"The brothers of a girl accused of stomping on the head of a 6-month-old baby at a Wisconsin day care, killing him, miss their sister desperately, their mother says. ...

Her mother spoke out, for the first time, to Inside Edition about what it's been like for the family since the girl's been locked up, saying the arrest has devastated her two young sons.

"They miss snuggles and playing the game Fortnite and coloring and making slime and going to church," said the mom.

Asked what she tells them when they ask after their sister, the mother replied: "It's temporary."

"I have countless nights where I have two little boys in my bed reminiscing and talking about her and how they miss her and they want her to come home," she added...."

I am very curious why the brothers seem to be living with the parents, but the girl was in foster care.

Right but that all contradicts the statement that’s been made up until like two days ago that the girl was in foster care. Going to daycare 3 days a week is a far cry from foster care. So who’s telling the truth.. mom, or the reporting from day 1?

The judge set up a return date for July 3 to see if the girl has been found competent at that time. The girl will remain in the custody of the Department of Human Services for at least the next year; a prosecuting attorney said it is likely the girl will eventually be committed to deal with her mental health issues.
8/5/19 Update: Prosecutors have now upped the charges against the girl. She was originally charged with reckless homicide, but the charge has now been amended to 1st degree intentional homicide. According to an amended criminal complaint, the final autopsy report concluded there were at least seven distinct impact injuries to the baby’s head. Earlier this year a judge found the girl is not competent to stand trial. Another hearing is set for Sept. 4.
9/4/19 Update: Girl is still considered incompetent to stand trial, keeping the murder case filed against her in limbo. "The defendant is not competent to proceed," prosecuting attorney Richard Dufour told Dunn County Judge James Peterson during a court hearing Wednesday in Chippewa County Court. The state has now filed a fourth criminal complaint in the case, with the most recent filing increasing the charge to first-degree intentional homicide, a Class A felony. The girl will continue to receive quarterly mental health evaluations to see if she becomes competent. Another court hearing was scheduled for Oct. 11. Peterson said he would address at that hearing if she can waive the preliminary hearing, even if she is still not competent.

I still can’t get my head around charging a 10 year old child with 1st degree intentional homicide it is just absolute insanity to me. What on earth are the prosecutors thinking? She needs psychiatric help in a mental health facility not LWOP. Surely there is no way she will be found competent to stand trial?

Thanks for the news! At 10 she's much better off in a facility with other kids instead of adults but IMO the only rational action would be to put her in an environment where she receives intense therapy. It doesn't bode well that she either didn't understand - or didn't care - that stomping on an infant would result in serious harm. She may bot have understood that he could (and did) die but certainly a 10 year old knows it's wrong to attack anyone.

IMO no matter the outcome the girl needs to be closely watched as she matures.

10/11/19 Update: Defense presented a motion to have a guardian ad litem appointed for the purposes of waiving the preliminary hearing and recommending a reverse waiver. They argued the girl’s “capacity to make adequately considered decisions such as whether and how to waive a preliminary hearing is somewhat diminished.” The court accepted that motion. Her case has been moved to juvenile court. Next hearing on 10/21.

Does anyone else find it odd that when they couldn’t deal with her they pushed her off on an unsuspecting, normal day care? Or am I misinterpreting it?

IIRC, the child was placed in a specialized foster home. That home also provided child care at times.

Could be wrong, I get most of my exercise jumping to conclusions.

Not much in the news... the girl had a court date on February 24, 2020 in Juvenile Court. The proceedings are not available to the public.

I found one article about the lawsuit filed by the baby's the parents in December 2019 but that's it:

The defendants are Chippewa County Department of Human Services, its director, Tim Easker, foster care coordinator Serena Schultz and unidentified “Jane Doe” social workers.

The lawsuit contends the defendants didn’t do enough to warn them that the girl was a “dangerous actor” and a threat to vulnerable children. The lawsuit doesn’t indicate any dollar amount the parents are seeking.

At 10 years of age there is ALWAYS a chance of rehabilitation without further recidivism.
Please don’t let this child be tried as an adult and be subjected to adult court policy and process.
I would hate to think that she has no chance to go on and lead a successful life where she can give back, after rehabilitation and support.
I’m not saying that she should be mollycoddled and that we forget about the victim in this case but to try her as an adult with the potential to be locked away for a very long time is barbaric in my view.
We are better than that !

I have to disagree. What you say may be true as long as the 10-year-old isn't a sociopaths. Most of the evidence suggests that sociopaths are born that way. I have no idea whether this girl is a sociopath; that would be a difficult diagnosis for a psychiatrist to make with a 10-year-old (although it might be apparent to people who know the girl well).

I don't think the biological mother is being completely truthful when she says the doctors said her daughter was too young for suicide ideation. Eight year olds have committed suicide. They may not fully realize that death is permanent but they are intent on ending their unhappiness. And if her daughter had exhibited suicidal tendencies why on earth would she be in foster care? Perhaps she was removed as a safety measure toward her other children.

We all like to believe that children, when they commit unspeakable acts, do so out of an ignorance of the actions, like setting puppies on fire or stringing cats up to watch them die, or stomp on babies' head. But we all know there have been children like that who seem immune to empathy and concern for others. We also know that some of those children have been rehabilitated to the extent they do not kill again. Their violent tendencies are managed through positive reinforcement. I don't know about a psychopathic diagnosis, however, one is usually nurture while the other is nature.

This child didn't/doesn't belong in an adult psychiatric unit but she is still a violent offender. A unit dedicated to working with mentally ill children is where she belongs. For as long as it takes.

I can't imagine having a child who relishes hurting other humans and animals. I don't think I would be capable of looking after them. Because part of being a mother is ensuring the safety of her own children by managing threats like stairs, hot stove tops, dangerous medications, aggressive animals, and scary people. You don't expect the scariest person to be your own child.
