Wednesday, October 16th:
*Trial Continues (Day 5) (@ 8:30am ET) - FL – Dr. Teresa Ann Grace Sievers (46) (June 29, 2015, Bonita Springs) - *Jimmy Ray Rodgers (28) arrested & charged (2/23/16) & arraigned (5/5/16) with 1st degree premeditated murder with a weapon, conspiracy to commit 1st degree premeditated murder & burglary. Plead not guilty. No bond. DA will seek DP.
Trial began on 10/10/19. Trial expected to last 4 to 5 weeks. Jury: 5 men & 7 women, 2 alternates: 1 man & 1 woman.

10/15/19 Day 4: Judge Bruce Kyle asks both sides if they figured out yesterday's issue with evidence from the FBI. Both sides said they were able to speak with the FBI agent about the evidence analysis that was turned over to the state. The defense says there were some parts of the report they weren't able to access because it required a special software to open. Defense explaining to judge now that FBI admitted in deposition that no raw data was sent to state/defense in this case. State witnesses: Linda Otterstatter (FBI-expert in trace evidence). Sherri Fentress (FBI-Mitochondrial DNA, or mtDNA expert). Lt. David Lebid (Lee County Sheriff's Office-Homicide Unit, was supervisor assigned to case). Short recess while Judge Kyle considers if statements about Rodgers in a “facility” is prejudicial. Assistant Public Defender Donald McFarlane is asking for a mistrial. He said the media is "running" with a story about Rodgers being on probation before he was brought to Florida to face charges in the Sievers case. Judge Bruce Kyle notes the defense's objection, but overrules. He allows the state to say Rodgers was in a facility when he said the statement (Statement was: LE told him he was facing a murder charge... Lebid said Rodgers replied with: "In the state of Missouri, that's 15-20 years and I'm okay with that.") Jerry Lubinski (from Missouri & is retired. He is 80-years-old. He has know Curtis Wayne Wright for about 10 years). Back from recess. Assistant State Attorney Hamid Hunter is asking the judge about bringing in certain witnesses to testify without the jury present first so there aren't as many breaks for objections during their testimony. Only the jury is being sent home, the trial is still continuing on without their presence this afternoon. Jury asked to come back 9am on 10/16. State witnesses: Laura Bland (a Circle K witness. Asked about the surveillance system at Circle K and how it is set and secured. Jason Duvall (Loss prevention manager at Walmart (about cameras in parking lot)).
*Mark D. Sievers (50) – Trial tentatively scheduled for 11/12.
*Curtis Wayne Wright, Jr. (41) arrested (10/14/15) & charged (10/20/15) & indicted (5/5/16) with 2nd degree premeditated murder. Plead not guilty. No bond. Took plea deal (2/26/16) plead guilty to 2nd degree murder; serving 25 years, waives all rights to appeal. Will testify at trials. Sentencing on 12/2.

If you are the praying type, please say a prayer for this girl. She is there all alone and I am sure she is petrified. This will be the first time she has faced JR since his arrest, AFAIK.

The next witness is Taylor Shomaker of Missouri. She was Rodgers' live-in girlfriend during the investigation. She also led investigators to the side of a highway in Missouri where they recovered a blue jumpsuit and pieces of a broken cellphone.

   Assistant State Attorney Cynthia Ross tells Shomaker to take a deep breath.
   
   In July/August of 2015 Shomaker was living with Rodgers and knew Wright, Shomaker said.

When Rodgers returned from Florida in the summer of 2015, he was wearing a Budweiser T-shirt and picked Shomaker and her kids up from her mom's house, Shomaker said.

He did not have the Budweiser shirt before he went to Florida, Shomaker said.
