I don't understand the concept - if she's too ill to sit for trial, how can she be considered mentally healthy enough to be culpable at the time of the crime?
I kind of understand. It's possible for a murderer to be of sound mind during the act but due to other factors - regret, remorse, fear, being put in a cell, etc. - their mental state can deteriorate after the act. IOW, there are two determinations that must be made; did the perp act intentionally as they committed the crime and are they now capable of assisting in their defense?

This case is really tricky as the girl is so young she may or may not have had the capacity to understand the consequences of murdering an infant (the finality of death) yet there is strong evidence that she knew if she continued stomping on the baby he would die. That doesn't exclude the possibility that since she was arrested she's undergone substantial stress which may impair her thinking.

IMO this is the no-win situation from hell. She's young and there's a chance she can be rehabilitated. OTOH she could be one of the rare people who lacks empathy for others and will harm someone else if she is released back into society. The whole case sucks. MOO.

“There is no way it was done in any type of intentional way,” the mother, who was not identified to protect her daughter, told Inside Edition.

When asked if she could remember what her daughter said following the incident, the mother replied: “That it was, just that was it was an accident. And you know? I believe my daughter.”

Wisconsin law requires the case – at least initially – be held in adult court, though it could later be transferred to juvenile court. The girl is currently being held in the adult unit at the Winnebago Mental Health Institute on $50,000 cash bond.

“She’s the youngest person there. She’s 11 years old with women 40 years old and over,” her mother told Inside Edition.

“At 10, your brain can’t process half the stuff that me or you or anybody else can.”

“She wants to be a doctor,” she said. “She wants to save people.”

Her mother also told the news outlet her child suffered from a mental illness that they’d been unable to get her help for. Ahead of the incident, they sought out treatment for, but were turned away because the girl was too young.

Ultimately, the family opted to send her to the daycare three days a week as a last resort.

The girl’s mother said if they’d been able to get treatment, her daughter “wouldn’t have been” at the day care and the baby boy’s death “wouldn’t have happened.”

Officials previously declared the young suspect not competent to stand trial. They said if she is able to better understand the circumstances the case can resume.

She is slated to again appear in court on Oct. 10.

A psych facility is terrifying to most people who have experienced it. They are not quiet, calm places. I can see how a child held in an adult facility would deteriorate.

It's totally possible for mental illness to not be treated depending on what the disease is. It doesn't mean she hasn't been diagnosed. Now the diagnoses would help us to know her better but that information wasn't given. I know from personal experience that many times they don't want to treat kids this young if they have a bipolar disorder, schizophrenia, etc. The drugs almost always say not for anyone under 18 although they can be prescribed for children 12 and older but they have to weigh the risks.
I agree that mom wasn't there and didn't have custody so she should not make comments of what her daughter did that day.

they treated me at 13 , but it was a hard road and it didn't help , it seemed to actually make it worse ...I would never touch any of that stuff now Ive been thru every pill on the market,including anti psychotics, sometimes that doesn't work and I just have to calm down take Valium and sleep, I don't see any solution...its sad for all involved.

And how exactly will the 5k online funding campaign bring the girl home?
I thought it was 50,000 and that seems to be her bail out of the institution per that article, which is weird , you don't get bail out of a mental facility '??????

A friend of the family launched a GoFundMe campaign in August to raise money in a bid to bring the young girl home, which is located about four hours away from the facility where she is currently in custody.

BBM so this was or was not a foster family??? so mom did have custody?

You're right - I misread it last night. It's 50k. So now my question is what could the mother do with the girl at home with her that couldn't be done in a hospital setting?

The mother wasn't clear about what treatment exactly she couldn't get for the girl so we can only guess that AC's Grandma was correct in that she may have been diagnosed with something but wasn't eligible for medication.

There was no indication in the article that the mother intended to get help for her daughter if she comes home as she believes she stomped the baby to death by accident. That's a scary attitude and contrary to mom's belief IMO the girl would pose a danger to others if she's released into her mother's care without strict supervision. MOO.

Every person I've known personally who was desperate enough to put their child in some sort of in patient mental health treatment ended up regretting it. They almost never provide truly appropriate care even when dealing with children. (Sure I'm sure some are good and appropriate. I'm only talking about the families I know who were desperate for help and found it to be nothing like claimed or promised.)

I can't imagine putting a 10 yo in with adults and them not coming out even more traumatized. That explains a lot. I think she child needs serious help. But I highly doubt this facility is equipped to deal with a child like this. You can find a 10 yog too dangerous to be in society or having murdered another child. BUT they are still a child with very different needs than an adult.

(Someone here locally is dealing with a facility essentially kidnapping their child despite them placing them there voluntarily for depression. Despite going down with multiple police officers the child was still not released. I've seen all the discussion about what the law does and does not allow. But as long as her son is there they can keep charging her insurance for it. She decided to remove him because the facility wasn't updating her at all or letting her talk to a single doctor who was supposed to be dealing with her child.)

Thank you for posting this link. Oddly, I was unable to watch the clip elsewhere but it played in its entirety and beautifully at your link. I highly recommend to anyone following this case that they watch this clip.

As for the mother complaining about where her daughter is being held... this is the same psychiatric facility where the Slender Man Stabbing pair Geyser & Weier have been held from age 12 when they tried to stab to death another 12 year old girl. Geyser still hears voices as of 2017 psychiatric testimony. So the facility does have experience with minor children in spite of the mother's claims.

They're two different things. One is whether someone understands the nature of the charges and can assist in their defense. IIRC in this case they determined she was too young to understand or assist.

However being young doesn't erase criminal culpability. That would be a specific type of insanity such that she either didn't know what she was doing (thought she was squeezing a lemon), or didn't know it was wrong to do.

"The brothers of a girl accused of stomping on the head of a 6-month-old baby at a Wisconsin day care, killing him, miss their sister desperately, their mother says. ...

Her mother spoke out, for the first time, to Inside Edition about what it's been like for the family since the girl's been locked up, saying the arrest has devastated her two young sons.

"They miss snuggles and playing the game Fortnite and coloring and making slime and going to church," said the mom.

Asked what she tells them when they ask after their sister, the mother replied: "It's temporary."

"I have countless nights where I have two little boys in my bed reminiscing and talking about her and how they miss her and they want her to come home," she added...."

Well...what she did was horrid but...seriously...charging a 11 y.o. kid as an adult is too much.
A 11 y.o. can't be treated as an adult....
