Im still wondering how they selected the Craig Creek Road area. It's known to locals and students who have been in the area awhile, but I feel these two would have very very basic knowledge of this area. I'm thinking they felt it was more isolated and remote than it really is. They felt they'd have time and isolation to dig a grave but didn't. They had to adjust by putting her in the car, and driving past MANY isolated dump spots that they just didn't know about, being new in the area. They had to compensate and go buy cleaning materials. I have no idea how either of them would have decided on the Wytheville Walmart which again, bypasses at least two Walmart stores between Craig Creek Rd and the location of the body (Pearisburg and Dublin). That Walmart is nowhere near their path.

I think it was a change in plans.

Also I can't imagine if they bought a knife along with the shovel. So obvious!! I'm embarrassed when I buy tampons, Midol and chocolate at the same time!!! I can't imagine checking out with an obvious murder kit

I apologize for the horrible structure of the language in this post. It was me, hiding in the bathroom at work again [emoji23][emoji16]

I know there are several local ppl on this thread. I grew up in the area and my family is still there though I moved 5 yrs ago. WHY do you guys think they went to the Wytheville Walmart?? Do you think they drove through Giles County, into Princeton WV, then took I-77 through the tunnels to Wytheville?? Or do you think they drove right past their first Walmart in Christiansburg, took 81 to the Wytheville Walmart and then turned completely around to head south to the dump site? My sister and I would sometimes choose the Wytheville Walmart because it is less crowded than any other in the area, but how on earth would these kids know this?

This is driving me crazy. For those not familiar with this area, this is a lot of meandering. It is NOT a straight path. And while she was allegedly killed in a remote area and dumped in a remote area, everywhere else they traveled is not remote. Small towns, interstates, plenty of Walmart and Target stores. My theory is definitely now that after the murder, they were planning as they went. Jmo [emoji3]

hmmm...I don't know that I see ashamed or shock. He looks to me somewhat confident. He's got that "sanpaku" look for sure where you can see the bottom whites under the iris, which is interesting (if you're into that kind of thing).

That's bc his head's tilted down slightly and he's looking up. I might also detect the wheels turning a bit. But mostly I see "*****, I got caught." Interesting take on photo. Thanks Wyome.

Wow. There are similarities, with the major difference being the case televised was not premeditated while "our" Nicole's murder was premeditated.

I wonder if DE and NK were into reenactments?!?

Just pondering.

Premeditated, or so says NK. This happens a lot, it just usually doesn't end in murder, so probably not a cc, but who knows. This case could take so many turns. Will be interesting to see.

The videos from each Walmart might be very telling. Especially the last purchase and whether both went inside or just one of them.

Anyone know if Nk had her own car at VT? Probably she did since she home is in Maryland, next state over. Wouldn't it be crazy if DE picked up Nicole and drove her to NKs dorm for a talk and left them alone, and NK did it all... Walmart, killing, driving, disposal of body, etc, and tried to frame DE. All of the evidence was in her dorm after all. If no car of her own, Maybe she asked DE to borrow his to take NL home. And maybe they've overcharged him bc right now it's only NK who's talking. It's a wild theory, but who knows. He did say he saw her that night but didn't kill her. Maybe he's keeping quiet bc he's worried about his illegal part in all of it prior to that night.

We are left with presumptions about their psyches, motives, and meanderings. I think LE has a pretty good idea of what went down and why. Since there is a dearth of information, there is a load of speculation. There is very little that we can presume, other than Nicole was murdered (we do not even know if the weapon was a knife!) She could have been stabbed by a screwdriver, for all we know. As to the timeline of when they visited different stores...LE knows when , from surveillance videos. We can guess until doomsday, but we do not know what sort of relationships any of the parties had with each other. JMO

LE must have proof of something due to the charges. This could be due to video recordings, text messages, phone pings, and alibis. It's not just due to what DE and NK have said or not said.
What we know for sure is DE is the one charged with murder and abduction. I do wonder though if they have proof that DE did have sex with NL would there be a charge for that? Does the absence of a charge for that answer the question of inappropriate relationship vs sexual relationship?

Good points Dita, but I think they're just keeping that quiet right now because Nicole was a minor.

I think the prosecutor's been looking for something to up the charges from day 1. She's just waiting for all of the forensics to come back... autopsy, computer forensics, etc. but they have to be careful asking for CM because a conviction will be much harder and they may even walk if the verdict has to be unanimous and some religious juror is dead against the DP. That area of rural VA is very religious and so too will the jury pool.

As far as I know, he has not been charged with statutory rape. That may be low on the totem pole, at this point, but it also may be because while they suspect sexual activity, they cannot prove it. JMO

I have been wondering about video and if the two perps video'ed the encounter. On one hand I hope not as it adds more humiliation to Nicole, but on the other hand, would be dam*ing evidence.

Just pondering.

Good post Details. Imagine if this whole thing was just a thrill killing / snuff film etc and had nothing to do with sex or his trying to "date" her. Whatever the MO is it will be all there in black and white on DE, NK and NLs phones and computers. Also we have the notorious quote "Secretive and Special."

  • #970
Also, I tend to doubt that there was sex on the night (morning) of the murder, so there wouldn't be DNA in a rape kit to prove it. I do not see how they can prove sexual activity other than "she said" sad but that's the way it is. JMO

If NK is the source that helped police find the body I have a hard time with the last line of this timeline. Investigators would Mirandize NK very soon after they began talking to her. If she signed her Miranda rights a day after the body was discovered and she was the one who told them where it was the prosecution has the risk that NK's statements and the body will be thrown out. Fruit of the Poisonous Tree. Where is the source that shows she waived her rights THE DAY AFTER THE BODY WAS FOUND.

Or this could support my earlier theory that the body was found by tracing cell phones or GIS device in DE's car or statement by DE.

The investigation and the prosecution so far has been so professional I'd be surprised if they made such a fundamental mistake.

Supposedly DE "did not tell them where to find body." But NK did.

Does anyone know if this is legit?

Don't know who Orly is, but if it's off-limits, I've removed the link.

  • #973
I'm now confused/seeking answers about a few things. Anybody help, definitively?

*Has LE/prosecution stated that it is known WHERE the stabbing and/or any other possible contributing factor to Nicole's death occurred?

*Can DELETED text messages be retrieved without the phone involved being on hand and if so in what manner?

*Under Virginia law, is there something about this case involving DE's/NK's age that likely will make it not eligible to be a capital case?

(snipped link)

Not allowed here at WS. It's that Orly guy's report again.

ETA: Orly Salinas. He's some former reporter who kind of went independent, I think. When his report was first brought here, mods/admins ruled it off limits.

Just speculating here, but I don't think he would have a problem with brief nudity while changing clothes. Considering he was an athlete, I'm sure that showering/changing in front of others was something he had experienced before.

It's not that the messages themselves are encrypted, it is the whole phone that is encrypted. If the FBI tries to use brute force (enter every combination) to unlock the phone, it will erase the contents of the device after X amount of failed tries.

The FBI wants Apple to create a special version of the phone's operating system that removes that built in safety feature (the auto erase of the contents).

It certainly is a different situation for LE and Apple. Apple has stated they regularly comply with valid, legal LE requests, but this San Berdoo situation goes way beyond that and has far reaching implications.

Hope that adds a little light to the situation.

I have seen people on our news arrested and go to jail in pj's.............LOL I see grown men wear them in Walmart!

I just can't see NK being sick enough to plot a young girl's murder, BRAG about being excited about being involved in it, keeping the blanket, going on a store run for supplies before AND after, helping get rid of the body across state lines, texting "POLICE" to DE, knowing LE would see or find that text and easily trace it to her, spilling her guts and appearing to do so with a flippant, not a care in the world attitude, and then not being an active participant in the murder. I don't believe it.

Holy run on sentence! [emoji57]

NK was involved up to her eyeballs in this, and enjoyed it.

Perhaps to stay warm? Lazy person's long johns. It doesn't get that cold here, but I have friends in WI that mentioned throwing on jeans over their pajamas if making a quick run to the store.

It could be that the arresting officers didn't give him a chance to do much and threw a pair of jeans off the floor at him and told him get dressed and come on. I wouldn't try to overthink the pajama thing, especially if he was arrested in the middle of the night.

LE keeping everything they have close to the vet so to say, which is good for their case.
Keeping it simple.......LE quickly charged DE with murder so they have proof.
They would never just take NK word for it. And not just because he picked NL up that night.
NK charged with the rest because that can be proved, she took them to the scene of NL remains.
March 28th these 2 will be at another hearing and IMOO they will be added charges.
All forensic, autopsy and tox proof will be out all together by then.
We just wait now til someone leaks something...........
