW trial court required a mask, and she was the only one to show up in the entire courtroom without one. Us YT followers pointed out the hypocrisy in livestream comments, and almost on the instant, she was wearing a mask and did so until the end of the trial. Hehe: her attorneys were reacting in real time to comments on the livestream....

So...IMO there's plenty of scope for KR to be retained. The judge could simply order some medical attention? A spot in the SHU? The Summit County jail only houses 100 total, but she could be sent elsewhere?

YES! BEFORE she started crying. There was nothing to wipe although she was squeezing her tear ducts begging for rain.

IMO, she is playing the judge as in *look at me, Im not doing well* .....she was NOT crying her eyes out at the bail hearing except on que. during bailing hearing, she was shaking her head no most of the time as in 'I did whatttttttttt?" Im not on board with the judge wishing her well as he did at the bail hearing. he seems a bit too warm and fuzzy addressing a defendant in a murder case. I understand innocent until proven guilty, but this gesture appears out of place to me. on the other hand, him recognizing she should not be among the community while awaiting trial was appropriate.

IMO she didn't write it, either. She used a ghost writer. She has no empathy for kids, and just wants them to "move on". She's incapable of grief herself, just from the ways she talks in this interview. She researched grief (she even says this) and then copies the feelings and expressions she reads there.

The Behavior Panel frequently talks about how psychopaths do the expressions and express the feelings they think show the real thing. But those expressions are fleeting moments: they don't linger on the face, unlike real emotion. This is the best example IMO I've seen them discuss:

Im wondering if they will try again. After the hearing regarding setting a prelim date, the judge, which I commented on previously as him being odd 'wishing her the best of luck' also made a comment that he would see her on Sept 1 in person, IF NOT SOONER. the defense was asking for 60 days. I dont see her defense coming back any earlier than that on that issue, but its plausible they will come back and make another bid for bail. the constant lament by the judge to keep things moving because she is in jail, well, again its another strange 'concern' IMO for her by the judge.

her display of wiping her eyes and sniffling when he spoke to her was IMO an attempt for sympathy and possibly a setup for another bail hearing maybe?

the mic was working. obviously we heard her and then the mic was tapped to see if it was working. IMO, her attorney didnt want to waste the look of her outfit in a chair. :D

She wrote a check to pay for illegal drugs to kill her husband. The stupidity is off the charts with this one!
and trying to say it was for 'cleaning' purposes. the witness already confirmed it was for the drugs. yes, moronic.

I disagree there will be any chance of bail release given the state clearly met the test for proof evident presumption great during the detention hearing (i.e., the exception to bail being a matter of right for a capital felony).

And Judge Richard Mrazik's constant reminder for keeping the preliminary hearing on schedule because the defendant is being held in custody while presumed innocent is very much the norm today in a climate of bail reform-- especially with civil rights advocates. (It didn't take much research of Mrazick's rulings to see he's very much a "constitutional judicial" including his recent denial for Summit County's request for a preliminary injunction at Park City Tech Center). JMO

Please see the evolution of pretrial bail release in Utah per the attached history of the Statute on this subject.

He does seem to go overboard in mentioning the fact that she's having to be jailed, but IMO he was also quite strict in observing the guidelines for holding her. He was even explicit about this maybe being a capital case (which point KR almost certainly is in denial about).

The "good luck" thing was very strange.

While acknowledging that she may be suffering, the judge also makes it clear that the timing ball is in defense's court. He would rather see less than 60 days, but it's all on them. I don't guess they'll be ready sooner than 60 days, but that's between them and their client. (IMO Lazaro doesn't like her client, so this could be very entertaining.)

As a result of all this, we might not see too many delays in this case.

IMO after what he said the first time, it will be hard to rule otherwise.
