AH seems to have a good poker face .. It will be interesting to see how or if that changes when she is on the stand.

She is an actress. But, after hours on the stand crying and (lying/acting?) followed by being questioned by JD's team, her ability to act will diminish IMO. The Depp team will have the knowledge of which/what buttons to push ( Depp knows those well ) I expect she will show her true colors...

The ACLU and the Washington Post article

The court hears Amber Heard was made an ambassador on women's rights for the ACLU - this was a role she announced in December 2018, which is when her Washington Post column was published.

Terence Dougherty, chief operating officer for the ACLU, is answering questions on Heard's article and says four people in the union's legal department who were experts in women's rights issues reviewed it before it was submitted to the Washington Post.

He says he was not involved in this.

Amber Heard and Elon Musk were locked in a legal battle over her frozen embryos, it is claimed.

In documents seen by the Mirror, Jennifer Howell – a pal of Heard’s sister Whitney Henriquez and mum Paige – says the latter told her that billionaire Musk was suing the actress.

In the statement, Howell said: “Paige told me.... she was in a legal battle with him over the rights to embryos they had created together. He wanted to destroy them, and Amber tried to keep them to have a baby.”

How long does it take to pay a pledge?

Questioning returns to Amber Heard donating $3.5 million of her divorce settlement - half - to the American Civil Liberties Union (ACLU).

Terence Dougherty, the union's chief operating officer, is asked if the expectation was that the full amount would be paid in a lump sum.

He says no, that they thought it was intended to be over a 10-year period, although this was never specifically confirmed.

Mr Dougherty says he thinks this information came from an email from Elon Musk.

He tells the court the $3.5 million was a pledge, and a pledge does not mean the full amount is paid all at once.

The court is now being shown a letter sent to Heard from the ACLU in September 2019, thanking her for her first $350,000 donation.

Mr Dougherty confirms Heard had "only" - as Depp's lawyer puts it - donated $350,000 at this point in time.

He is then shown a document entitled "Pledge Form" which confirms Heard's pledge for $3.5 million.

Scrolling down, the form shows a schedule for paying the donation. It's a little blurry on our screens, but it looks like the schedule set out payments of $350,000 a year.

Mr Dougherty says Heard never signed this form and neither did any of her representatives. He says he doesn't know why.

He says there are other documents that point to Heard being aware this was a long-term commitment but he doesn't recall the actress agreeing to a 10-year schedule as set out like this.

I thought for sure we were supposed to hear more from his divorce attorney. I don't know why I thought that but thank you for the explanation!

I think that’s a no on she in particular, as his side had to subpoena her; and the recording date said 2020 (er, I thought it had).

I don’t know why she required a subpoena to show up in 2020. My guess is, maybe she tries never to testify about her clients for discretions sake.

'They were highly unusual circumstances...'

Terence Dougherty, the ACLU's chief operating officer, is being asked about emails sent by someone else at the union.

One refers to a phone call with Elon Musk and Mr Dougherty is asked why the tech entrepreneur was involved.

Mr Dougherty says the organisation had a prior relationship with Musk.

This is about the $100,000 donation from Heard mentioned earlier, that came in the form of a cheque from Johnny Depp.

The emails talk about holding the cheque until getting "clearance from Amber".

Mr Dougherty says it is his understanding that they wanted to clarify whether this was an individual donation from Depp or part of Heard's $3.5m pledge.

He is then shown an email from Heard sent in October 2016 confirming that "it is indeed all right to cash Mr Depp's" cheque.

"They were highly unusual circumstances and I sincerely appreciate all of your patience and grace in helping facilitate through them..." Heard wrote.

The actress pledged to donate her $7 million divorce settlement to the ACLU - for which she became an ambassador in 2018 - and to a children's hospital in Los Angeles.

Depp has previously accused her of lying about this and Mr Dougherty is being questioned about it.

He earlier told the court the ACLU has received $1.3 million in total through four direct and indirect payments, including one cheque for $100,000 from Johnny Depp.

Asked about regular payments after that, he says: "We didn't receive any amounts in 2019 and on."

"Three years since her last contribution, what if any efforts has the ACLU made to get Amber Heard to pay?" Mr Dougherty is asked.

"We reached out to Ms Heard starting in 2019 for the next instalment of her giving and we learned that she was having financial difficulties," he says.

'Why was Mr Musk representing this?'

We're back to the Elon Musk email that has been mentioned previously now, and we hear it is dated 18 August 2016.

ACLU chief operating officer Terence Dougherty says the email is from Musk to Amber Heard and Anthony Romero, the executive director of the ACLU, and describes her plan to donate to the union over the next 10 years and her support for its work.

Musk said Heard was not restricting the gift, she just had a preference - we heard earlier that she wanted the money to be spent on women's rights issues.

"Why was Mr Musk representing this on behalf of Ms Heard?" Mr Dougherty is asked.

He says he doesn't know but presumes it is because Musk knew Mr Romero.

Heard never refuted Musk's representation she would pay the full $3.5 million, the court hears.

These answers are all coming under questioning from Johnny Depp's lawyers, who are looking to cast doubt over Heard's claim that she intended to donate her $7m divorce settlement to charity.

CourtTV just finished saying she’s been a lot more facially animated today, and some of the expressions a little snide and unflattering in the bargain.

Maybe after she got her prior diagnosis fed out by the doctor, she’s mentally conceding she doesn’t need to keep up the saintly act anymore.

Boy this is a long drawn out deal about some "pledge" which frankly has no basis for legal enforcement. Time to move on in this case to AH's case and close the case out. AH is not the first person who "pledges" money and then either changes their priorities or has cash problems. I guess all this time spent on this really a waste.
I respectfully disagree. I think this is important testimony…they had a team of lawyers at the aclu involved in this and that article.

The CourtTV guests and anchor were just discussing this, wondering if Depp’s team were going to ask how much knowledge the ACLU team had of the underlying claims under AH editorial, since they so clearly had a hand in helping her draft and edit it.

Called it a potential smoking gun, in fact - did she name JD to them?

Who wrote the Washington Post op-ed?

A quick recap... Amber Heard was announced as an American Civil Liberties Union (UCLA) ambassador in December 2018, at the same time as her Washington Post article was published.

The ACLU is also one of two organisations she pledged to donate her $7m divorce settlement to (and the amount has been questioned in court earlier this morning).

ACLU chief operating officer Terence Dougherty is answering questions about this and is now being shown an email from a Gerry Johnson, who at the time worked in the union's communications department, asking for thoughts on Heard writing an op-ed on gender-based violence. This was sent before the article at the heart of this case was published.

Why was the ACLU recommending Heard write on this subject? Mr Dougherty is asked by one of Depp's team.

He says that as she had agreed to be an ambassador and work on women's rights issues, ideas were being generated for her to write an opinion column.

"If she feels comfortable she could interweave her personal story," the email says.

Mr Dougherty is then shown a series of communications about the op-ed in which an ACLU staff member sends a draft.

"I tried to gather your fire and rage and really interesting analysis and shape that into an op-ed form," she says in the email.

Mr Dougherty says he took "fire and rage" to be about gender-based violence and not specifically Johnny Depp.

"Was it your understanding that it was the ACLU staff member who prepared the first draft of the op-ed?" Mr Dougherty is asked.

There's a slight pause before he replies: "Yes."

"Your lawyers should review this for the way I skirted around talking about your marriage," the emails say and also that they hope it doesn't put Heard in "jeopardy" because of the non-disclosure agreement she signed as part of her divorce.
