They are not to take what he said on the interrogation video as evidence.

Okay. Are they showing the video in the courtroom with instructions to ignore what the agent says? That seems confusing....or I am confused (strong possibility!).

I wish they would post that whole interrogation video. Sounds like DE was aware of what would happen when they brought him in. Looking up for a camera, knowing they could hold him for 24 hrs, etc.

During an interrogation, LE will often lie or embellish to try to get a suspect to tell them what happened. For example, they could say (just an example as I haven't seen the actual video) "we have a shovel with Nicole's DNA and your DNA on it" when really, they haven't actually tested anything. So when the jurors watch the video, anything the investigator says should not be taken as actual fact. It could just be interrogation techniques.

It is confusing. My layman's take is that they may not take into account "as evidence" anything that was said by either party in the interrogation video. But anything he testifies to outside of that is fair game for jury to consider. Anyone, please correct me if I am wrong.

I am confused as to why the judge let the interrogation video into the court room at all then...

If I were on the jury, I'd like a written transcript of the video with just DE's statements on it. That would make it much easier to disregard the agent's statements. It's hard to unhear what you hear.

IIRC Pettit said her DNA was found under his fingernails. The ME said DNA was found under her fingernails...but we haven't heard yet whose DNA. I suspect it was his because of the gouges on the side of his nose....hope I haven't gotten this wrong!

Pettitt told jurors they would hear an array of evidence that included Lovell’s DNA being found beneath Eisenhauer’s fingernails
and in the trunk of his car, his online searches for ways to dispose of a body, and his planning the murder with another Virginia Tech student, Natalie Marie Keepers.

IIRC it was within the first 24-48 hours after she disappeared. LE found her social media accounts quickly because she had written the userID's and passwords on her bedroom wall.
