Judge reiterated that Dr Perper's testimony on ??? is not generally accepted in the scientific community.

Is that right? Or is the judge spewing what Spencer said?

This judge is very thorough and doesn't just rule off the cuff. I like that.

No. He only said the prosecution needs to supply more foundation.

I really don't think so. He is a former prosecutor. I think he is very fair and very knowledgeable and sticks to the law. I don't really see him leaning towards the defense or prosecution in his rulings.

ETA: It may appear that he is biased towards the defense because we're all more accustomed to seeing judges that lean more towards the prosecution lol

It seems that you cannot jump to conclusions as to what the judge is ruling until he finishes his statement.

:eek: WOW! This trial thread has picked up a lot. I have a lot of catch up reading to do later. Spend a few days carving pumpkins and we jump 2 entire threads!

Now that the high holiday is over I can settle in and really watch (listened while carving, but I think I missed some stuff with my attention being divided).

I hope they take a short lunch since the bench conference lasted so long this morning.

The judge did reiterate what the defense had said about Dr Perper's findings (?) are not generally accepted by the scientific community. He then went on to say that the state had not completed their questioning as if their questioning would finally answer this issue.

Still IMO it isn't appropriate for the Judge to doubt the integrity, the value, of this doctor's testimony unless he has been found to be incompetent and/or unethical in other cases.

It sounds like the state's position is that the MEs only looked at the body after death, whereas Dr Perper looked at the bigger picture. That would make sense to the jury I think - at the time no one was pushing the idea of murder, so the MEs did what made sense at the time. As more info came forward, it needed another look from a different angle.

Is that the general idea of what the state is doing? If so, I think it's a smart move not to argue that the MEs were incompetent, leading to the need for Dr Perper to take a look.

Maybe, or maybe not. It is their right to do so. I personally enjoy and welcome the differing opinions. It keeps thing interesting.

So the blood was diluted by water (drowning) and further because of the therapeutic treatment (introduction of fluids by IV)?
