Wow! Absolutely excellent research and post, Chezire! Hope you don't mind me bringing it over because it is very pertinent to this discussion. I especially hope those who don't find JBP and Suburban Dr. similar take the time to read it. THANKS!

The important thing is not how we posters here at WS felt when watching the news (I add that if you cared to go back through that day's posts, my first post that day of BP search indicated that, I, too, wasn't sure of the findings either,) but how CASEY felt about the initial news reports announcing that a bag with bones had been found in JBP on November 13, which initial reports are what Casey was watching, as I outline below, and as compared to how CASEY felt about the initial news reports annpuncing that a bag of bones was found off Suburban on December 11.

At WS time 11:03 a.m., with Murt covering it live, the first news of a find was of a bag with some sort of toy in it, here, posted by Amster: http://www.websleuths.com/forums/showthread.php?p=2936697#post2936697 and also here, by Amster: http://www.websleuths.com/forums/showthread.php?p=2937521#post2937521 , all of which reflect that as of the noon news in Orlando, the news stations were covering this find and all the events following it. By 1:00 p.m. WS time, now two hours after the news stations were reporting the BP findings, we were able to click and read print articles from the news stations, for example, WESH, that small bones were found with the toys in some plastic bag, see here: http://www.websleuths.com/forums/showthread.php?p=2937735#post2937735 . OSCO was not at the scene and it had been already 2 hours since the Orlando news stations were reporting about the bag with the bones and child's toys, child's shoe, etc. TexasLil posted Padilla was saying on news stations in FL that they'd found bones size of a child's fingers and toes, post # 650, here: http://www.websleuths.com/forums/showthread.php?t=74941&page=26

So it is all in how one interprets what the news article says and doesn't say...

Me? I read it to mean that once the guards saw what Casey was watching, which was the findings at JBP, in a jail dayroom (which is typically a very public place, viewable by other inmates who might be passing through in the halls, etc.) they decided to shut that down and get her back to her cell, in case Casey had some terrible reaction and/or needed "privacy." LOL. (Sarcasm intended.) So...Casey saw the news as it was rolling and had no reaction. (I add that if she had been watching the news reports that LE had discounted the findings and were saying they were NOT bones, why any need to shut off the television and send her back to her cell? Zero need, as who would react to a news report discounting things that had been found.)

I also agree with Nancy Botwin that the jail would be wise to retain all videos of KC to defend against the frivolous litigation sure to come. Furthermore, it's possible that those videos were requested by the state and/or the media prior to any "normal" retaping, if such is the practice. As a government agency, I don't see how the jail could do anything but comply, absent a court order.

If this motion was written by LKB rather than JB it makes more sense to me: she writes the way she speaks...complete stream of consciousness with a coherent thought here and there.

Isn't Baez completely over-reacting and hyping this into a greater drama than it needed to be? If his claim is true that he was not 'crying' then why be baited and respond? Why not rise above it, maintain professionalism and, let the video speak for itself? This is a non issue and a brief storm in months of bad weather if he rides it out. Me thinks he doth protest too much and nerves have been touched.......

I would suppose the concern would be that video taping (with no audio) would allow for lipreading. I assume the jail provides a room for attorney/client meetings that would be offlimits to video taping of any kind. Now as to whether or not they can be video taped walking down a hallway or something, I would assume they could film you. If your in a area where you know other people might be, not sure you have the right to expect privacy.

In a place where there are cameras everywhere.... It would be hard to prove he didn't know he wasn't being video taped.

If the tape is in a public area with others around, I don't think he can claim privilege. IT's only when they are in private, in meeting that there is privilege.

Can't wait to find out where it was filmed at and who did it.

Are cell phones allowed when visiting prisoners? Could the private investigator, D C, have taped this meeting with his cell phone? He could have turned it over to LE later to help himself out of trouble for searching the woods? Wasn't he at the jail with JB to meet with KC?

They are still allowed to tape, for safety reasons. Pulling it for lip reading.. it would be documented. If it was ever found out.. the jail would be in major... Because that would be against the privilege.

However, JB might think that because of the privilege, he has the right for complete privacy. That wouldn't be correct. Folks can still see them, etc. Just not hear what they are talking about, etc. Which means they are monitored in their activities to make sure no hugging, etc. Which are against Jail rules. Also to make sure nothing illegal is passed from one person to another.. Standard stuff.

Now days, places use cameras for eyes, instead of real people. That leaves a camera person, in a safe location, monotoring many, many cameras. <shrug>

Some points from my small dealings with Attorney Client Privilege in Federal civil suits, as explained to me by attorneys.


  • Not all communication with your attorney is privileged-- it needs to largely pertain to a legal issue or service provided.

  • You need to envoke it, and show that it wasn't waived-- if you don't claim in a letter or phone call or other work-product that it is privileged attorney/client work product, then you bear the risk that it isn't.

  • I believe there's also a requirement that both attorney and client understand that the communication is conducted in private. I always consulted behind closed doors and if on speaker-phone, all parties present were announced.

The context as we know it is some unidentified remains were discovered, and Baez perhaps offered moral support and comforting in relation to this. Talking about the discovery and her reaction and him crying about it, doesn't sound like legal advice or services related to the case-- unless Baez and Casey both knew that the bones are Caylee's. And how could they know unless they both know Caylee is dead and where the remains are located.

And if this shifts to a legal dicussion, then ask for privacy and envoke priviledge and they'll take you a classroom. If this isn't possible, shut your mouth and advise your client to do so also.

One other intriguing situation where attorney/client privilege doesn't apply (at least in the Federal law I'm familar with), is when the attorney is acting primarially as your business advisor and not in a legal capacity. This appears to speak to the conflict of interest questions of late.

Casey had no reaction to the "bones" found by LP's divers in the Econ River at Blanchard Park.
Casey was not one bit concerned about LP and the divers searching Blanchard Park because she KNEW they would not find Caylee there.
If she really did not know where Caylee was she would have shown some reaction to what the divers found, possibly being human bones and possibly being Caylee.

ITA! And since the story now is that Zanny took Caylee at JBP, you would think that, if it were true, the JBP find would have been more of a scare to her. Of course, she knew that wasn't Caylee in JBP! But, when the find is made down the road from her house, BAM! Suddenly, she has emotions to show! I say it was fear, knowing she was caught. JMO.

I know, I have participated in that thread but I don't remember anything there about an actual videotape of casey reacting after learning about a possible find at JB park. Speculation sometimes turns to fact on this thread and I'm trying to sort between the two here. I have heard nothing about an actual videotape of casey reacting over the JB park stunt. All I have heard about is a videotape of casey's reaction to the December discovery of a child's body. If there was actually a videotape of the first reaction, you better believe the media would be all over it and so would Baez, in an attempt to stop its release, because it would be a great comparison.
You know, I was caught up in the whole competing reactions thing for a moment, until I dug a bit deeper. It's just one of those things where I think we are making a mountain out of a molehill. I think that for two reasons: 1) The area LP "searched" had already been thoroughly searched by a professional search organization, TES, and NOTHING was found. Thus, I laughed when I saw LP got to the area and once again state something as fact that he could not possibly know (that being that Caylee was in the water there) in what I felt I was nothing more than an attempt to further inject himself into this case, for publicity. So, one could argue that there was no reason for casey or her family to take any supposed "find" by LP seriously. 2) I have seen no actual evidence that an actual videotape of casey's reaction to the JB Park "find", exists.

I think Linda Kenney Baden wrote this motion. It appears to be her signature on the bottom and, as cyberborg mentioned, the writing style is very different than JB's.

Not all motions are written by a single atty. Sometimes several attys work on a motion and only the lead atty signs. But since JB is lead he is responsible for reviewing and giving permission for all motions before being filed.

This motion is ONE HOT MESS, so whoever wrote it (some or all of it) needs to rethink their approach.

Agreed. I wondered if perhaps at the beginning of the visit, KC reamed JB out about not getting there sooner to tell her what was going on, and this upset him along with everything else. I imagine she's seen that very tactic used by CA on GA in her own home.
