I really wish the story on this little guy got more media coverage . This little guy deserved more deserved better. .I hope Codi gets justice but even more I hope one day they can lay Codi to rest properly.jmvho
I have not forgotten this case and looking forward to the trial and conviction. Thank you for the update.
 
HAMPTON, Va. — The trial for Cory Bigsby, the Hampton man accused of killing his 4-year-old son, has been postponed.

The delay happened during a Tuesday morning pre-trial hearing for Bigsby, who is facing charges of murder and concealment of a body in the death of son Codi, who was reported missing in January 2022.

The trial was originally set to begin November 6, but Bigsby's defense attorney, Amina Matheny-Willard, said she hasn't completed a review of the prosecution's discovery in this case.
While Hampton Circuit Court Judge James Hawks agreed to move the trial, he said he didn't know why Bigsby's defense didn't complete their review, despite having "ample time to do so." Hampton Commonwealth’s Attorney Anton Bell told Hawks he wasn't informed the defense would ask to move the trial.

They make me soo fricken angry I've followed this from the beginning all the delays and bs stories . Wish they would just say where's Codi jmoo
 
Cory Bigsby's defense team files motion ahead of trial, asking judge to strike prosecution's witnesses.
a newly filed motion in Hampton Circuit Court, his attorney, Amina Matheny-Willard, said the Hampton Commonwealth’s Attorney’s Office didn’t give them a witness list on time.

Because of that, Matheny-Willard said Judge James Hawks shouldn't allow the prosecution's witnesses on the stand.
I wonder if defense will be successful I hope not considering the judge gave them another delay. Does anyone have any knowledge on this ?

... She was allowed to escort her client to a bank Tuesday to take care of financial matters, and her motion to suppress evidence, as she is challenging mental competency, will be heard next week.

Matheny-Willard this afternoon issued a statement to 10 On Your Side, saying in next weeks hearing she will object to a prosecutor’s plan to allow a child to testify via closed circuit television. This objection raises questions about whether the victim’s siblings can shed light on what happened to their baby brother. She said the prosecution’s video plan poses due process issue under the 14th amendment.

“[The Defense] is objecting because it gives the jury the impression that my client should be feared, which is not true and it interferes with his presumption of innocence,” she said. “Additionally, it is a violation of his Constitutional Right to confront and cross-examine the witness against him.

Amina is simply grandstanding in order to ride the publicity this high profile case is garnering her. She knows very well that this attempt to stop the minor sibling from testifying by video will be unsuccessful. It is long standing practice to allow minor children to testify from another location and their presence in the courtroom hasn't been required for a number of years. She is wasting time, money, and effort. None of it helps her client or leads to Codi.

Introduction
Virginia, among a number of other states, has taken steps in recent years to reduce the trauma experienced by child victims when they must testify in court about what happened to them. One such step is a 1988 amendment to the Code of Virginia that allows child victims in criminal proceedings to testify from a room outside the courtroom via two-way closed-circuit television.

Section §18.2-67.9 of the Code permits this in cases involving certain criminal offenses, under certain conditions, when a victim is 14 years of age or younger at the time of the offense and 16 years or younger or the time of testimony. Revisions to the Code in 1999 include a child witness who is 14 years or younger at the time of the testimony. Additionally, in any civil proceeding involving alleged abuse or neglect of a child, the child’s testimony may be taken via closed-circuit television (§63.2-1521 ;16.1.252 (D) ) if the child victim is 14 or under at the time of the alleged offense and 16 years or younger or the time of testimony, or a witness who is 14 and under at the time of testimony.

To clarify -- I don't like it when a child's testimony is needed, but I absolutely love it when the court allows the child to appear via video.

I understand and value the accused's right to face the accuser. Especially if that's anything like a reasonable match.

Child about parent, child about any adult with care, custody, & control, adult abuser -- protect the child first & let the court sufficiently protect the adult.

BTW, where is Cody???

except that is the most likely thing that did indeed occur and the complaining minor witness should be protected pursuant to Section §18.2-67.9 of the Code as established in September 1995: as Revised July 1999: and again in 2002.

Where is Cod Bigsby Amina? Ask your client. BTW, still waiting on those photographs and affidavits of people who allegedly saw Codi after LE say he was dead? It's been what six months or more since that claim was made and yet nobody has had time to produce them to LE or the press or anyone? They must be too busy with their searches for Codi, oh wait . .

The family added that they had seen Codi within that seven-month time frame between June and January, specifically once in September.

"He's been at my house during that time," said Butler.

Butler and fellow family members also claimed to have seen photographs of Codi from that time period, but said they could not share the photos with us.

my concern is, if the confessions are tossed, what does LE and the state have in the way of actual evidence? I have zero doubt he killed or neglected Codi to death and disposed of his body. I want to see him pay and sure as heck don't want to see him EVER get custody of Codi's siblings EVER EVER EVER again.
 
I am hopeful, since these confessions being discussed occurred in August of last year, well after he was advised of his rights to counsel and hired Amina, that the judge will allow them to remain in but afraid of what it would mean if not.

The statement was introduced in court Wednesday in a motion by Bigsby’s attorneys to prevent four written jailhouse statements being used as evidence in Bigsby’s murder trial. The defense asserts that Bigsby made the statements under duress.

“Then went home and prayed for forgiveness,” Bigsby wrote. He went to King’s Dominion the next day, and later “dumped my clothes from the crime in the trash and burned them.”

“Then the next day I went back to burn Codi and cover up scars from the beatings,” he said, though the statement doesn’t explain how he accessed Codi, given that he previously wrote that he was already buried.

“Then I went home and took a bath with (another child),” he wrote. “Please except my confession! Sincerely Cory Bigsby.”

This was a November 2022 jailhouse confession. I believe it's his most recent. I believe it's the closest he has come to telling the absolute truth. The previous confessions were all minimizations. I stepped outside and found him unresponsive. I stepped outside and found him at the bottom of the stairs, etc. This one . . . This one rings true IMO MOO

I'm pretty sure only one confession was given before he got the lawyer. The rest are after. Cory doesn't have a chance imo jmoo
