The Army confirmed Wednesday that Cory is an Army veteran who held the rank of Sgt. 1st Class at the end of service in September 2017. Additionally, according to court documents, Cory was previously charged in 2018 with assault and battery involving a family member. The charges were later dismissed.

Court records state that he has family in Norfolk and some college education. Records that identify his financial resources state that he has, “military retirement; disability,” but it states that he does not currently have a place of employment.

Now that investigators are combing through new leads and have cleared out their staging area, people in the community have taken it upon themselves to knock on doors and search areas that may have been missed by law enforcement.

Volunteers braved the cold Saturday to search for the child behind the woods of Restoration Church on Fox Hill Road. The church sits adjacent to Buckroe Pointe Apartments, where Codi was first reported missing.

Some were armed with machetes as folks hiked through thorns and mud in hopes of finding something that could help bring the boy home–digging through an abandoned storage unit and bodies of water.

“A lot of people are very concerned, a lot of people are very upset and we just want a favorable outcome for Codi. We’ve been printing out flyers, working with different organizations just to make sure that people aren’t forgetting that there’s some little boy out here that is potentially out on his own,” said MW who grew up in Buckroe Beach, “Even though its been a week since he’s gone missing, it’s still important that they constantly see his face and know that any information, any tip is important.”

The child was reported missing on Jan. 31, and police haven't stopped searching for him since.

Many people in Hampton do not personally know Codi Bigsby, but those who stopped by the memorial have one thing in common.

Cory Bigsby reported his son missing at 9 a.m. on Jan. 31, telling police he last saw his son sleeping in his bed about seven hours earlier. But police say that doesn’t match other evidence in the case, and they don’t believe the boy walked away in the middle of the night. <>

Outreach by the FBI <> also has raised speculation that the boy has been missing for much longer.

The FBI asked people to come forward if they have knowledge of the comings and goings of Codi or his father since the holidays. “Have you seen Codi, his father Cory or his siblings since Christmas?” an FBI message posted to social media asked.

After his opening statements, Hampton Commonwealth's Attorney, Anton Bell said Cory Bigsby has previously been convicted of AWOL in the military and Cory confirmed that was true.

Jeff Ambrose, Cory's attorney, said this was not a question he was expecting today.

"I don't believe [Cory] lied, I believe when the question of whether or not he had a conviction came up, he wasn't thinking of military convictions," said Ambrose.

The judge was concerned about past violent complaints and said the AWOL military conviction was also concerning.

In the meantime, Ambrose says he's expecting over 72 hours of interview footage coming from the Hampton Police Department, all of which were taken during the first week of Codi's disappearance.

Ambrose says he will also receive discovery materials collected by state and federal agencies during the investigation and search for Codi.

Immediately following the bond hearing on Tuesday, Ambrose said he filed an appeal. He is hoping for a second bond hearing.

Bigsby’s estranged wife took the stand, advocating for him to get released on bond. Many of his family members also attended the hearing but did not want to comment on the case.

Ambrose has also said he doesn't think his client's rights were upheld while at the police station.

"My understanding is that he did request an attorney and to remain silent -- at least at some point during this process -- and that those requests may not have been honored correctly," Ambrose said.

Cory’s estranged wife was in the courtroom Tuesday as a witness. The defense attorney, Jeffrey Ambrose, called her to the stand. She testified that she would help Cory with any court requirements if he was granted bond.

The couple has multiple children and she lives in the Hampton Roads area, Ambrose said. Her children are not the ones in the home when the alleged child neglect incidents took place.

  • The estranged wife who testified today is the mother of Cory's four older children. The four older children are not related to the events cited in the neglect case involving Codi and the three other children in Cory's home.
  • On the stand, she clarified that she was not Codi's mother or the woman who filed the complaint in 2018.

On or about Jan. 11, EM remembers seeing people at Cory Bigsby’s new house,

“There was one adult male who looks like he could be similar to his description, and maybe two other adults around as well. They were cleaning and bringing stuff out and the kids were playing and kind of keeping busy,” she said.

She said she does not know for sure it was Codi and Cory, but last Saturday, she took a picture of the police at the house.

“They were checking it out. Using a K-9 to check out the backyard, and then they were over kind of at the neighbor’s house,” she said.

EM said she does not think the police took anything from the property during that search.

“I looked in the backyard… The gates were all wide open. The shed was completely stripped open. We could see everything had been opened. There was nothing left to be hidden. It was all very much out in the open,” she said.

After multiple speakers questioned where the mayor and City Council have been during the search, Hampton Police Chief Mark Talbot told the crowd he’s received their support behind the scenes of the investigation.

"I want to start by thanking you all for not being a distraction throughout a very long and difficult investigation," said Talbot. "Obviously, the public has no way of knowing the number of conversations that I’ve had with you all and the emails, the phone calls, nobody knows that. Nobody needs to know that."

From there, the tension between activists and the chief grew.

"Y’all want to sit here and call somebody a distraction? This is a distraction. Get your hands off me, pretty boy," said local organizer Japharii Jones as officers escorted him out of council chambers as he yelled expletives in his bullhorn.

“This is emblematic of what we’ve tried hard to avoid," said Talbot in response. "We didn’t want it to become a sideshow."

Talbot said he wants to reassure everyone they are still very dedicated to this investigation and finding Codi.

"We’ve followed the evidence from day one. It was very clear to us the evidence about what likely occurred has been very clear. There is little about this that has been mysterious."

Early on in the investigation, Hampton Police Chief Mark Talbot told the public that he considered both of Codi’s parents to be “persons of interest;” however, he’s since cleared Codi’s mother. ...

Codi’s mother has participated in the investigation and answered the police department’s questions, but she had not addressed the public. That changed on Thursday when she released a statement through a family spokesperson exclusively to 10 On Your Side investigators. We are releasing Codi’s mother’s statement in full, but have chosen not to name her because she is not a suspect in this case:

“At this present time, I do not wish to take part in any telephone, television or social media interviews. My reluctance is based on the upcoming trial and the questions asked are questions that will be addressed in court. In addition, I have been advised by legal counsel not to address the public. However, I would like to speak to the support of the community. I sincerely appreciate all the volunteers, rescue workers, police, FBI, news reporters, the community at large, family, friends, and everyone who is showing love and support for Codi. It truly warms my heart. I am praying for the safe return of my baby boy, Codi. I hope the public and the community understand and respect my position during this tragic time.”

Bigsby remains in custody on the child neglect charges after a Hampton Juvenile Domestic Relations Court judge denied him bond on Tuesday. Bigsby was transferred to the Hampton Roads Regional Jail in Portsmouth on Thursday morning where he has been placed in quarantine, according to jail spokesperson Sharon Scott.

“He will be assigned to housing within the next 20 days, depending on the results of his COVID test,” Scott told 10 On Your Side investigators in an email.

Attorney Jeffrey Ambrose is representing Bigsby in the child neglect case and has filed an appeal on the judge’s bond decision. The appeal hearing is scheduled for Feb. 25 in Hampton Circuit Court.
