I have seen people on our news arrested and go to jail in pj's.............LOL I see grown men wear them in Walmart!

LOL! He should be nominated for "What Not To Wear" for Stacy and Clinton to make over. Too bad the show ended!

Seriously, I doubt LE gave him much time do anything, but put his jeans over his PJ's. Probably wouldn't let him out of their site to remove the PJ's and put on jeans. He might have tried to escape if the bathroom had a window...

I'm now confused/seeking answers about a few things. Anybody help, definitively?

*Has LE/prosecution stated that it is known WHERE the stabbing and/or any other possible contributing factor to Nicole's death occurred?

*Can DELETED text messages be retrieved without the phone involved being on hand and if so in what manner?

*Under Virginia law, is there something about this case involving DE's/NK's age that likely will make it not eligible to be a capital case?

OK, gonna make a try at the bolded item myself. I have been confused about this since the prosecutor said in article linked last night that she was continuing to consider whether to pursue the capital offense angle -- while at some point earlier in these threads, from some information another poster provided, I had gotten the impression that DE/NK would not be death-penalty-eligible because they are both under the age of 21. On doing a little research myself, I believe the capital murder qualification to which that poster was referring was this one (and all the stuff I'm going to quote is available at the link at the end of this post):

...The following offenses shall constitute capital murder, punishable as a Class 1 felony:...

...12. The willful, deliberate, and premeditated killing of a person under the age of fourteen by a person age twenty-one or older; ...

I (who am not a lawyer, so just my regular old opinion) read this as saying that, in Virginia, NK and DE are not death-penalty-eligible under THIS item, because of their ages.

There are, however, a number of other capital murder definitions/qualifications that could possibly apply here that DO NOT make any mention of a specific age range disallowed for defendants. One I would think COULD (possibly) be in play here:

...1. The willful, deliberate, and premeditated killing of any person in the commission of abduction, as defined in § 18.2-48, when such abduction was committed with the intent to extort money or a pecuniary benefit or with the intent to defile the victim of such abduction;...

There are other possibilities at the link -- but of course, IMO, we (the public) do not have enough information about the specifics of this case yet to make even an educated layperson's guess, really, at which, if any, of those listed will apply.

But I do now understand, at least, why the prosecutor can still be "considering" the question.

An updated scanner, used for the first time in this investigation, helped police create a 3-D model of what they believe to be the crime scene in Montgomery County.....
The machine creates a “point cloud” that is paired with the hundreds of pictures it takes to create a 3-D model of a crime scene.

“Enables the user to create measurements from the virtual crime scene itself without necessarily having to do them or to basically check the ones that were done manually at the scene,” said Zirkle.

“You could say a perpetrator is 6 foot 1 tall, or a witness for that matter is 6 foot 1 tall, and you can create a view from where that person was located and what they would have seen at the time of the crime,” said Zirkle.

OK! But for some reason, he wore his jammies under jeans. Any suggestions as to why? JMO Sort of bizarre, but Michael Jackson wore his jammies to court...just skipped the jeans, lol

Runners are notorious for keeping their leg muscles warm. . And that's not to say why he had them on. He could have been so startled and on edge that he didn't even bother to realize.

I agree that there was probably no sex the night of the murder but in cases of rape, statutory or otherwise people are prosecuted without physical evidence. Even when the victim denies there was contact. I'd assume if they did have sex there was some talk about it through text or something

My husband and I have been having the Apple discussion since last night. We have different beliefs on the ethics.

Is FBI legally allowed to ask or force Apple to employ a way to crack an iPhones history.

I don't know if this can be part of the discussion here.

Can we discuss it here? This may be a part of the trial if, say FBI can't crack a phones history for whatever reason.

I know there are several local ppl on this thread. I grew up in the area and my family is still there though I moved 5 yrs ago. WHY do you guys think they went to the Wytheville Walmart?? Do you think they drove through Giles County, into Princeton WV, then took I-77 through the tunnels to Wytheville?? Or do you think they drove right past their first Walmart in Christiansburg, took 81 to the Wytheville Walmart and then turned completely around to head south to the dump site? My sister and I would sometimes choose the Wytheville Walmart because it is less crowded than any other in the area, but how on earth would these kids know this?

This is driving me crazy. For those not familiar with this area, this is a lot of meandering. It is NOT a straight path. And while she was allegedly killed in a remote area and dumped in a remote area, everywhere else they traveled is not remote. Small towns, interstates, plenty of Walmart and Target stores. My theory is definitely now that after the murder, they were planning as they went. Jmo [emoji3]

No it was the Commonwealth Attorneys description released on Feb 4! Wgram do you agree with me that it makes no sense to go to the Wytheville location? No matter how stupid they were, they covered so much unnecessary ground it's baffling. It's almost taunting, like seeing how much they could get away with. I don't know but this Wytheville thing has been on my mind all day.

Just a thought and I don't know if this is even possible, but perhaps since NK is the only one talking, they are not upgrading her charges for fear it would make her clam up and stop giving up info. If NK thinks that LE believes her story, she will likely keep talking, and given enough rope...

I just can't see NK being sick enough to plot a young girl's murder, BRAG about being excited about being involved in it, keeping the blanket, going on a store run for supplies before AND after, helping get rid of the body across state lines, texting "POLICE" to DE, knowing LE would see or find that text and easily trace it to her, spilling her guts and appearing to do so with a flippant, not a care in the world attitude, and then not being an active participant in the murder. I don't believe it.

Holy run on sentence! [emoji57]

NK was involved up to her eyeballs in this, and enjoyed it.

Given that DE went to a Christian school, I wonder if this statement is reference to John 8:32.
“And ye shall know the truth, and the truth shall make you free.”

Wow, interesting, he said "I believe..." He caveats it. Very telling. Not "the truth will set me free," but "I BELIEVE the truth CAN set me free." Lying.

That is really, really cool! I wonder if they are using too in regards to Keepers' version of the story and where she was when she watched DE kill Nicole?? Technology is just growing leaps and bounds now. It's very futuristic and innovative! Kudos to the people who developed that amazing scanner! I would love to see how they use it at the trial....

I agree with you, I think she was very much enjoying being part of something "special and secret". That said, I don't think it's that unusual for us gals to like secrets. When I was a little girl, secrets were a big deal. "OMG I HAVE A SECRET!" and then to be let in on a secret, also a big deal.

But I'm talking about, "I like this boy at school" kind of secret and not "I'm helping plan a murder" kind of secret. She took the whole "I like secrets" to a place that is dark and sick.

She was excited to be part of something so secret because it was with him. I think she really wanted DE and obviously would do anything for him. Nobody is going to help you do anything, much less move a dead body unless there's something in it for them. :loveyou: :crush:

Just a wild guess. DE has a relative in Galax. When DE and his family were traveling from their home in Columbia MD to visit the relative, I'm guessing that they took I-85 to I-77 and then the Hwy 58 exit toward Galax. Since DE would be familiar with that route, I'm thinking that may have been his intended route to where he and NK planned on leaving Nicole's body (Hwy 58 to Hwy 89). Let's say that DE and NK realized they needed cleaning supplies when they were near the I-85 and I-77 intersection and thought that Walmart would be a good place to purchase them since they are open all night. If they did a google search for the nearest Walmart, the Wytheville Walmart would be the one they were closest to in that area.

Yeah, she's in it up to her eyeballs. If there's one thing whackier than being "excited by something so secretive and special" as murdering a kid, it's telling cops that as soon as you're brought in. What a major whack job. Something is not right there. :happydance:
