Testimony continues in Summer Phelps case

Although there were troubling clues, 4-year-old Summer Phelps' severe abuse remained invisible to the nurses who visited her family and went unreported by the residents of the Spokane apartment building where she lived.

That's according to testimony Tuesday in the Spokane County Superior Court trial of Jonathan Lytle, Summer's father, who is charged with homicide by abuse.

Nobody caught enough of the danger signs to save Summer.

Sandra Gormon-Brown, a First Steps social worker, said she first visited the family in July 2006, shortly after the birth of Johnny Lytle, the son of Lytle and his wife, Adriana Lytle.

She described Summer as a "darling little girl" whose speech was delayed. She also noted in her reports that Adriana was "too harsh" with Summer.

Adriana Lytle canceled a second visit on Jan. 10, 2007, and during her February visit, Harms said Adriana Lytle didn't let her see Summer, saying the child was asleep in the bathroom and shouldn't be disturbed.

Linda Davis, who was staying at the Dresden Apartments where the Lytles lived, told the jury she heard "lots of crying and screaming" in the Lytle apartment, with "mentally abusive" words used against Summer by her stepmother. After Christmas, she saw a collar around Summer's neck that later proved to be a dog shock collar. Bryon J. Rogers, a painter who lives at the Dresden, said he worried about the safety of the Lytles' baby because he'd heard Adriana Lytle scream at him.

Attention all Social Workers: When you hear that a child is 'asleep in the bathroom' .... there's a huge clue that something might be wrong! :doh:

To any "neighbor" that hears lots of crying and screaming from a neighboring child, you might want to think about picking up the phone and asking the police to do a wellness check on the child. :rolleyes:

Maybe, if we all pay attention, we can prevent the next "Summer" from the same fate.

One by one, the items used to torture 4-year-old Summer Phelps in the last months of her life were shown Wednesday to a Spokane County Superior Court jury.

A black dog collar used to shock the child when she was too loud. A blue mop used to press her against a tall bathtub where she was forced to wash her urine-stained clothes and bedding. Black belts and kitchen utensils used to hit her.

Red hair found by police in the Spokane apartment where 4-year-old Summer Phelps died was mostly pulled from her head and matched her DNA, a forensic expert testified Thursday in her father's trial.

Jonathan Lytle is accused of homicide by abuse in the death of his daughter, who was beaten, bitten and shocked with a dog bark collar. She drowned in the family bathtub on March 10, 2007, after being forced to wash urine-soaked clothes for hours.

Summer's stepmother, Adriana Lytle, has pleaded guilty to homicide by abuse for her role in Summer's torture and death.

Electronics expert testifies about collar

In her four years of treating abused children at Chicago's inner-city Cook County Hospital, a local pediatrician told a Spokane jury Monday that she'd never seen a child as bruised as 4-year-old Summer Phelps and has never heard of a child being shocked with a dog bark collar or dunked underwater as punishment.

Harper, who moved to Spokane in 1985, said she saw a lot of child abuse in Chicago and has consulted on more than 500 abuse cases overall. Harper was asked by Spokane Police Department investigators to review photographs of Summer at Deaconess Medical Center the night of her death. She wrote her report on March 29, 2007.

Also Monday, electronics expert Mark Gores testified about the dog bark collar that prosecutors say Summer was forced to wear to keep her from screaming. Burns were detected on Summer's neck the night she died.

The shock device on the dog bark collar is triggered by vibrations. When the electric current was tested with an oscilloscope, it measured 2,698 volts – more than 20 times the electricity in a typical 120-volt home outlet, Gores said.

Both sides rest in Lytle case

Jonathan Lytle’s lawyers rested their case Wednesday afternoon without calling any witnesses in his trial on charges of homicide by abuse in what experts have described as one of Spokane’s worst child abuse cases.

A half-hour earlier, the trial judge denied a defense motion to dismiss the case, saying Lytle showed “an extreme indifference to human life” in the torture death of his 4-year-old daughter, Summer Phelps.

Lytle’s lawyers from the Counsel for Defense moved to dismiss after the state rested its case. They claimed the state hadn’t proved Lytle caused the extensive injuries to Summer, who was beaten, bitten, burned and denied food.

Adriana Lytle, Jonathan Lytle’s wife, has already pleaded guilty to homicide by abuse in Summer’s death.

After two weeks of harrowing testimony about the death of 4-year-old Summer Phelps, a Spokane jury must now decide whether Summer's father played a central role in the escalating violence that killed her.

The homicide by abuse trial of welder Jonathan Lytle went to the jury Thursday after a prosecutor and a defense lawyer presented two starkly different versions of who was most responsible for the child's death.

Summer's stepmother, Adriana Lytle, has pleaded guilty to homicide by abuse – avoiding a similar trial – and is in the Spokane County Jail awaiting sentencing after the verdict in her husband's trial.

Spokane County Deputy Prosecutor Larry Steinmetz told the jury Thursday that the Lytles turned their tiny, cluttered apartment on North Monroe Street into a "torture chamber" where Summer was systematically beaten, burned, shocked with an electric dog collar, forced to wash urine-soaked clothes, starved and dunked in a bathtub for punishment until she died March 10, 2007.

SPOKANE -- A Spokane County jury convicted a Spokane man of abusing and torturing his 4-year-old daughter to death.

Thirty-year-old Jonathan Lytle showed no emotion as jurors announced the verdict, which came after only four hours of deliberations. Lytle was found guilty of homicide by abuse in the death of Summer Phelps. The girl was beaten, bitten, burned and denied food for long periods before she died on March 10, 2007.

Jurors also found Lytle guilty on three aggravating factors: that he used deliberate cruelty, that the victim was especially vulnerable and that Lytle had a position of trust and authority that he used to carry out the crimes.

Lytle faces up to life in prison.

SPOKANE -- The Spokane father convicted in the death of his daughter said in a jailhouse interview he, too, is a victim.

He called the death of his four-year-old daughter, Summer Phelps, a Cinderella horror story, where the step-mother is to blame for her death.

In a rambling and disjointed interview Monday night, Lytle said he is "dumb as a box of rocks" amd couldn't comprehend what was happening

I haven't watched the video yet, but I'm sure Jonathan will be casting all the blame on the wicked step-monster, Adriana. I hope they both rot in jail for their horrific abuses upon darling little Summer!

I hate it when they just say a person "got life." Are they talking about LWOP or are they talking about "life" where he can come up for parole in 10 years?

I hope they both get horrible, fatal diseases soon. Let them die - painfully - in prison. Sorry, but I hate the thought of taxpayer $$$$ caring for them for any length of time. If there is any justice in the universe, they will both suffer.

Neither is eligible for parole until they are in their 90s. Jonathan got 70 years, Adriana got 67 years. Elizabeth Phelps ought to get something for child endangerment.

Let me say first that I am not trying to incite any reactions for fellow posters. I am not trying to stir things up...I swear....

But I went on myspace to see if there was a tribute page for this little girl, because often times there is one created for murdered children.

I stumbled across one registered under her Mother's name but it was set to private. So I clicked on the other myspace profile registered to Mother's name and it is public.

I went back and reread the articles listed on page one and thereafter in this thread trying to figure out the exact date of this wee baby's death and I could only figure it was March of 2007.

Did I read correctly that Mom dropped Summer off in the August prior to her death and did not go to pick her up? Did I read correctly that Dad stated he had cut himself off from her by moving and cutting off phone? Why weren't the authorities alerted to this? Did father have custody of Summer? Was it joint custody?

Rest in peace sweet Summer you precious ginger haired princess. (Sorry she just touched my heart when I read this today).

Kat, I believe it's correct that Summer's bio-mom dropped her off in August and did not go back to pick her up.

I don't think Summer's sperm donor cut himself off from Summer's egg donor. I'm pretty sure he stayed right at the same place where "mom" (I use the term loosely, as she wasn't much of a mother, imo!) dropped her off.

I believe that was Adriana's sister that you are thinking of, that moved away (after kicking Adriana out) and changed her phone number; basically trying to 'hide' from Adriana. I'm not positive but I'm pretty sure the egg-donor had custody of Summer.

Yes, Summer was a precious little princess. Here's a couple of photos for those who are unfamiliar. Summer will always remain in my heart!
