Judge sends Cory Bigsby, father of missing Hampton 4-year-old, to mental facility

The mental examination results come from the third doctor to evaluate Bigsby’s mental competency. One of the previous doctors who evaluated Bigsby, hired by the defense, was not on the commissioner’s list of appointed physicians.

Bigsby’s lawyers argued that the other doctor, who found that he was fit to stand trial, had reported false information. His lawyers cited an instance when the doctor provided inaccurate information about where he was raised.

Cory Bigsby headed to Eastern State Hospital for further mental health evaluation
Cory Bigsby, the father of missing Hampton child Codi Bigsby, will undergo mental health treatment for around two months.

Also in court Friday, the judge discussed a motion filed by Bigsby’s defense team to drop the charges. They based their motion on evidence obtained by the Commonwealth, which the defense claims wasn’t submitted to defense for months.

The evidence is a written statement Bigsby wrote while in jail. Bigsby’s defense team said the Commonwealth got a copy of that letter on August 3, but did not share it with the defense team until November.

Cory is going to Eastern State Hospital for a “restoration process” to help restore his mental capacity so he can get to a point where he is capable in participating in his trial.

Although the contents of the letter have not been released to the public, WAVY News is told it was not a suicide note or any kind of confession.

The Bigsby family says they believe Codi is still alive but believe he is being sex trafficked. They say Hampton Police have not done enough to locate the missing boy.

"I believe in my heart, I know Codi is alive. But I believe he's being trafficked somewhere," said Cory's aunt, JH. ...

Court documents show a different court-approved doctor said Bigsby failed to understand the circumstances of his charges. In addition, Cory he claims he has no recognition of the names of the children listed in the indictment that he had been parenting.

"I do believe that Codi is no longer with us but I pray every day that he is," said Strickland, who is the organizer of "We Are Codi's Voice."

Strickland and the Bigsby family have not seen eye to eye.

According to Bigsby's attorney, the family is considering taking legal action against Strickland because they don't want her collecting funds on Codi's behalf, for a tribute she's organized.

Attorney walks back statement about Cory Bigsby’s jail letter

Matheny-Willard’s motion to dismiss is based on the discovery of a letter Bigsby wrote in jail. Matheny-Willard would not divulge the contents of the letter, but said it “changes the course” of Bigsby’s trial and shows his deteriorating mental health.

On Friday, 10 On Your Side investigative reporter Julie Millet asked Matheny-Willard directly if the letter was a suicide note or confession, and the attorney said no. On Saturday morning, Matheny-Willard sent a text to several reporters, including Millet, changing her initial statement. She said, “Because the statement is verifiability untrue, nonsensical, and bizarre, I do not consider it to be either one.”

Zwermer concluded that Bigsby understands the roles of the judge, jury, and prosecution, but doesn’t have a “rational appreciation for his legal circumstances” or the ability to help his defense team, court records show.

Zwermer highlighted two instances that led him to believe Bigsby doesn’t understand the seriousness of the charges against him. When the doctor asked Bigsby about the 30 charges he’s facing, he said he was arrested for “buying too many groceries” and that he “didn’t take the kids when they were asleep.”

Zwermer wrote that Bigsby’s own biographical information was full of inaccuracies, including how many children he has and their names. Bigsby denied knowing the names of the four sons he’s charged with abusing and neglecting.

Bigsby’s been placed on suicide watch at least twice while incarcerated at the HRRJ. Once he was discovered hoarding medication in his cell, and another time he told a corrections officer he intended to hang himself. Both times, Bigsby denied having taken the action or issuing the threat, court records state.

Bigsby also complained to a mental health professional that he heard voices in his head telling him to kill himself. He also told jail medical staff that there was a machine implanted in his head and asked for surgery to remove it, according to court records.

Duo traveling to Maryland to put flyers up for Codi Bigsby

The main reason is that the groups know the Bigsby family has ties in the Maryland area near Washington D.C. They want to put up flyers like this one to let family members know Codi is not forgotten.

“We are going because we are letting the residents of Maryland know this child is still missing,” said Nancy Strickland with “We are Codi’s Voice.”

We sat down with both leaders of the groups traveling to Maryland on Monday.

“The awareness needs to be brought to them as well that this baby is missing from Hampton,” Klalil Cribb told 10 On Your Side. He heads “United We Stand of Hampton Roads.”

They believe people are forgetting Codi Bigsby.

Some would believe this trip is a waste of time. Not to them.

“Absolutely not,” Strickland said. “This is not a waste of time. What does it hurt to search, exactly? What does it hurt? We need to keep his name out there.”

They make the trip knowing that the Hampton Commonwealth’s Attorney and the former Hampton Police Chief, Mark Talbot say that Codi is presumed dead.

“Codi is not going to be forgotten,” Strickland said. “I’ve said from the start, ‘We are Codi strong.’ We will never let Codi’s name die. We are Codi’s voice.”

Inspiring mission to remember Codi

We watched them leave, these two determined goodwill ambassadors.

They stopped at a rest area to hang a flyer.

They went to a Metro stop in Capitol Heights to spread the word, putting flyers under windshield wipers for Metro riders to see upon their return. The Bigsby family has members living around Capitol Heights.

And the final stop is the White House. Strickland took video of Cribb taping up a flyer on a park bench.

Strickland can be heard on tape.

“Hey everybody this is Nancy Strickland of We are Codi’s Voice, and here is Klalil Cribb of United We Stand of Hampton Roads and we have made it to the White House to post the poster right outside the White House. We hope we can bring some type of awareness in D.C.”

Sources: Cory Bigsby charged in death of 4-year-old son, Codi

10 On Your Side has learned that Cory Bigsby was indicted on charges connected to the death of his 4-year-old son, Codi.

Sources tell 10 On Your Side that Bigsby was indicted by a grand jury on Monday. The paperwork associated with the indictment has not been filed yet in Hampton Circuit Court, according to clerks in that office.

McKenna also wrote that Bigsby understands the legal process in front of him, but continued to be guarded about the case. During a May 9 meeting with the restoration counselor, Bigsby also discussed a “hypothetical plea bargain.”

Bigsby is due in Hampton Circuit Court on Wednesday.

Cory Bigsby indicted with murder of 4-year-old son Codi Bigsby, sources say

Cory Bigsby has been indicted on a murder charge in connection to the death of his son, 4-year-old Codi Bigsby who went missing last year, sources tell News 3.

Cory has been in custody since Feb. 2022, indicted on charges of child abuse and neglect that were not related to Codi's disappearance.

Now, sources tell News 3 Cory was indicted by a grand jury on Monday on a murder charge.

The revelation comes just a day after WAVY broke that Cory Bigsby had been indicted by a grand jury earlier this week and that he had been deemed competent to stand trial. Bigsby’s attorney, Amina Matheny-Willard, declined to comment on the case on Monday.

But based on a statement Bigsby made while locked up on a host of child neglect and abuse charges, Hampton police and the FBI searched an outdoor area in Maryland, near Washington, in the summer of 2022, a law enforcement source said.

Though that didn’t turn up any leads on Codi’s whereabouts — and the boy’s body wasn’t found — Bigsby’s jailhouse statement is still being discussed in his case.

In March, one of Bigsby’s attorneys, Amina Matheny-Willard, wrote in a motion to toss the case that prosecutors — through the regional jail correctional officer — “obtained a statement” from Bigsby last August while he was locked up. What exactly Bigsby said in the statement remains a mystery.

Matheny-Willard contended that prosecutors slow-walked providing the jailhouse statement to Bigsby’s defense lawyers, saying it took more than three months to turn over. But Hampton Commonwealth’s Attorney Anton Bell said it didn’t need to be shared earlier because it involved the investigation into Codi rather than the other pending charges.

It wasn’t immediately clear Friday whether that obtained statement was part of the basis for this week’s new charges.
