If you look at the link with a view of the fire pit, just a few posts above mine, it shows how this could have happened. He probably loosened his grip of the baby and the baby rolled down the incline to the firepit. There is no barrier, and the bench was extremely close to the pit. I believe this is an extreme case of an accident and very bad decisions. Who takes their sick baby outside to sleep?

That bench is right on top of the fire pit. You'd burn your knee caps off sitting on it. How stupid.

Exactly-I don't mean to keep harping on it, but was the dad actually outside sleeping with the baby on the bench? I don't believe so, and not with the 4 year old either...jmo.

The charging documents say he said he fell asleep w/the baby on his chest and his daughter next to him.

That video helps me picture the incident in my head, not that I really wanted to, but I can at least see how it happened. I can't figure out the hole, though.

So, so sad.

Okay I looked at the video...tell me how on earth the dad the baby and the four year old al fit to fall asleep on the tiny bench?

I wondered if "next to him" meant the dd slept on the ground? I thought the bench was pretty small myself, but I couldn't enlarge the video for some reason.

Ohhh, I don't know if I want to read the charging docs... :(

He has been deported 3 times before.

When I first looked at the video, I thought the grill sitting at the top of the pit was the bench, but it's not. The bench is metal and located to the left of the pit on a slight incline. I'm not good with photoshop, but I hope this picture helps:

Thanks for that because I couldn't see the bench very well when I watched it. I think it looks long enough and wide enough for at least him. I'm not sure about the dd too though. Doesn't it look homemade? Like pieces of plywood nailed together.

Federal Way man pleads not guilty in infant son's death in fire pit

After first indicating Wednesday that he wanted to plead guilty, a Federal Way man pleaded not guilty to a second-degree manslaughter charge in the death of his infant son in a backyard fire pit....

An attorney who represented Rios, 38, said before a morning arraignment that he wanted to accept responsibility and plead guilty before prosecutors could amend the case with more severe charges. But after reading a letter at a hearing Wednesday afternoon in which the King County Prosecuting Attorney's Office assured Rios' attorneys there were no plans to file more charges and urged Rios to take more time considering his case, Rios' attorneys entered a not-guilty plea for him.

I guess LE sincerely feels this was a terrible, terrible accident if they are trying to help the man minimize his jail time....This one needs to go into that Parenting 101 book someone should be writing from these cases...

1.) Do not fall asleep near a firepit with your infant on your chest.
2.) Do not leave your infant with a 6 month old puppy who might think it is a toy for 1.5 hours....

This whole case is horrible. Prayers for the family for strength to get through this (they will never get over it).
