Jesse Vang, charged in the death of 3-year-old Elijah Vue, has filed a federal lawsuit against the Manitowoc County Jail, alleging unfair treatment and discrimination.

In the lawsuit, Vang claims he is being targeted and discriminated against based on his "race, color and or charges." He alleges that he is punished for infractions that other inmates commit without consequence.

The lawsuit states Vang was disciplined for having extra blankets, socks, and T-shirts, and for not wearing his proper jail uniform.

According to jail records included in the lawsuit, these items are considered contraband.

In more than 30 pages of documents attached to his handwritten complaint, Vang says deputies and jail staff have targeted him since last year, writing him up for what he calls minor rule violations like having extra clothing or not wearing his uniform exactly as required, and claiming that other inmates who do the same things aren’t punished.

In those same records, jail staff say Vang used profanity, disobeyed orders, and repeatedly waived disciplinary hearings.

Vang has filed multiple grievances throughout 2024 and 2025, detailing complaints of what he considers unequal treatment.

Vang said the staff's treatment of him is a violation of his 8th Amendment and 14th Amendment rights, which refer to cruel and unusual punishment and equal protection under the law.

Among the Manitowoc County Jail inmate reports, staff said in one instance they found that Vang concealed a nail inside a soap box, which is considered possession of contraband. Jail staff also mentions numerous occasions where Vang refused to wear his uniform. Staff also cited Vang's disrespectful behavior, where he used anti-gay slurs multiple times toward corrections officers.

Vang filed several grievances in 2025, which were denied.

Good, I hope he’s unhappy as all get out. The reference to his making numerous anti gay remarks to staff further convinces me that the whole “making a man” out of Elijah was rooted in some delusional belief that the little boy was gay.

IMO both Vang and Baur are the lowest of the low, trash that fouls society and have forfeited their right to walk freely among us. Bah.

Vang's attorney, Jeffrey Jensen, said he will soon be ready to file pre-trial motions in the case. Judge Anthony Lambrecht set a March 23 deadline for those to be filed, with the state replying by April 20. Oral arguments will be held May 18.

Baur's attorney, Amber Gratz, says she is still reviewing evidence in the case and isn't ready to file motions. As such, no deadlines were set Thursday.

MANITOWOC COUNTY, Wis. (WBAY) - Jesse Vang, one of two people charged in connection to the death of Elijah Vue, filed three motions Monday that ask for some evidence to be excluded, as well as a change of venue for his upcoming trial.

Vang's attorneys argue the cadaver dogs finding decomp in trunk evidence should be tossed because they can't cross a dog on the stand :rolleyes:

They want the state's soil expert to be ousted because jurors can judge the samples themselves and don't need an expert to tell them what to think. :rolleyes:

and of course, the usual and expected, too much pretrial publicity means he can't get a fair trial and wants venue moved or jurors brought in from another area and sequestered during trial.

Defense motions were due March 23; prosecutors have until April 20 to respond. Vang faces child abuse causing death, hiding a corpse and neglect charges​
