The tape has ended. Eisenhauer leaves the interview abruptly saying the FBI should "focus on finding a body" instead of "interrogating the last person who saw her alive. I'm done."

What a stupid thing to say ! "focus on finding a body" rather than "interrogating the last person who saw her alive."

Why would he think that would be a good thing to say at this point in the case? (trying to understand his reasoning)

I watched them both. I thought the Commonwealth's Attorney did an excellent job. Very focused and to the point. The defense attorney was much more ... wordy. And I am pretty sure he mixed up Nicole with Natalie Keepers at one point! He's really reaching with the whole David GPS pointing to Natalie. And Natalie's email address being named after an author whose book included a young girl being killed. She was involved up to her eyeballs, to be sure, but I still don't think he will create enough reasonable doubt against David. We shall see.

David Eisenhauer’s defense attorneys made a motion for a mistrial on Tuesday after a video of Eisenhauer being interviewed by FBI special agent Travis Witt was shown in court.

John Lichtenstein said that Witt’s remarks were “deeply prejudicial” and jurors could not help but be swayed by the agent’s description of sexual predetaros.

"The inescapable implication,” Lichtenstein said, was that Witt was calling Eisenhauer a predator.

Commonwealth’s Attorney Mary Pettitt*replied that jurors should get to see the whole interview so they can weigh Eisenhauer’s physical responses as well as his spoken answers to Witt’s questions.

Judge Bobby Turk agreed and denied the motion for mistrial.

Day 3 of the trial is scheduled to begin at 8:30 a.m. on Wednesday. *

Hubris. He really didn't think they would catch him. Now he thinks they won't convict him. Very narcissistic guy, but dumb, too.

You have to chuckle a little at him saying that to an FBI agent. Oy.

I didn't realize the timeline until now:

Per the prosecution, DE stabbed Nicole and left her bleeding/dying on Craig Creek Road, and didn't return to the murder scene until 17 hours later. (Keepers accompanied him on the "return")

Even though I’m so behind in all my other threads I’m following I just read all of Nicole’s from the day she went missing.

All our concern with her being without medication. So hard to read now. Ontario mom called it out on page one or two that she hoped she didn’t sneak out with a boy she met online. :( how sad was that to read knowing what we know now.
We had such hope when Nicole went missing. And now here we are. Such a senseless murder. So much loss. So much hurt.

The crux of medical examiner's testimony appears to be the difference between blunt-force or sharp-force wounds. Commonwealth emphasizing a stab wound to Lovell's jugular killed her. Defense pointing to blows to head/possibility of shovel as murder weapon.

I guess they found NK's prints on a shovel so they try to convince the jury that that was the murder weapon, not a knife. jmo

I just finally watched these openings. I have pretty much the same impressions as you. Question...when the defense attorney was talking about the bloody stick with hair, what was it? Was he talking about the wooden handle to the shovel?

Geez, when he was talking about the suitcase she brought back with her with all the bloody things in there...what was this girl thinking? I think whoever posted that DE set her up to take the fall was right...or she is involved in this more than what was disclosed.

The prosecution's case is much weaker than i thought. Keepers is looking really bad too. At this point, i would say Eisenhauer slips right out.

So far I have the same impression. But lets wait and see what evidence they present.

I dunno. If the jury believes Nicole died of stab wounds (as per the medical examiner), AND the prosecution has evidence (security cam footage, cell phone records, etc) NK was not near Nicole until 17 hours AFTER she was stabbed... then, it will be tough for the defense to spin yarns of (credible) doubt.

But, then again... jury trials always worry me. ugh :(

I think maybe it's been a long day and my brain isn't working. Can you please explain the 17 hrs. TIA
