DAY 1 - WI v. Jessy Kurczewski | Opening Statements - A Wisconsin woman is facing life in prison if convicted of killing a friend in her care by poisoning her with eye drops. Jessy Kurczewski, 39, is charged with one count of first-degree intentional homicide and two counts of felony theft in the 2018 death of Lynn Hernan. Opening statements begin in the Waukesha County court of Judge Jennifer Dorow.

Judge Dorow is not playing around with these attys! Her tone and decisiveness is refreshing. I was critical of how she handled Darryl Brooks and I’m loving this side of her!

Jurors are getting spunky! Declaring you won’t show up once you’ve been selected is quite something. He did show though! Haha!

Defense is playing tricks already - telling that juror his boss’ dad was related to the victim!! Why didn’t state indicate before the juror was brought out that they wouldn’t be calling the witness in question? They wait until defense has poisoned the well to indicate oh by the way….? Smh

Just a quick aside - I’m loving Judge Dorow’s nails! She talks a lot with her hands (as do I) and I couldn’t help noticing. I wonder if it’s acrylic or natural??

Anyway, state’s motion to not broadcast ME’s testimony was a big ask! Not surprised judge shut it down. As usual Judge Dorow is quite verbose. Listening to the hearing now….
Me too! I'd guess acrylic (that's what I wear), but could be press-on. moo

Defense is showing photos of the victim & the defendant, defendant is crying.
--- She treated you like the daughter she never had, moo. Did you take advantage of her kindness? Time will tell... evidence.

A friend of Hernan told investigators he didn't believe it was a drug overdose – and thought Kurczewski and her mom were involved. In January 2019, the medical examiner said Hernan had a fatal dose of the main ingredient found in eye drops, and there shouldn't be any of the drug in the woman's blood – adding it was "impossible to have that level...in the blood just by using it in the eyes." At that point the investigation was reopened, and Kurczewski was arrested in July 2019

Defense is arguing in openings. Finally state objects to defense saying visine doesn’t kill you! This is opening statement not argument, judge reminds defense.

It sounds like this trial will be heavy on the forensic accounting evidence, which can get tedious depending on the witnesses. It’s quite dry testimony, generally.

So now defense is saying the victim was in on the fraud. The victim was defrauding the bank for a loan, according to defense.

Well, for a fair and balanced opinion, I need to know what the Defense's intentions are. It appears they are taking the defensive position that the victim died by suicide so they will need to mention the victim's participation, if any. By example, D mentioned the various and copious amounts of drugs in the victim's system at TOD.

Then, D mentioned the FBI report on the handwriting on the bank checks, by saying, that their analysis is "they don't know". The P objected by telling the Judge that is misrepresenting the FBI handwriting report. D said, "We'll see."

Correction: Yesterday on the stand was a deputy medical examiner - handles case overload for the ME.

The 39-year-old Wisconsin woman accused of poisoning her wealthy friend with eye drops faces trial for murder. Jessy Kurczewski allegedly dumped six bottles of Visine into Lynn Hernan’s water bottle and tried to stage her death as an overdose in 2018. Prosecutors also claim Kurczewski defrauded Hernan of nearly $300,000 before killing her. Judge Jennifer Dorow, who oversaw Darrell Brooks’ Waukesha parade massacre trial, is overseeing Kurczewski’s case.
