Prosecutors are seeking to block a request for a gag order in the case against Jesse Matthew Jr. in Fairfax, Virginia.
Matthew, 33, is charged with abducting University of Virginia student Hannah Graham, who was found dead a month later. He is also charged in an unrelated 2005 sex assault and attempted murder in Fairfax, where his defense attorneys asked the court in December to enact a gag order.

Harrington and others think sexual assaults are not properly handled or reported by colleges who fear bad publicity.

Jesse Matthew charged in slaying of UVA student Hannah Graham

(CNN)A man suspected in last year's killing of University of Virginia student Hannah Graham has been charged with first-degree murder in the case, a prosecutor told reporters Tuesday.

The murder charge against Jesse Matthew Jr. comes in addition to a count of abduction with intent to defile filed against him previously, Albemarle County Commonwealth's Attorney Denise Lunsford said.

"These indictments signal the beginning of the next phase in what has been an incredibly difficult process for the family of Hannah Graham, for our community and for the men and women of the many departments and agencies who have worked on this matter since September of last year," Lunsford said.

Lunsford said she chose not to seek a capital murder charge, which carries a potential death sentence. Virginia law allows it in homicide cases that allegedly involve an abduction or sexual assault. Lunsford would not discuss her reasoning, but she said the decision came after consulting with Graham’s family and weighing the impact on the community.

“The charges that the jury will hear are the charges that the prosecutor feels comfortable to bring,” Lunsford said.

Matthew’s lawyer, James L. Camblos III, who previously served as the Albemarle prosecutor, declined to comment on the charges. Camblos said that Matthew will be transported to Charlottesville next week and is scheduled to appear in court on Feb. 18 by video feed from the Albemarle-Charlottesville Regional Jail.

"Having verified that Jesse Leroy Matthew, Jr. has been charged in Albemarle County with the offense of abduction with the intent to defile as a result of events that allegedly occurred on September 13, 2014 in connection with the disappearance and death of Hannah Graham, the prosecution of him in the City of Charlottesville for that offense is duplicative and likely to become barred by the Double Jeopardy Clause of the Fifth Amendment. As a result, the commonwealth has filed with the Charlottesville General District Court a request for the entry of an order of nolle prosequi in Mr. Matthew's pending case in the city."

UPDATE: A three week jury trial has been set for June 29

The man charged with abducting and killing University of Virginia student Hannah Graham has a preliminary hearing set today in Albemarle County.

Jesse Matthew is scheduled to be arraigned on charges of first degree murder, abduction, and reckless driving in Albemarle County Circuit Court at 11 a.m. The judge is also expected to set future hearings in the case. A grand jury indicted Matthew on these new charges on February 2. . . .

Defense attorney Jim Hingeley addressed the court regarding both motions. The first motion filed was to appoint a DNA expert to examine evidence, and the second was for a continuance of trial.

Hingeley said the requests were based on the need for funding to be authorized by the court as well as additional time needed to find and appoint an expert. The defense does “not have someone in mind,’ Hingeley said.

“It’s not just a matter of getting an expert,” Hingeley said. “There are some items that have DNA evidence in them that have not yet been analyzed by the Commonwealth.”

Hingeley said the time-table for identifying a DNA expert and analyzing the evidence is uncertain, and the current trial date set for June is too early.

The trial against Matthew was originally scheduled to begin in late June, but Higgins slated a status hearing for May 5 to set a new date for the trial, which is expected to last three weeks.

One of Matthew’s lawyers, public defender James Hingeley, said in court that the delay would allow the defense time to hire an expert witness to analyze DNA evidence gathered in the Graham case. Albemarle County Commonwealth’s Attorney Denise Lunsford said that her case will rely on DNA evidence at trial, and she said scientists are continuing to analyze evidence. She said previously that prosecutors plan to call 52 witnesses during the trial.

The parents of a slain University of Virginia student watched in the courtroom Wednesday as a judge agreed to delay the trial of the man accused of killing their daughter.

John and Sue Graham left the courthouse after the 15-minute hearing without speaking to reporters.

When the Grahams arrived in the courtroom, Gil Harrington, mother of Morgan Harrington, hugged them. Authorities have said forensic evidence links Matthew to Morgan Harrington's 2009 death. The Virginia Tech student vanished while attending a Metallica concert at the University of Virginia.
