Cash bond reduced for teen charged in Manitowoc County 7-year-old's death

MANITOWOC (WLUK) – The cash bond set for a teen accused in the death of a 7-year-old relative was reduced to $100,000.

An order was entered Friday reducing the bond from $150,000 cash to $100,000 cash, court records show.

Earlier this month, a judge denied Damian Hauschultz’s request to move the case from adult court to juvenile court. No trial date has been set. He returns to court April 2 for a motions hearing.

8/13 Update: The matter is before the Court to modify/reduce the bail, to allow contact with the defendant's wife, and also to discuss having Jacob Hauschultz as supervisor for contacts between the defendant and his daughter S.H. Arguments. The Court denies all 3 parts of the motion. Next Scheduling conference hearing on 10/28.
10/28/19 Update: Status hearing on 1/27/20. 1/27/20: Defendant in custody. Defense counsel is working on a motion to suppress. The parties are asking for another date for scheduling conference. Scheduling conference is set for 2/18/20.

Court-appointed guardians ask for Hauschultz case to be moved outside Manitowoc County

MANITOWOC (WLUK) - One of the court-appointed guardians of a 7-year-old boy who died after being beaten and put in a snowbank is asking that a jury from outside Manitowoc County hear the case.

At a status conference Tuesday, Tim Hauschultz’s attorney filed a motion for a change of venue, and a motion to suppress the results of what it claims is an unreasonable search. A motions hearing is scheduled for April 27, court records show.

Damian Hauschultz returns to court April 2 for a motions hearing. In Wisconsin, those ages 10 and older charged with homicide are charged in adult court. A motion to move the case to juvenile court was rejected.

McKeever-Hauschultz returns to court March 31, when the results of a competency exam will be reviewed.

Judge denies motion to reduce bail for teen accused in 7-year-old Ethan Hauschultz's death

MANITOWOC - A Manitowoc County judge has denied a motion that would have given 16-year-old Damian Hauschultz a reduced cash bail and a chance to leave the juvenile correctional facility he's being held at as long as he was monitored.

A motion hearing on the matter was held in Manitowoc County Circuit Court via Zoom video conferencing on Thursday, although Hauschultz was not able to attend since the juvenile correctional facility does not have video conferencing capabilities.

In the motion to modify bail, filed March 11, Hauschultz’s attorney, Russell Jones, said the current bail, set at $100,000, is excessive.

During the motion hearing, Jones argued that a bail of $25,000-$50,000 is still a significant amount to Hauschultz’s family and that the lowered amount, coupled with other bail conditions such as GPS monitoring, would ensure Hauschultz’s continued appearance to his future court dates.

Teen accused in death of 7-year-old Ethan Hauschultz released on $100K bail, court records say

April 13, 2020

MANITOWOC - A 16-year-old boy charged in the death of a 7-year-old boy has been released from custody after $100,000 in cash bail was posted on his behalf, according to court records.

The cash bail was posted less than two weeks after a Manitowoc County judge denied a request from Damian Hauschultz and his attorney, Russell Jones, to lower the amount of money required to secure his release from juvenile detention.

At the time, Jones argued that an amount between $25,000 and $50,000 would still be significant to Hauschultz's family and, along with other conditions, would be enough to make sure he appeared at future court dates.

Hauschultz's address was changed in court records to reflect an address in Manitowoc. His next court appearance is July 1.

MANITOWOC (WLUK) -- A woman charged in connection with the death of a 7-year-old boy is competent to stand trial, a judge ruled Friday.

Tina McKeever-Hauschultz faces four counts, including intentionally contributing to the delinquency of a child causing death, for the April 2018 death of Ethan Hauschultz.

The ruling means McKeever-Hauschultz comprehends the proceedings and can assist in her defense. As a result of the decision, the criminal case resumes. An arraignment is scheduled for May 13, court records show.

MANITOWOC (WLUK) – Tina McKeever-Hauschultz pleaded not guilty Wednesday to her role in the death of a 7-year-old boy.

McKeever-Hauschultz faces four counts, including intentionally contributing to the delinquency of a child causing death, for the April 2018 death of Ethan Hauschultz.

No trial date was set Wednesday. A scheduling conference is set for July 27. The parties appeared by video conference due to the Supreme Court directive limiting in-person court appearances.
