re bold on Motion to Sever for Jonathon - ?? Sever his attorney? At least the trial date is still there!
RSBM for focus

Or perhaps it’s in reference to one of the following?

Usually a motion to sever is made by either the State or the defendant in order to ask the court to have separate jury trials on the different charges. Most times it is the defendant who asks for severance, so that the jury won't hear all the evidence about all the charges in the same trial. Usually, if the charges occurred at the same time, or in a course of continuing events, or or otherwise related to each other, the State will argue to have the charges all tried together, so that the jury gets to hear the full story of what happened and so that witnesses don't have to be subpoenaed for more than one trial. Judges tend to prefer hearing related charges all at once in a single trial because it saves time and judicial resources.

[SBM]” (BBM)
What does motion for severance of offenses mean - Q&A - Avvo

Or

“In criminal cases where there are multiple defendants for a single crime, the district attorney or prosecuting attorney can bill the charge under one docket number. This means that all defendants will be tried at the same time in front of one jury or judge.

[SBM]

However, it is often not in a defendant’s best interest to be tried with the other co-defendants, particularly if one of the co-defendants has significant evidence against him or her. In order to prevent all of the defendants being tried together, a criminal defense attorney can file a motion to sever. If granted, the motion will allow one defendant to be tried separately from the others.“ (BBM)
Co-Defendants and the Motion to Sever

In this particular case, it’s probably the latter (or perhaps even both) that Jonathon is trying to get the judge to agree to, IMO.

Thanks for the explanation inmyhumbleopinion - but their trials have been severed.
Trials set for
Emma on 1/28
Benito on 4/1
Jonathon on 4/15.

Kindra plead guilty & will be sentenced after she testifies at the trials.

So that's why I wondered "who" he was going to "sever"! :D

I’m sorry I must have missed that!

So perhaps he can’t afford the attorney?

Or could it be something like this (since he is facing four separate charges, IIRC):
“‘What does the motion for severance of offenses mean in a criminal case?’

‘Most times it is the defendant who asks for severance, so that the jury won't hear all the evidence about all the charges in the same trial.

[SBM]

There are many issues which can decide whether to sever or consolidate charges for jury trial. Even if the charges are related and happened at the same time, sometimes there is some evidence related to one of the charges which might be so prejudicial in the juries eyes that it would taint their judgment concerning the other charges.“ (BBM)

Guess we will find out eventually :)!

Thanks again for that explanation. I wish they would give more info on the court sites. Or sever his attorney, but I don't think that would pass as his trial is coming up.
Yes, we will find out eventually! :)

re bold on Motion to Sever for Jonathon - ?? Sever his attorney? At least the trial date is still there!
I'm wondering if the motion to sever is related to something the defense wants suppressed. The hearing of 3/6/2019 is also noted as a 3.5 suppression hearing (which could be physical, oral, or identification evidence that defense wants suppressed). JA will likely have his Mom KA and girlfriend EB testify against him. He will probably try to get what he told his girlfriend suppressed. I don't think so but will be interesting to hear the argument.

Benito Marquez makes an appearance in Lewis County Superior Court Thursday afternoon in Chehalis

FEB 14, 2019

Benito Marquez, a 17-year-old Lewis County teen charged in the beating death of Randle teen Benjamin Eastman III, is expected to plead guilty in the case during a hearing on Friday, Feb. 22. bbm

Marquez and his brother Jonathan Adamson have both been charged in Eastman’s death, and are facing an identical set of charges: first-degree murder, first-degree rape, tampering with physical evidence and unlawful disposal of remains.

Specific details about the plea agreement will remain vague until the hearing concludes, said Marquez’s attorney, Shane O’Rourke. The hearing on Friday, which is set to be a “plea only” and will not include a sentencing, will start at 3:30 p.m. in Lewis County Superior Court’s department 2. bbm

“There’s certain reasons until that time … I can’t give any specifics about what that entails,” said O’Rourke, who added later: “The details are essentially ironed out, we think, but there are a couple loose ends and things that need to be tied up, so I can’t give any information other than that at this time.”

Marquez has been in solitary confinement — on $10 million bail — in the Lewis County Jail since July 2, 2018. When asked if the negotiations have moved quickly considering the severity of the charges, Meyer said that they have, thanks to frequent communication among parties. He added: “But, it’s not like it was a whodunit type of case.”

Meyer said he couldn’t comment how this latest update on Marquez might affect Adamson’s case. [JA trial date week of Aug 5].
