Why is that every time this judge talks I feel the outcome is going to be negative? :/

he gets me every time!!! :)

Maybe, or maybe not. It is their right to do so. I personally enjoy and welcome the differing opinions. It keeps thing interesting.

The judge did reiterate what the defense had said about Dr Perper's findings (?) are not generally accepted by the scientific community. He then went on to say that the state had not completed their questioning as if their questioning would finally answer this issue.

Still IMO it isn't appropriate for the Judge to doubt the integrity, the value, of this doctor's testimony unless he has been found to be incompetent and/or unethical in other cases.

Maybe you're right, but I thought he just was stating what the defense's position was and that in order for him to be able to tell one way or the other that the state should form more of a foundation.

Funny thing is, I don't think they've done that since resuming and the defense hasn't said a word. I'm so confused!

Yesterday there was some conversation about the inmates testifying against "DOC" < His loving nickname from jail.
Seems some of the other inmates were not happy with the guys that were subpoenaed, and willing to talk. These inmates are afraid of being deemed snitches.

Sounds to me like MM has made some friends, to help protect him maybe??

The inmates who claim to be afraid to testify have said they are worried that some of their fellow inmates will find out about their testimony. As a result the testifiiers will be labeled as "snitches". In general, criminals don't like snitches.

On possibility is that the testifiers fears are real. Another possibility is that they are simply trying to use their testimony to get favorable treatment like a transfer to a different prison.

AS I UNDERSTAND IT, it has absolutely nothing to do with a fear of MacNeill himself.

It is my understanding that before the trial began, the judge said that MICHELE
would not be referred to as THE VICTIM, rather by her first name.
Is her name spelled with one L or two?

Guess defense is waiting until they are up at bat? If the defense doesn't attack this witness's credibility on cross then IMO it was an opinion only and had no business being voiced in a court of law.

I agree with you, although it remains possible that MacNeill delivered (or had delivered) threats. It does seem unlikely.

All this medical testimony is hard for me to follow, but the gist of it seems to be that he feels she must have drowned because that's the only way to explain the dilution of the blood, but that he can't comment on what may have led to the drowning. Is that what you guys are getting?

Thanks for the updates. I like Perper but I did nod off lol. I do agree with his findings. Hope the Jurors don't have any difficulty understanding him.

Though her husband is on trail for her murder, a cause of death has never been determined for Michele MacNeill. Today, a noted forensic pathologist and toxicologist testified that he believes the former beauty queen died as a result of drowning.

Dr. Joshua Perper, a retired medical examiner who was called as an expert witness at the murder trial of Dr. Martin MacNeill, said that not only did he believe the mother of eight was drowned, but drugs could have also played a role in her April 11, 2007 death.

"It was clear she was inhaling a significant amount of water," Perper said.
He said the report that MacNeill regurgitated more than seven cups of water during the resuscitation process also played a role in helping him reach his conclusion.

"In addition, she had some drugs on board [that] in my opinion, could have contributed to her death," he said.

It's too bad the level of drugs in her blood couldn't be determined due to dilution and not knowing the dosage and times the drugs were ingested.
