Man admits manslaughter of Billy Harty but denies murder

The accused, Martin Casey, offered an alternative plea of guilty to manslaughter that was not accepted by the prosecution

A man has today pleaded not guilty to the murder of 28-year-old Billy Harty, who was found seriously injured in a street in Leicester's Mowmacre Hill. Martin Casey, 30, appeared at the city's crown court this morning.

Casey, of Golf Course Lane, off Hinckley Road, Braunstone, instead pleaded guilty to manslaughter. However, that was not accepted by the Crown, and the judge adjourned the case for a murder trial.

The defendant appeared in the dock wearing a light grey tracksuit with matching navy stripe details on the shoulders and legs for the eight minute plea and trial preparation hearing. Mr Harty was found with serious head injuries in Bedale Drive in the early hours of Monday, October 25, and died in hospital later the same day.

Leicester's senior resident judge, Timothy Spencer QC, told the defendant: "You will stand your trial on Tuesday, May 3. You understand how serious this allegation is?" "Yes," replied Casey.

Judge Spencer added: "You've pleaded guilty to manslaughter, and whatever the jury's decision you will be sentenced for some sort of homicide and the sentence will be a serious one, do you understand?" Casey replied, "Yes", and said, "Thank you", before being escorted from the dock. He was remanded back into custody.
