Millard obviously talked about it. Isho posted that photo of himself with the gun pressed against his eye, that can't be a coincidence. If he told Isho he likely told Smich.

I feel that leaving the phone and the credit card to be used, he was creating his own alibi, and didn't dream that Marlena would speak up. They had her pretty controlled back then.
