On Monday, Matheny-Willard sent a motion to clarify to Hampton courts. In the filing, she says Bigsby disagreed with his former attorney, Jeff Ambrose, on legal strategy, so Bigsby fired Ambrose on April 7. That was before Ambrose asked the court to leave the case because of an ethical conflict.

This new motion to clarify also asks the court to seal or redact Ambrose's motion to withdraw to only include Ambrose's name and the words, "I wish to withdraw."

Matheny-Willard argues the language used in current court filings could taint a future jury pool.

Now, the City of Hampton's attorney, Cheran Cordell Ivery, has responded on behalf of Mayor Donnie Tuck and Hampton Police Chief Mark Talbot.

In response to requests made in the cease and desist, the City has made the following responses:

  1. They say Chief Talbot will not retract any of his statements about the disappearance of Codi Bigsby and the police's ongoing investigation into his whereabouts;
  2. The city states that no statements made by Chief Talbot have obstructed justice or tampered with a potential jury pool.
  3. According to the letter, the City does not endorse or condone harassment or threats made against anyone. They say if this occurs, then it should be reported to law enforcement immediately.
  4. Lastly, the City denies that Chief Talbot made statements that put anyone's life in danger.

In response to the attorney's claims that the police department did not seek to initiate an AMBER Alert, City of Hampton says that is not true. They state in the letter that State Police have criteria of when to issue an alert. The city says they made a request for one, but State Police denied it for not meeting every criterion.

In a separate letter, Matheny-Willard put the city on notice of the family’s intent to file suit against Hampton city officials. Ivery wrote that a “notice of claim” against the city — asserting that the city is liable for damages to the Bigsby family — would be responded to by the city’s insurance risk manager.

“The City of Hampton and the Hampton Police Division’s efforts remain focused on finding Codi Bigsby and will continue in this regard until such time as he is located,” Ivery wrote.

Codi Bigsby’s family attorney files formal complaint against Hampton police chief

On Wednesday morning, Attorney Amina Matheny-Willard filed an internal affairs complaint on behalf of Codi Bigsby’s family against Hampton Police Chief Mark Talbot.

The complaint alleges Talbot made reckless and false statements about the Bigsby family’s lack of cooperation.

It says the way he made these statements at a public town hall meeting provoked verbal life-threatening attacks by community members.

Hampton police said the complaint will be passed on to their Professional Standards branch for follow-up. They declined to comment further.

HAMPTON, Va. — The lawyer of Cory Bigsby has filed a motion for a Hampton judge to reconsider bond for the third time in total.

Cory Bigsby, who is the father of missing 4-year-old Codi, has been in jail since February on seven charges of felony child neglect that are unrelated to his son's disappearance.

Among them: Hampton police admitting investigators ignored Bigsby's requests for an attorney. She also said prosecutors "grossly overcharged" Bigsby with seven counts of neglect.

Bigsby's attorney said she immediately filed an appeal after the hearing on Monday.

Talbot said based on the evidence HPD has, it is not looking for another suspect.

The Chief said he doesn’t want to speculate whether or not Codi is alive or not because he doesn’t know. But he said there is no evidence that he is alive.

Talbot added that he believes the reason why the child hasn’t turned up is because people are not telling the truth about his whereabouts or what happened.

Bigsby's lawyer, Amina Matheny-Willard, set the bond hearing court date for June 7 at 10:30 a.m. Bigsby will be appearing in court on video, not in person.

In court Tuesday, his new attorney Matheny-Willard asked Judge Wilson to reconsider Cory’s bond. She claims his last attorney Jeffery Ambrose was “ineffective.”

“At his previous bond hearings, the Commonwealth’s Attorney’s [office] used evidence that was improper, as I’ve argued before, to kind of stir up emotions.”

“They are continuing to say he’s a person of interest. It’s been over five months and that was the first narrative the police department put out there. So, everyone’s all upset because they feel based on what the police department and Commonwealth Attorney’s office have done that he’s responsible for Codi’s disappearance and he absolutely is not.”

Kevin Kulp with the Hampton Commonwealth’s Attorney’s Office, called on four witnesses; a Walmart loss prevention specialist, two car dealership employees and the new lead detective Steve Rodey.

Walmart security camera video shows Cory in Walmart alone on January 25. Cory admitted to police he left his four young kids home alone that day.

Another video from a car dealership in Norfolk shows Cory with one child on December 13th.

Detective Rodey confirms Cory was away from his 3 youngest kids for 6 hours that day.

Judge sends Bigsby's child neglect charges to grand jury, denies him bond 5th time

HAMPTON, Va. — Cory Bigsby, a Hampton man accused of felony child neglect, was denied bond by a judge for the fifth time on Monday.

In a morning court hearing, the judge found that there's enough evidence in Bigsby's case to send it to a grand jury on July 5. That grand jury won't decide if he's guilty; they'll decide if there's enough evidence against Bigsby that he should face trial for child neglect.

According to a source close to the investigation, tells WTKR the new charges in this indictment include 15 charges of child neglect for leaving the children home alone. Four more charges of alleged child abuse and two additional child neglect charges in connection to those child abuse charges. Also, two misdemeanor charges were added for failure to secure medical attention for an injured child.

According to the documents, they were left alone long enough for it to be considered ‘a reckless disregard for human life.’

Court documents show that he neglected to care for at least one of his four children on December 13-15, again on December 28, on January 11 and 25, then once more on February 1.

Court documents say Bigsby committed an act against a child that was, “so gross, wanton, and culpable as to sow a reckless disregard for human life.”

Family lawyer Amina Matheny-Willard is expected to hold a press conference at 1 p.m. Friday to share more information, specifically to talk about what she says has been inaction by the commonwealth in the case.
