Gabby Petito funeral set for Sunday on LI; will be open to the public (nypost.com)
Gabby Petito’s body was cremated ahead of her funeral, which is scheduled for Sunday on Long Island.

The service for the 22-year-old Blue Point native will be held at Moloney’s Funeral Home in Holbrook. It will be open to the public from noon to 5 p.m., according to a statement from Richard Stafford, a lawyer for the Petito family.

Her father, Joseph Petito, also shared the arrangements on Twitter, adding, “Thanks to all for your support and love,” with a photo of the blonde, blue-eye Gabby with stars across her face.

Petito’s body was set to be cremated in Wyoming before she was brought back to New York, The Sun reported.

Florida statute may work to advantage of Brian Laundrie's parents

So far, Laundrie’s parents have not been charged with any crime, and experts say that could be a tall order under Florida law.

Per Florida Statute 777.03, a person commits a felony offense when they assist an individual to evade detection, arrest, trial or punishment after the fact. Relatives of the offender, however, are largely protected from being accessories. This would include the parents of Brian Laundrie, who now has a federal warrant out for his arrest for allegedly committing bank card fraud.

Harvard law professor emeritus Alan Dershowitz told Fox News that many states have similar statutes because "there are a lot of people who think that parents' obligation to children comes first."

"For example, a woman or a man have a right not to testify against their spouse," Dershowitz said. "Now generally, that doesn’t apply to mother and child or father and child, but there are some people who think it should."

However, attorney Cory Baird told WESH-TV that while the parents are protected from any charges stemming from how they may have helped their son, "if they made misleading statements or lied to officers, obviously that’s a crime in Florida, and they’re not protected from that."

Baird said any such effort, if there were one, made by the parents to help their son could be a federal crime.

"Where you’re aware of a crime and you do your best to cover it up, or you don’t report it — that could be a federal crime in and of itself," he said.

Dershowitz cautioned against drawing any conclusions about Laundrie’s parents.

The new arrest warrant corrects a minor yet critical error in the original warrant issued two days earlier. The little-noticed error caused confusion among close observers, however, since the original warrant accused Laundrie of committing a crime he ultimately was not accused of committing by a federal grand jury.

To be clear, a grand jury indicted Landrie on one single count for allegedly violating 18 U.S.C. § 1029(a)(2). That statute makes it a crime to use an “unauthorized access device” (e.g., a debit card) and to “obtain[] anything of value aggregating $1,000 or more.” More precisely, the indictment accuses Laundrie of using a Capitol One debit card and its requisite PIN to access more than $1,000 between the dates of Aug. 30 and Sept. 1. The indictment says the alleged debits occurred “in the District of Wyoming and elsewhere.”

If found, tried, and convicted, Laundrie faces a possible ten-year prison sentence and a fine of up to $250,000 in connection with his current single-count federal indictment in Wyoming.

NG was one of many mourners to stop and a message or flowers for the growing memorial. The Portland woman, who knew Petito all her life, was supposed to play host to the traveling couple once they finished their cross-country trip around Halloween.

"Of course the thing that will haunt me forever was that I never had a suspicion about Brian, not a clue. She seemed so happy," NG said.

TV personality Duane Lee Chapman, better known as Dog the Bounty Hunter, is reportedly now helping in the search to locate Brian Laundrie.

FOX News confirmed that Chapman and his wife Francie are currently at Florida’s Carlton Reserve, where Laundrie, who has been missing since last Tuesday, was last seen.

“Dog and Francie have experienced extreme loss themselves,” the bounty hunter’s team said in statement released to FOX News. “Their hearts go out to Gabby’s family for what they’re going through and want to help bring justice for her death.”
