What's Your Opinion On Why Jurors Ask To Hold And See Heart Sticker

  • #41
I haven't read anyone's thoughts but yours, so if I repeat what others said, forgive me. When Judge Perry gave the jurors the choice of seeing the picture on the screen or passing the item among themselves or both, I automatically answered, "Both". Why? Because seeing something in person is very different than seeing something in a picture. Remember, our world is 3-D, but a photograph is flat, 2-D, having only width and length but no depth. Seeing things in person is always better.

Frankly, I don't know why they've collected all that evidence on the evidence table and not opened it for the jurors to see. What's that about? If I were on the jury, I'd want to see it all, up close and personal.

There was also the fact they weren't told what it was. I think I figured it out by the description Baez gave when he was objecting (something he rarely does, so of course, the jury was curious. ).

I have a couple theories about why the jurors are not fondling the evidence.

It would take too much court time and $. The purpose of the screens are so they are able to see the evidence without all 12 of them touching, studying a particular piece one by one. They can do that in deliberations when they only cost us hotel, meals and the nominal payment.

I think the reason that the envelopes aren't opened is twofold. Same thing with time...And the fact that everyone must wear gloves when they touch any of the evidence. This is to insure that if ICA is put away wrongly..where is that funny guy icon?..the evidence will still stay pristine.

Surely I don't want them to handle everything. In this case, I was talking about the heart sticker specifically. It's much better to see it in person than in a photo. About the other evidence, the really important evidence, like the canvass bag, the child's blanket, maybe even a plastic bag from the woods, could have been help up to the jury, maybe just carried in front of the witness box so they could all see the damage. Certainly I didn't mean every strand of hair, every dry leaf, or every buccal swab. KWIM?
