I think our justice system has it wrong, Alexander Whipple should be charged with Capital murder, rape of a child. And the burden of proof that he did NOT commit those acts should be on him. He would have to bring forth the evidence that he did not murder a child or rape a child.

It would be easy, where is Elizabeth? Prove you didn't do these things..

But how could he prove he didn’t do something? How do we know someone else didn’t do this and this guy is just dumb enough to pin it on? How can AW prove he didn’t take ES if someone else did and he genuinely has no idea where she is? Not saying he was uninvolved or that anyone else was involved. But you cannot expect someone to prove they didn’t do it.

It sounds like the window we are looking at is 2:00 AM to 6:46 AM? The video of him only blocks from the home with no Lizzi. Wherever he left her would seem to be close by the house, but LE seems to have done a through search and found nothing. It's insane that someone can commit a heinous crime and sit silently in jail. I'll never understand how their conscious allows them a moment of peace.

It’s possible.

He got wet somewhere though, and it certainly wasn’t from walking down the road.

My guess is that the condition of his clothes was impacted by where he went.

And where he went, was to dump Lizzy’s body.

I imagine that trash cans and dumpsters were searched during this process.

So I’m leaning towards him not putting her in a trash can.

No chance. I am retired and can’t keep up either. It is almost 1.30 a.m. in Germany. I have to go to bed now and pray that this innocent little girl will be found soon or this perp will finally talk. Frist thing I am going to check when I get up in the morning.
I'm retired too AND have a life.

I’m curious as to the reasoning for them withdrawing calling this a recovery - as per last presser

Maybe someone complained? He admitted le thinks differently, and everyone knows they often have to deal with families going through horrible situations. Maybe until an investigation reaches a certain point they shouldn't say out loud or include in press updates what everyone pretty much suspects but some aren't ready to hear? :(

No, but when critical evidence, a child is missing, and the accused is not cooperative with LEO. I think that the burden of proof should change.

5 year old girls don't just disappear. Someone who had nothing to do with the dissapearance would cooperate with LEO.

This just happens too often. Like Caylee Anthony...the killer was able to be free.

What critical evidence? None of us actually KNOW he did this. How do we know that the police really have definitive evidence that she was injured, and that he was the one who did it? I actually don’t believe they really got conclusive DNA evidence in that short span of time before they started saying they did. Police are allowed to say that to put pressure on. Perhaps they are trying to make the community think their guy is definitely 100% behind bars so there isn’t panic.

We don’t know what proof they have that he did. All we know is that her mom said this is what happened. Do we even know for 100% certain that he stayed that night? Do we know she was alive when he got there? We don’t know anything for certain except that she is gone and her mom said that he took her.

Your idea of changing the justice system and the rules our constitution lays out for us is simply crazy.

Haha. Honestly I don't know about the field on the west side. Like I said the place is huge. Up the street by the storage units they even have a waste disposal area that stinks. Yes they work on Saturdays during the busy season which is typically around Memorial Day to Labor Day (grilling season) but I'm not sure when they decided to start doing Saturdays again this year. (It was slower in February)

Lol. I looked them up on the map- it is a very big facility. I was surprised to see homes so close by. Google shows them to be open 24/7 but I know that might be an error.
I guess it would be hard for him to get in and out without being seen by someone or showing up on video.

I feel like she was thrown away and they need to be searching the dump. :’(

It kind of looks like he isn't wearing shoes? Toe area is pretty flat looking and toes are curving upward. Guess it could be dress shoes...

Possibly, but this kid doesn't seem to have any connections to anyone, seems to be a loner. I think he did something to Lizzi and hid her body all by himself.

Well... he got his drugs from somewhere. I’m sure he did do something on his own to ES, but until there is actual evidence there is no way to know. It’s really weird that she hasn’t been found but he was spotted on camera so close without her.

This makes me wonder what the matching DNA is, now, which links the two. If it were bodily fluids which indicated she’d been molested and/or injured, they’d at least be able to charge him with that, right?

Wouldn’t the attorney know that? Why bother asking for release if the police could, in turn, just file those charges in response and keep him around longer?

It's their job to force due process.

But the DA has to be careful. They can charge him, likely, with various things but they have to be cautious about double jeopardy. So they might do something like charge him with disposal of a corpse, like in the Maleah Davis case, but not assault, which I believe could cause double jeopardy to kick in if they later had evidence of murder.

LOGAN — Shortly after Logan police launched the search for 5-year-old Elizabeth Shelley on Saturday, they said they found evidence near her residence that linked Alex Whipple, the girl's uncle, to the missing child.

"These items have been forensically tested and they do link Mr. Whipple to our missing child, Elizabeth. They also have evidence that links them to the residence that they were in," Logan Police Capt. Tyson Budge said Monday.

"(It) also links them together outside the home. We have several of these scenes that we have located that have evidentiary items in that we have now tested and have evidence that they were together."

Search warrants have been served at the missing girl's residence and samples were taken from Whipple himself, he said.

Evidence collected thus far points to Whipple, according to the captain.

"Since the very beginning of this investigation we have enough information and enough evidence we believe that Alex Whipple was involved in the disappearance of Elizabeth Shelley. We're putting together a case and as soon as we have more information, we'll make that available to you," Budge said.

Whipple was booked into the Cache County Jail for investigation of failure to disclose identity, possession of a controlled substance and drug paraphernalia, possession of a dangerous weapon by a restricted person and other potential charges. Previous court records list his address as Providence, Cache County.

Whipple has a criminal history. In 2016, he was convicted of assault in an incident of domestic violence involving a "cohabitant," according to state court records. He was convicted of joyriding in another case that year. He was charged with possession of a controlled substance in 2017.

Also in 2017, Whipple stole a car from his neighbor and led Utah Highway Patrol troopers on a 40-mile chase while driving under the influence of alcohol, according to court records. He finally stopped after police in Orem spiked his tires. He was arrested as he tried to run away.

He was sentenced to prison on March 19, 2018, but the prison term was suspended and he was ordered to serve 180 days in jail and five years of probation. Terms of his probation include no alcohol, no illegal drugs and drug testing and no violations of other laws, according to a court docket.

THANK YOU LUCILU for this photo. I can’t get a video and I can’t see him in the railcar photo. But this is important

This sighting behind the abandoned rail car at Western Mechanical is:

1. Just across the railroad tracks from the intersection of W100 S and S 600 W

2. Kitty corner from the 7th Day Adventist Church where there was some talk that evidence had been found

3. Half a block south of the Cafe Sabor where he was on surveillance walking NORTH approximately 15 minutes after this reported sighting !!

4. About 4 long blocks from the home.

So the perp was skulking around that area at 6:30 am - apparently without backpack or carrying anything. He then appears to have walked north, which is in the opposite direction that he finally was apprehended in.

LE- TEAR THAT PLACE APART !!!

And the time frame is really narrowing down. That’s only 4 1/2 hours.

Can anyone speak definitively to thegarbage collection situation the morning she went missing?

We're garbage cans set out? We're dumpsters in the area searched before pick up?

If feel like she is going to be found as long as she didn't get picked up by the trash. That seems to be a great way to hide a body.

Oh joy. He's a real prize. Frankly I'm surprised we haven't heard of him until now. I can't believe some lucky lady didn't snap him up and have him immediately start babysitting her vulnerable toddler.

Interesting, the biological Father of Elizabeth has not seen her in four years, or been with Alexander Whipple, and yet he doesn't think that the uncle would hurt her. He hasn't been there...how does he explain his daughter is missing?
Please make sure you read his whole comment (which was a Facebook comment, not an interview.). He says that he knew AW 4 years ago and didn’t think he could do this, then he says, but a lot can change in 4 years. This article is trash.
