Lewis County Prosecutor Jonathan Meyer cited legislation called the “Miller-fix,” when asked if Marquez’s age factored into negotiations with O’Rourke on a fair outcome and plea deal.

The Miller-fix, according to a post from the Washington Defender Association, essentially mandates that a juvenile receive a 25-year sentence for an aggravated murder conviction — “with an opportunity for release after serving the minimum 25 year sentence.”

Meyer called it a “presumptive release date, regardless of sentence.”

“But the main driver for me, he needs to be held accountable, and we need to make sure that Mr. Eastman has justice. I don’t care what your age is. You don’t have the right to take away someone else’s life,” Meyer said.
One Suspect in Randle Teen’s Death Expected to Plead Guilty

ETA: Although BM was being tried as an adult, under the Miller Act, his age is what prevails at sentencing -- juvenile 25 year mandate.

This hurts but glad that at least JA will never see the outside for his remaining life upon his guilty verdict.

Teen pleads guilty, his brother to face trial in Benjamin Eastman murder

17-year-old Benito Marquez entered court Friday to plead guilty to first-degree murder and rape in the death of Benjamin Eastman. Prosecutors say while those charges carry a maximum sentence of life behind bars, a judge will wait to sentence Marquez until after he appears as a witness in the trial of his older brother, Jonathan Adamson.

After striking a plea deal with prosecutors, Adamson was also expected to enter a guilty plea Friday as well. However, he backed out at the last minute and called the hearing off.

The mother of the two defendants as well as another woman are charged with assisting Marquez and Adamson after learning about the crime. Adamson's case is now expected to go to trial. It's unclear why he changed his mind Friday.

After the violent death of his son, one father is turning tragedy into good

Eastman says it’s been more than half a year since he found out his only son was killed, and the feeling of loss has not left him.

“I miss his presence, yeah,” said BJ Eastman.

For Eastman, the light went out, a light that once shined not just on him and his family, but also on the entire community.

“You felt the loss when we started school,” said Chris Schumaker, Ben Eastman’s principal.

To honor Eastman, Schumaker’s school decided to turn Ben’s locker into a memorial. The door has been removed. The inside of the locker is painted in Miami Dolphins colors (Ben’s favorite football team). There are several pictures of Ben and his family within the locker, and his family has written loving messages on the walls of the locker.

“I was really taken aback,” said BJ Eastman.

Eastman says the school dedicated the locker to him and his family during a special assembly.

These signs of support from the community are what have helped him get through this difficult time.

Eastman says he’s felt so inspired by this love and support from the Randle community, he wants to keep spreading it.

"What better way to honor Ben than to share some love,” said Eastman.

About three months ago, BJ Eastman created a new foundation called Blessings from Ben.

Eastman said it was created to give back to local kids interested in sports, but since the foundation’s start the focus has spread to anyone in need.

Eastman says with the work of his foundation, his son will always live on.

Marquez Friday pleaded guilty to amended charges including murder in the first degree, rape in the first degree, tampering with physical evidence, and unlawful disposal of human remains. He is due back in court for sentencing on March 28.

Kinda Adamson pleaded guilty to two counts of rendering criminal assistance in the first degree and is due back in court for a sentencing review on Feb. 28.

Benito Marquez has been sentenced to around 34 years for the brutal death of 16-year-old Ben Eastman III. Marquez's brother, Jonathan Adamson, will stand trial in the case in August.

The siblings’ mother has also pleaded guilty to charges related to the murder of the teen. Kindra Adamson pleaded guilty to two counts of rendering criminal assistance last year for covering for her sons. She will not be sentenced until the conclusion of Adamson’s trial, which is set to begin in August.

Jonathon Adamson’s fiancee Emma Brown, is expected to plead to guilty to two counts of rendering criminal assistance next week, according to KOMO.

As for the recent sentencing of Marquez, the victim’s father is not impressed.

“I don’t agree with it. [It’s a] slap in the face,” B.J. Eastman told KOMO, referencing the length of the teen’s prison sentence. “It’s just not fair.”

CHEHALIS, Wash. – Benito Marquez, one of two Lewis County brothers accused of murdering 16-year-old Ben Eastman last June, plead guilty Friday to first degree rape and murder.

The defense and prosecution agreed to a sentence of 413 months – or just over 34 years – in prison. Marquez, 17, changed his plea during an afternoon hearing.

The two sides went back and forth for months during the plea negotiation. They said in court that Marquez’s age factored into the deal they reached.

While the guilty plea offers Ben’s family some closure, his father B.J. said he is frustrated that the sentence isn’t longer.

“I don’t agree with it. [It’s a] slap in the face,” B.J. Eastman said. “It’s just not fair.”

As part of the deal, Marquez would serve the maximum sentence for the murder charge, but the rape charge would likely be replaced by an assault charge. For Marquez, that would mean he would not have to register as a sex offender when he is released from prison.

Marquez also agrees to provide truthful information about the other people charged in the case. If he does not cooperate, his sentence could be much longer.

Marquez’s brother, Jonathon Adamson, was also scheduled to plead guilty Friday, but canceled the hearing just an hour before.

These hearings are painful for B.J. Eastman, but he plans to come to court until these cases are finished.

“I’m the face for my son, you know,” he said. “I’m here for my son. I’m his voice. He can’t plead his case anymore. That’s what I’m here for — to get justice.”

Kindra Adamson, the brothers’ mother, plead guilty to two counts of rendering criminal assistance last year. The prosecutor says she won’t be sentenced until after Jonathon Adamson’s case is resolved.

Fiancé of Randle Murder Suspect Pleads Guilty

Emma Brown, the Glenoma woman accused of misleading authorities when they were investigating the disappearance of slain Randle teen Benjamin Eastman III, pleaded guilty Monday morning to two counts of first-degree rendering criminal assistance.

Brown’s plea came just on the heels of Benito Marquez, 17, pleading guilty on Friday to first-degree murder and other charges in Eastman’s death.

Brown, 21, is listed in court documents as the fiancé of murder suspect Jonathon Adamson. Adamson, along with Marquez, his brother, is charged in Eastman’s June beating death.


Brown was accused of withholding information on Eastman’s whereabouts when deputies still believed he was a missing person, though she was already aware of the homicide.

Represented in court by attorney Jakob McGhie, Brown’s plea was entered as an Alford plea, meaning, McGhie said to Judge James Lawler, she doesn’t necessarily agree with the charges against her, however if the evidence is presented to a jury, she acknowledges they will likely find her guilty.

According to a letter sent to McGhie by Lewis County Prosecutor Jonathan Meyer, if Brown is to plead guilty to both counts against her and follow a list of other orders, the charges will be downgraded later. One of the counts will be changed to a non-felony count of rendering criminal assistance and the other to making a false statement. The recommended sentence from the prosecutor’s office will be credit for time served.

Among the list of things Brown must complete to comply with the plea agreement is making a recorded statement to law enforcement, passing a polygraph test and serving as a state witness in any other case connected to hers. Currently, the only other person attached to Brown’s case that hasn’t pleaded guilty is Adamson. Adamson was slated to plead guilty the morning of Feb. 22. However, he indicated to his attorney, Don Blair, that he didn’t want to follow through with the plea. The hearing was stricken. He’s currently set to go to trial the week of Aug. 5.

Marquez additionally agreed to serve as a state witness as part of his plea deal, as did the murder suspects’ mother, Kindra Adamson — who pleaded guilty last year to two counts of rendering criminal assistance. Kindra Adamson was also charged with misleading authorities during the investigation.

Brown waived her right to a speedy sentencing, meaning she doesn’t have to be sentenced within 40 days of her plea. She has a review hearing on March 28.

Also last week, Adamson’s brother and co-defendant Benito S. Marquez, 17, pleaded guilty to all counts against him, including first-degree murder and first-degree rape. During his hearing, both Lewis County Prosecutor Jonathan Meyer and Marquez’s attorney Shane O’Rourke referenced updated information on Adamson’s role in Eastman’s death.

Meyer, who declined to specifically say where that information had come from, said that Adamson’s new slate of charges were more appropriate given the allegations.
The alleged beating lasted somewhere between 20 and 45 minutes. At one point, Eastman got free and ran to his assailants’ car, locking himself inside. Adamson then allegedly unlocked the vehicle and Eastman was pulled out for the beating to continue.

Adamson allegedly cut Eastman across the back with a box cutter and raped him with a stick.

Agree. I believe that Oxygen reporter confused "agreed to a sentence" with the past tense. Judge has not sentenced Marquez yet.

According to a statement on the plea of guilty in Marquez’s case, on June 24, 2018, he and Adamson were camping, when they decided to lure Eastman into the woods with the intention of killing him.

“We knew that he would not suspect that we were going to kill him and used that trust to our advantage,” reads the document.

The alleged beating lasted somewhere between 20 and 45 minutes. At one point, Eastman got free and ran to his assailants’ car, locking himself inside. Adamson then allegedly unlocked the vehicle and Eastman was pulled out for the beating to continue.

Adamson allegedly cut Eastman across the back with a box cutter and raped him with a stick.

“After murdering (Eastman), we buried his body near the scene of the crimes. After discussing the matter with our mother, my brother and I decided to move the body to our grandparents’ property,” the document reads.

Deputies investigating Eastman’s disappearance found his body in a shallow grave on June 28. A cross made of sticks marked the grave.

ETA: Not sure why this is being reported as new "aggravated" charge. Adamson was initially charged with 2nd degree murder until additional details released with later arrest of brother Benito, Mom, and Brown, when Adamson charge upgraded to aggravated 1st degree murder. I think the only new charge here was witness tampering. MOO

Now - WHY would they WANT to kill him??!! Who would come up with a plan to kill your friend??!!

And you are correct Seattle about the "new" charges. I had to add to my list of charges (according to the article, which I didn't have before) were: 1st degree assault, 1st degree rendering criminal assistance (whatever THAT is?) and the 2 counts of witness tampering. And what they said in the article - 1st degree aggravated murder.

*Arraignment Hearing (@ 8:40am PT) – WA – Benjamin Eastman III (16) (June 23, 2018, Randle; found June 28, 2018) – only for *Jonathon Robert Adamson (21) arrested (6/30/18), charged (7/2/18) & arraigned (7/11/18) with 4 counts: 1st degree murder, 1st degree rape, 1st degree assault, 1st degree rendering criminal assistance, tampering with physical evidence, unlawful disposal of remains, 2 counts of tampering with a witness & charged (2/28/19) of first-degree aggravated murder which, upon conviction, would result in a mandatory life sentence. Plead not guilty. $10M bond.
New Trial confirmation hearing on 8/1/19 & trial to start 8/5/19.
3/7/19 Arraignment on new charges of 1st degree aggravated murder.
*Benito “Benny” S. Marquez (16) arrested (7/2/18) & charged (7/2/18) & arraigned (7/19/18) with 4 counts: 1st degree murder, 1st degree rape, tampering with physical evidence & unlawful disposal of remains. Plead not guilty. $10M bond. Marquez is charged as adult.
2/22/19 Update: Guilty plea entered had review hearing on 3/28. Agreed to a sentence of 413 months – or just over 34 years – in prison. Re deal Marquez would serve the maximum sentence for the murder charge, but the rape charge would likely be replaced by an assault charge. For Marquez, that would mean he would not have to register as a sex offender when he is released from prison. Marquez also agrees to provide truthful information about the other people charged in the case. If he does not cooperate, his sentence could be much longer. Since Marquez is under 18, he can apply for early release after 20 years behind bars. If denied, he can reapply every five years after that. Review hearing on 3/28.
*Kindra Rose Adamson (43) arrested (7/10/18) & charged (7/11/18) & arraigned (7/19/18) with 2 counts of Rendering Criminal Assistance. Plead not guilty. Was a $1M bond, Judge reduced it to $100K. Also allowed to reside in County other than Lewis if/when she’s released.
She knew of murder 6/23-24; withheld info from LE.

8/10/18 Update: Plead guilty to rendering criminal assistance. Faces a maximum of 20 years in prison, but under State guidelines more than likely will face a prison term of 12 to 14 months. As a condition of a plea bargain will likely be called by the state to testify against her sons. As part of the plea agreement, if she follows all the conditions of her release, one of the felony counts would be knocked down to a misdemeanor, with a recommended sentence of credit for time served. Review hearing on 3/28.
*Emma L. Brown (20) arrested (7/11/18) & arraigned (7/19/18) for 2 counts of Rendering Criminal Assistance. Plead not guilty. $1M bond, reduced to $100K; out on bond 7/13/18.
She knew of killings & withheld info from LE.
2/25/19 Update: Brown plead guilty to both counts against her & follow a list of other orders, the charges will be downgraded later. One of the counts will be changed to a non-felony count of rendering criminal assistance & the other to making a false statement. The recommended sentence from the prosecutor’s office will be credit for time served. Review hearing on 3/28.
