*Tina McKeever-Hauschultz (35/now 41) (great aunt) – 3/12/21: Plead no contest to 2 counts of child abuse-failing to prevent bodily harm & the 2 counts intentionally contributing to the delinquency of a child were dismissed. Sentenced to 5 years in prison & 5 years extended supervision. Was released in January, 2025 & now serving 5 year extended supervision.
*Damian L. Hauschultz
(14/now 21) – Plea hearing on 6/25/21 & plead guilty to 1st degree reckless homicide & was sentenced on 9/2/21 to 20 years in prison & 10 years probation. Filed official appeal on 12/9/22. Court of Appeals acknowledged on 4/11/23. Appeals denied (3/13/24). His 2nd appeal was denied to heard in the Appeals Court (9/12/240.

MANITOWOC (WLUK) -- A judge did not make a ruling Friday on whether three social workers will be allowed to testify about Timothy Hauschultz's disciplinary techniques at his upcoming trial on felony murder and other charges related to the death of his great-nephew, Ethan Hauschultz, 7.

The defense wants to call three social workers to testify about the punishments Hauschultz ordered. The social workers knew of his tactics, and didn't stop them, leading Hauschultz to belief they were reasonable and appropriate, according to defense attorney Donna Kuchler.

However, as "offers of proof" about the testimony were not filed in a timely fashion, Judge Jerilyn Dietz ruled last month that they could not testify. Hauschultz's attorney asked for a reconsideration of the ruling, which was supposed to be addressed Friday. That didn't happen.

Kuchler asked to submit details in writing, which the judge wants by Monday. No additional hearing was scheduled.

MANITOWOC – Timothy S. Hauschultz was set to have a jury trial beginning next week but that was canceled and a plea hearing was set for later Feb. 20.

A jury trial had been scheduled for Feb. 24-March 5. It had been rescheduled several times while an appeals case was decided for Damian Hauschultz, who had been convicted of reckless homicide in Ethan's death.

The trial was canceled Thursday, according to a judicial assistant from the Manitowoc County Courthouse. A plea hearing is now set for 2 p.m.

MANITOWOC (WLUK) -- A judge rejected a plea deal Thursday for Timothy Hauschultz, who is charged with ordering the punishment which led to the death of Ethan Hauschultz, 7, in 2018. As of now, the case is scheduled for a motions hearing Monday and a trial on Tuesday.

A trial was scheduled for Monday, but a plea deal was reached between the state and defense. The terms of the plea would have seen Hauschultz convicted of two counts being party to child abuse - intentionally causing harm. Six other counts, including felony murder and intentionally contributing to the delinquency of a child causing death would have been dismissed.

Judge Jerilyn Dietz questioned the severe reduction of the charges, and said she wouldn't accept those terms. Both sides cited their review of the evidence coupled with the risks of going to trial -- with the possibilities of acquittal or conviction -- but Judge Dietz was unswayed. Court was adjourned to allow the parties to reassess the plea deal.

When court resumed, the defense again argued that plea deal should be accepted, citing the District's Attorneys' Constitutional role to decide what charges to file and prosecute, but the judge again rejected it.

Thursday's hearing was originally going to address the issue of whether three social workers would be able to testify at trial about their knowledge of types of punishment Hauschultz would order. The defense plans to argue because they were aware of the log-carrying punishments and did not intervene, Hauschultz's actions were legal. Those issues will be discussed Monday, with trial now scheduled for Tuesday.

Both parties appear for today's Plea Hearing. The joint agreement is a plea to the charge in count 3, Party to Crime Child Abuse - Intentionally Cause Harm and to the charge in count 6, Party to Crime Child Abuse - Intentionally Cause Harm. The remaining counts would be dismissed and read in. The parties jointly recommend prison/time served.
The Court requests an explanation of the plea agreement from the State.
Attorney Jacalyn Labre states the District Attorneys office did an evaluation of the case and took into account the victims wishes, facts, and other defendants associated and based upon those factors the State feels that this is appropriate.
Victim does not agree with the offer being presented by the parties.
The court addresses the agreement and does not accept. Defense would like to speak out against the decision of the court. The court allows the Defense. The court address other cases in relation to this plea agreement. The Court has made its ruling and that it does not satisfy the publics best interest - the plea is not accepted by the Court.
The Court will have a brief break, everyone back at 2:50pm -parties to work out a more appropriate offer while off the record.
Defense has Attorney Novreske voice his take on the courts ruling and speaks on the matter. The Court rejects the argument as the court gave both parties a half hour to come up with a new agreement. The Trial is still on and to begin on Tuesday 2-25-25. Motion hearings will be held on Monday 2-24-25 prior to trial.

The joint agreement is a plea to the charge in count 3, Party to Crime Child Abuse - Intentionally Cause Harm & to the charge in count 6, Party to Crime Child Abuse - Intentionally Cause Harm. The remaining counts would be dismissed & read in. The parties jointly recommend prison/time served. The Court requests an explanation of the plea agreement from the State. Attorney Jacalyn Labre states the DA's office did an evaluation of the case & took into account the victims wishes, facts & other defendants associated & based upon those factors the State feels that this is appropriate. (14/now 21) – Plea hearing on 6/25/21 & plead guilty to 1st degree reckless homicide & was sentenced on 9/2/21 to 20 years in prison & 10 years probation. Filed official appeal on 12/9/22. Court of Appeals acknowledged on 4/11/23. Appeals denied (3/13/24). His 2nd appeal was denied to heard in the Appeals Court.

MANITOWOC (WLUK) – Timothy Hauschultz will not stand trial Tuesday on charges he ordered the punishment which led to the death of Ethan Hauschultz, 7, in 2018, as his lawyers will appeal a judge’s decisions to reject a plea deal and not recuse herself from the case.

On Monday, District Attorney Jacalyn Lebre and defense attorney Bradley Novreske both urged the judge to reconsider her decision and allow the plea deal. She declined, saying it’s not in the public’s interest.

A defense motion for Judge Dietz to recuse herself was also denied, so the defense said it would file an “interlocutory appeal,” asking the appeals court for an immediate review of the decisions.

However, after an additional, private meeting with the victims in the case, the judge reversed course and postponed the trial. Details of that session were not divulged, with Judge Dietz calling her ruling “admittedly vague” for confidentiality reasons.

No new trial date was scheduled. The parties will return to court March 5 to discuss scheduling.

Defense provides additional oral argument in support of its motion to stay proceedings - adding that the defense has unresolved questions regarding previous bellows motions and issues gaining information from related CHIPS cases.

Corporation Counsel Attorney Peter Conrad contributes to the discussion, making clarification that the Court has not permitted testimony pertaining to any youth or juvenile or their records. Attorney Conrad confirms that based on prior rulings, there is no existing order from a children's court which would authorize any release of information.

Court makes record on some of the points from the defense motion to stay proceedings. The motion to stay proceedings references the "late decision by the trial court on the issue of the admissibility of the social workers' testimony". The Court already ruled on the motion re social worker testimony in 2023 (and Judge Rohrer ruled on it in 2022). The ruling filed by this court on 02-21-25 was simply to re-affirm those past rulings.
The Court feels, based on thorough review of case law, that it acted well within its discretion and did not in any way impede on the defendant's rights. Defense requests the following conditions to be amended:

1. No contact provision with Tina M. McKeever-Hauschultz be amended to allow contact with the restriction that they are not to discuss the case.
2. No unsupervised contact with S.L.H. DOB: 12/24/2006 to be amended to allow unsupervised contact with the restriction that they are not to discuss the case.
3. Allow the defendant to attend bible study at additional dates and times than previously listed on the bond.

The State objects to all modifications. The no contacts are in place with Tina McKeever-Hauschultz and S.L.H. as they are witnesses in this case. The restriction on the bible studies was put in place to limit the defendants contact with children by allowing him to attend adult bible class only. The State argues that conditions as currently set are sufficient.

Defense argues that nearly three years have elapsed since the last bail modification with no violations from the defendant. Defense would request contact with Tina McKeever-Hauschultz and unsupervised contact with S.L.H. with the restriction that they are not to discuss details of the case. Additionally, defense believes that the defendant should be able to attend church without restrictions regarding services, classes, or bible studies.

The Court will amend the bond as follows, the Defendant may have contact with S.L.H. DOB: 12/24/2006 with the restriction that they are not to discuss the case, non-violent contact with Tina M. McKeever-Hauschultz with the restriction that they are not to discuss the case. Additionally, the court orders that the defendant is permitted to attend any adult bible classes at the Open Bible Baptist Church located at 2021 S. 14th Street. If there are children present the defendant must leave.
All other conditions are to remain the same.
The Court orders the Pastor must be provided with a copy of the amended bond.

MANITOWOC (WLUK) – Timothy Hauschultz will not be able to appeal three issues before his case goes to trial for allegedly ordering the punishment which lead to the death of Ethan Hauschultz in 2018, a court ruled Monday. The defense also wanted to appeal a decision about the scope what social workers will be allowed to testify about at trial. However, such appeals – known as “interlocutory appeals” – are not automatic. The appeals court needs to give permission for such appeals to be heard. Prosecutors opposed the defense motion. In a two-page ruling Monday, the appeals court denied Hauschultz’s permission for the appeals to be heard.

MANITOWOC (WLUK) -- The man charged with ordering the punishment which allegedly led to the death of Ethan Hauschultz in a snowbank in 2018 wants the jury selected from outside of Manitowoc County due to pre-trial coverage of the case.

Hauschultz's attorneys, Bradley Novreske and Donna Kuchler, contend the jury needs to be picked elsewhere as a matter of fairness.

Hauschultz (7) (April 20, 2018, Manitowoc; burned & buried in “coffin of snow”) – *Timothy Scott Hauschultz (48/now 54) (great uncle) charged (2/4/19) & arraigned (3/20/19) with first-degree reckless homicide, 3 counts of substantial battery & 3 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-death as a party to a crime, 2 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-felony & a misdemeanor battery. 2/26/25 Update: Defense attorneys on Wednesday filed an appeal to the Wisconsin Court of Appeals re rejected plea deal by Judge Dietz. The Court of Appeals could have a decision by 3/12/25. 2/25/25 Docket update: Motion for modification of bond. 2/26/25 Docket updates: Transcript of motion hearing. 3/5/25 Update: Scheduling conference with Judge Jerilyn M. Dietz presiding. Defendant Hauschultz appeared by video. Attorney Donna Jean Kuchler & Attorney Bradley W Novreske appeared by video for Hauschultz. Attorney Jacalyn Christie Labre & Attorney Jill Vendetti appeared by video for State of Wisconsin. Matter is on the calendar for a motion to modify bail & a scheduling conference to reset the matter for trial. Court begins with the motion. Defense requests the following conditions to be amended: 1. No contact provision with Tina M. McKeever-Hauschultz be amended to allow contact with the restriction that they are not to discuss the case. 2. No unsupervised contact with S.L.H. DOB: 12/24/2006 to be amended to allow unsupervised contact with the restriction that they are not to discuss the case. 3. Allow the defendant to attend bible study at additional dates & times than previously listed on the bond. The State objects to all modifications. The no contacts are in place with Tina McKeever-Hauschultz & S.L.H. as they are witnesses in this case. The restriction on the bible studies was put in place to limit the defendants contact with children by allowing him to attend adult bible class only. The State argues that conditions as currently set are sufficient. Defense argues that nearly three years have elapsed since the last bail modification with no violations from the defendant. Defense would request contact with Tina McKeever-Hauschultz & unsupervised contact with S.L.H. with the restriction that they are not to discuss details of the case. Additionally, defense believes that the defendant should be able to attend church without restrictions regarding services, classes, or bible studies. The Court will amend the bond as follows, the Defendant may have contact with S.L.H. DOB: 12/24/2006 with the restriction that they are not to discuss the case, non-violent contact with Tina M. McKeever-Hauschultz with the restriction that they are not to discuss the case. Additionally, the court orders that the defendant is permitted to attend any adult bible classes at the Open Bible Baptist Church located at 2021 S. 14th Street. If there are children present the defendant must leave. All other conditions are to remain the same. The Court orders the Pastor must be provided with a copy of the amended bond. Defense to file an order. Parties discuss scheduling. All additional motions must be filed with the court by 4/25/25. Next pretrial conference set for 9/4/25 @ 9am, Jury trial set to begin 10/01/25 at 8:30am. All future court dates are subject to the decision of the Court of Appeals. 3/10/25 Docket update: Assistant Attorney General Michael Conway filed the State's response late Monday, opposing the appeals court reviewing any of the matters. Filed: Response to Petition for Leave to Appeal.
3/17/25 Update: Hauschultz will not be able to appeal three issues before his case goes to trial for allegedly ordering the punishment which lead to the death of Ethan Hauschultz in 2018, a court ruled Monday. The defense also wanted to appeal a decision about the scope what social workers will be allowed to testify about at trial. However, such appeals – known as “interlocutory appeals” – are not automatic. The appeals court needs to give permission for such appeals to be heard. Prosecutors opposed the defense motion. In a two-page ruling Monday, the appeals court denied Hauschultz’s permission for the appeals to be heard.

Hauschultzes were court appointed guardians for Ethan & his 2 siblings in 2016.
*Tina McKeever-Hauschultz (35/now 42) (great aunt) – 3/12/21: Plead no contest to 2 counts of child abuse-failing to prevent bodily harm & the 2 counts intentionally contributing to the delinquency of a child were dismissed. Sentenced to 5 years in prison & 5 years extended supervision. Was released in January, 2025 & now serving 5 year extended supervision.

(14/now 21) – Plea hearing on 6/25/21 & plead guilty to 1st degree reckless homicide & was sentenced on 9/2/21 to 20 years in prison & 10 years probation. Filed official appeal on 12/9/22. Court of Appeals acknowledged on 4/11/23. Appeals denied (3/13/24). His 2nd appeal was denied to heard in the Appeals Court (9/12/24).
