The Judge said at the very end that Sammy wasn't there today and so she did not have the exact amount of time used by each side today but by her estimate the Plaintiff used approx 5 hours and the defense an hour and 15 minutes but Sammy would be in touch with both sides tonight with the official record.

Just saw TMZ has filed motion to protect identity if the person that gave them the kitchen video.
I mean, it's really not that hard to figure out who it is. Amber filmed it. So her or who she emailed it to.

I sure would love if we could establish how TMZ came to have that video of JD slamming cabinets in the kitchen that was secretly recorded by AH, that she testified about and that somehow magically TMZ has a copyright on. The only way that would happen is if the owner gave or sold the the rights to copyright it. Period. I would love to be able to prove that came from her.
That does prove AH sold it to me because if she DID NOT, then why wouldn't she file some injunction or something to stop them from playing it without paying her?

When does the jury read JH statement submitted to the court? I still don't know why they didn't call her back to do a video depo.

Completely lost as to why Howell didn’t really testify

Same! Did they cut off her because she will finish in the next 2 days? If not that is a complete waste to not enter it in. Does anyone know the reason for this?

If TMZ owns the rights to that video, it means that some kind of contract was signed. Only AH or JD have the authority to sign over the rights to that video. It absolutely implies that AH sold the video to TMZ. There is no way that JD would. It was leaked one day before the divorce depositions. Clearly an attempt at intimidation/leverage in the divorce proceedings.

Of course it was sold by ms H herself, probably through someone in her entourage. She was so quick to point out - on the stand, mind you - that she "would not even know how to do that". Well, every living soul with a phone can send videos to TMZ. As advertised at the top of their website: Got a Tip? email or call us!

Well, there are two things, getting permission to publish a video, and actually owning the video outright. From what I understand TMZ now fully own the rights to that video. I could be wrong.

What would be the point of telling the jury there are emails or depositions but not letting them see them as in the case of JH?

I’m wondering if it’s because she had no conversation with Whitney specific to the staircase incident that she can rebut with. If it’s not specific impeachment to those statements then it’s hearsay? My best guess as a non lawyer. Because I don’t think she can just come in and testify to whatever conversations she had with Whitney about AH.

Listening to Emily D. Baker, former prosecutor for 17 years, and she said she thinks it might be enough to argue in closing that JH had warned WH against "doing something wrong" to protect her sister.

IMO that means they do. A good lawyer never asks a question that they don’t already know the answer to. ;)

JH's sworn declaration directly disputes WH's testimony about the staircase. She also talks about WH having confided she was subject to abuse by her sister, feared AH would kill JD etc. The fact that she moved out of the penthouses due to fearing for her own safety from her sister should have been allowed, but that's just my opinion. It's a huge bummer JH didn't get to testify about it. One can only hope that either the letter to WH or the UK declaration of facts still get entered into evidence and the jury still gets to read them for their deliberations.

But at least it's out in the public now, so that we can read all of this for ourselves and make our own judgements.
