Defense now arguing whether or not items found in a gym bag in the dorm room should be viewed by the jury as "together." Court has instructed the jury to leave the room so lawyers can discuss. That's the fourth time today they've been asked to leave.

The picture I just tweeted was shown to the jury, but the condom wrapper Tony Anderson had a problem with was not itself introduced as evidence. The paper with Nicole's address was though. @ABC13News

12:55 p.m.: Shaun Caudell, with the Virginia State Police is now on the stand. He conducted a search of David Eisenhauer’s dorm room at Virginia Tech. He helped collect items from Eisenhauer’s room. All items of evidence were handed over to the Blacksburg Police Department. He collected Eisenhauer’s checkbook, with a Galax address on it. Pictures of the evidence are shown on a large screen in the court room. An envelope was also collected in the room, and a Lexus key fob.

Eisenhauer’s attorneys have objected to nearly every piece of evidence the commonwealth has submitted for evidence.

The next picture shown is a trash can with a Walmart receipt in it. It lists a shovel and aerosol. Three computers were found during his search also. Another item collected was a backpack with a condom wrapper, a runner’s number, and a green piece of paper that says We Are Virginia Tech. That paper also has Nicole Lovell’s address on it. Eisenhauer’s attorneys had earlier objected to the jury seeing that information.

1:26 p.m.: Trooper Christopher Grzelak with the Virginia State Police is the next on the stand. He was called to search a pond at Virginia Tech for a cell phone. He dove into the pond and searched the bottom of that pond. He found an iPhone, it was placed into a paint can evidence container. It was given to the lead investigator.

Eisenhauer’s attorneys asked if Trooper Grzelak helped find a knife in the pond. Other VSP recovered a knife also in the pond. It was found near where the phone was discovered. Other troopers thought Grzelak and his dive team had dropped the knife in their search, they had not. It was kept and collected as evidence.

Detective M.P. Czernicki of Blacksburg PD just walked in with a large bag of forensic evidence, among it, a cell phone belonging to Lovell. "I was told (VSP dive team) had located an item in the water and responded to the scene."

Czernicki says the first thing after getting a search warrant for David Eisenhauer's car was to look it over. Says he say an area that was clean and didn't have any brine or road salt, which would have been weird considering it had just snowed here. @ABC13News

Czernicki now talking about why they moved David Eisenhauer's vehicle to Radford. He says they have a temperature controlled place to search it; Blacksburg & Montgomery Co don't have that. They got a second search warrant since they didn't search it the night they seized the car

Cops are already being a little slippery with their words. They made it seem that Keepers dumped the knife into a paint can, then they admitted the paint can was theirs. Then they said one of their detectives planted, i mean, may have dropped a knife into the waters of the VT Cross Country pond. (remember, Keepers said it was thrown off the steep I-77 exit ramp in Princeton and into Brush Creek)

Ouch



As for a knife in the pond, they would have to explain that because it was found and collected. At the time they searched the pond, they probably didn't know if Keeper's claims about tossing the knife were accurate. Better they collect it and log it in than leave it there.

ETA: And it was Nicole's phone that was found and placed in the paint can.

no, it specifically states that the cops later said one of their own detectives and divers may have had it fall out of his pocket. Let me go find that script.

It seems to me that they were "on the fence" about wanting to plant that baby in the pond, until Keepes later revealed where the knife really was abandoned

I'm lost again. What's with the "planting evidence" info?

Did I miss something about that?
