hearing that his defense will be that Keepers was very jealous of his Eisenhauer's newfound love, defense will pin everything on Keepers and the mystery 4 inch "catfight gash" on her cheek. Saying that yes eisenhauer did in fact go the woods with the girl on a legit date, but when he came back from his car to get the girl roses, she was gone, leaving Eisenhauer "sad and confused" as to who kidnapped the girl when he stepped away

(Remember, no one actually saw David E commit any crime, and he denies it. No one knows where Keepers really was)

I thought it had been stated that what looked like a cut on Keeper's face was actually hair -- or am I only remembering the discussion about it here on WS?

Yes, there was a lot of discussion here. Looking back in the old posts, I don't see any verified/linked information that it was a scratch or cut.

LE has remained completely silent about any evidence or other details for this case. We'll find out soon.

As it stands David Eisenhauer will not be taking the stand in his own defense. His alleged accomplice Natalie Keepers is on the witness list to talk on Eisenhauer's defense. @ABC13News

I had forgotten about that "source". I just did a search and found the original reporting from that "source". It was all wrong, according to what was later revealed in the regular news media outlets. Wrong info about evidence, wrong info about location of murder scene, etc. I think they were making up their reports as they went along, based on what they saw in the news media.

Deflecting blame onto NK if he got caught may have been his plan all along. Think about it - LE didn't recover any evidence from DE but they did locate Nicole's backpack and blanket, in addition to the cleaning supplies used to dispose of her body, in NK's dorm room.

Yes, cameras will be allowed. Assume some were there today, but I haven't seen any photos yet, perhaps they're not allowed during this phase?

The court is filtering through about 170 potential jurors by bringing them in the courtroom in groups of 12 and asking them several, sometimes repetitive questions.

No cameras were allowed inside the courtroom as the judge, prosecution, and defense attorneys asked dozens of questions centered around their prior knowledge of the case.

Many of the three dozen questioned Monday said they were familiar with the charges.

The long, tiring process will eventually evolve into 12 jurors and two alternates.

bbm Aren't these two statements contradicting each other? Or am I not understanding them correctly? If Keeper is called for the defense how can her testimony be incriminating for DE?

Jury seated in Nicole Lovell murder trial

Trial set to begin at 1 p.m. Tuesday.

By the end of Monday's proceedings, a jury of eight women and six men, which includes the two alternates, was selected.

The defense filed a motion to dismiss one of the jurors because she was a juror in a murder trial in West Virginia 20 years ago and that jury found the accused guilty. The judge denied that motion.

Just throwing this question out there for all the seasoned trial watchers: In your opinion, based on what we know now about this case...is it better for Natalie to be tried much later, or better for David to be tried so much earlier?

It is confusing isn't it? I think if NK is called to the stand and pleads the fifth, that will be incriminating to her.

So glad they seated a jury and we know it will start tomorrow.

I dug this up re: cut versus hair for Keepers:

Lovell responded, “I bet she fought like a wildcat. She’s my kid. The Keepers girl, in her mug shot, looks like she has a scar. I couldn’t tell in court because she had her hair, you can see it in those pictures right there. You can see the scar going down her face.”

What you see in her mug shot, according to Commonwealth’s Attorney Mary Pettitt, is not a scar, but a strand of hair. Pettitt said, after their arrest, both Natalie Keepers and David Eisenhauer “were subjected to a forensic exam to document any injuries, bruises or scratches.”

“Any relevant results of those exams will be presented in court,” Pettitt continued.

He only reported what he could see. WDBJ7's Justin Ward, who stands a cool 6'5'' and over 300 lbs, was sitting directly in front of Mike along with two baliffs. Eisenhauer looked out at the crowd many times and even had what appeared to be Cheetos passed to him from a female attorney.
