Wi. Hearing on Zoom. YIKES. Def. Violates No Contact Order, Mar. 2021

Mar. 5. Livestream of prelim hearing in crim case, assault w intent to cause bodily harm. There was a no-contact order in place. Article & video at link.* Most relevant part at 7:15 to 15 min.

"About seven minutes into the proceeding, ...[Davis, prosecuting atty] said she believed [Mary Lindsey, the complaining witness] and Harris [defendant] were in close proximity during the livestream, based on Lindsey’s answers and body language."
“Your Honor … I have reason to believe that the defendant is in the same apartment as the complaining witness right now, and I am extremely scared for her safety,” Davis said. “The fact that she’s looking off to the side and he’s moving around, I want some confirmation that she is safe before we continue."

Judge asks victim on Zoom where she is. She says home.
What address? Apt on Hatch St.
Judge asks def his location.
Def on Zoom says Lafayette St. address.
Judge asks def to go outside & use phone to show him the house number.
~9:15 mark Def. gives excuse.
LE arrives at victim's apt and sees Def. there on same apt. Whoops.

~ 13:25, Def explains to judge that he & "Mary did not want the no- contact. I asked that it be dropped."
~14:15, judge says: "It's the first time I ever had anybody sitting in the next room potentially intimidating a"
Ignoring his def counsel also on Zoom, def interrupts judge. For the second time, judge advises him to remain quiet. Says bond is cancelled, directs officers to take def into custody on bond violation, reschedules hearing, notes prosecutor may have additional charge for him, obstruction of justice.

In some ways technology improves administration of justice. Other ways, well???

Liars Gonna Lie? So...
Commenter on another website -
- suggested Zoom (and other software makers) for virtual meetings should enable users to ping each other to find their locations, to verify that a participant is telling the truth about their location.
Then another person said -
- Couldn't users digitally trick the location tracking features on their devices to hide their actual physical location?

Is anything simple w internet use?

Maybe like ^ case, a judge can order a participant in Zoom hearing to take phone, tablet, laptop, device to go outside and show house/apt. numbers and street?

Yup, liars gonna lie. Couldn't he have at least split for the Zoom thingies.

O/T but the very beginning of cell phones my nephews would lie like "I'm at the movie". My brother saved leg work by saying "Good go take a few photos inside and outside the theater".

I hope Mary is alright.

In all likelihood, the protective order was against him, so she would not be in violation, only him. It is very common in domestic dispute cases for the couple to get back together, mutually or because one side is very controlling of the other. I think it was clear here that the man wanted to be near her during this hearing so he could control her testimony to the court.

@Philly sbm. In linked Zoom vid clip Mary was in one 'frame' & def. was in a other frame, w each of them sitting in front of a plain wall backdrop. No visual clue that they were in the same place. Judge was pretty clearly at the bench :) (or on the set of Law & Order or crime show:D), and looked imo like most of the others were in office settings.

Or did you mean something else?

Oh no, no, no. Thanks. Honestly I must confess first I had the woman's welfare in mind, BUT and big BUT I can't get that viral lawyers filter "I'm not a cat" out of my head.

Who knows? This world of tech is getting to moi.
