GUILTY WI - Jason Cleereman, shot dead in traffic dispute w/Theodore Edgecomb, Milwaukee, Sep 2020

Yes
I understand the reason behind his words
I listened

His demeanor sounded angry to me
It absolutely could appear different to someone else

That's just my view/thoughts

I agree with post about judge, their are ways to run a court in a respectful and polite manner, their is no need for him to speak to people how he does,

a Judge must have control over her/his court, they must make sure the rules and laws are followed, but they can do this without behaving like this judge, I saw him go off on a defence atty in a motion hearing that was extraordinary IMO

saw the hearing the Judge in this trial is wild, he has just gone on a rant at the defence attorney the like of which I have rarely seen in a court

The judge is speaking so angrily at the defense today that I'm finding it uncomfortable to watch

Seriously unacceptable behavior by this judge!
Snarky, discourteous and impatient.
IMO he is in violation of judicial canons.

SCR CHAPTER 60
CODE OF JUDICIAL CONDUCT
SCR 60.02 A judge shall uphold the integrity and independence of the judiciary.
An independent and honorable judiciary is indispensable to justice in our society. A judge should participate in establishing, maintaining and enforcing high standards of conduct and shall personally observe those standards so that the integrity and independence of the judiciary will be preserved.
[...]
SCR 60.04 A judge shall perform the duties of judicial office impartially and diligently.
(d) A judge shall be patient, dignified and courteous to litigants, jurors, witnesses, lawyers and others with whom the judge deals in an official capacity and shall require similar conduct of lawyers, staff, court officials and others subject to the judge's direction and control. During trials and hearings, a judge shall act so that the judge's attitude, manner or tone toward counsel or witnesses does not prevent the proper presentation of the cause or the ascertainment of the truth.
[...]
The duty to hear all proceedings fairly and with patience is not inconsistent with the duty to dispose promptly of the business of the court. Judges can be efficient and businesslike while being patient and deliberate.

Judge Borowski - bully with anger issues? Not his first rodeo!
I expect the judge will continue his snarky tone during the rest of the Edgecomb trial.
Attorneys must tread lightly in his courtroom:
Judge orders detention of public defender for 'acting like I'm some kind of idiot'

Judge orders detention of public defender for 'acting like I'm some kind of idiot'
OCTOBER 30, 2018
A Wisconsin judge ordered a short detention for an assistant public defender last Friday, saying he was in contempt for “acting like I’m some kind of idiot.”

Judge David Borowski of Milwaukee County ordered the detention of Puck Tsai after the defense lawyer argued against modifying the signature bond for his client, according to the Milwaukee Journal Sentinel, which obtained a transcript of the hearing.
[...]
“Rolling your eyes, throwing your hands in the air, acting like I’m some kind of idiot gets you locked up for contempt,” Borowski said.
[...]
The Wisconsin State Public Defender’s Office released a statement to the newspaper. “The fact that our attorney was taken into custody, handcuffed and belly-chained for doing his job is unacceptable,” the statement said.

“The message this action sends to our attorneys, whose jobs are to be zealous advocates for the rights of their clients, undercuts a basic tenet of our justice system.”

Milwaukee County courts: Defense lawyers call on judge to apologize

Defense lawyers group calls for Milwaukee County judge to admit error, apologize or resign over jailed lawyer
OCT 30, 2018
A group of Wisconsin defense lawyers on Tuesday called for a Milwaukee County judge to resign if he won't admit he erred in detaining a lawyer for contempt and apologize.
"Judges should never jail attorneys or litigants appearing before them because the judge is having a bad day," reads a news release from the Wisconsin Association of Criminal Defense Lawyers.

Borowski Vacates Contempt Order, Recuses Himself
Judge backs off from case where he had defense attorney handcuffed and imprisoned.

Defendant took the stand today and got destroyed by the prosecution. Plus, they have said throughout the trial that he got hit by the Cleermans car and today he slipped and said almost got hit. Oops.

The widow ran to her husband after he was shot and took his wallet because she couldn't hold him and wanted something to hold?? What the heck??? I need to watch her testimony. I haven't found video of the defendant hitting the "victim" through the car window, but I thought I read there were two videos. Should I stop looking for that video?

There is only one video of him punching Cleerman. You can see it here at about 1:08

I actually watched the whole trial. The defendant testifying was very captivating.
IMO Edgecomb did goof by stating the gun accidentally went off vs his claim of self defense.
I understand that people assumed it was a race incident but it wasn't proven to me. It just overall sad case that didn't need to happen.

I agree. I'm not sure I 100% believed the wife's testimony, but I think it was a fair verdict.
