They cannot be tried for any crime, wenchie. It sounds crazy but it is true. If the grand jury concluded that Burke was the perp, the gag order would be put on the case, and no prosecution would occur. You are correct that they would not do "nothing". What they would probably do is recommend psychiatric help amongst other solutions, but there is not crime that an individual under the age of 10 can be charged with in Colorado. Regardless, Burke would be in therapy after his sister was murdered anyway.
I'm not saying that this is my theory, but I'm just trying to give you the background on the COlorado law. Also, as is the case in all states, juveniles identities are to be kept secret. I do not know of the extent that the state may go to, in order to protect identities, but it is their job to do so...
