Anger Builds In Case Of N.C. Girl's Death

Posted: 1:33 AM Nov 20, 2010

After a disabled 10-year-old girl went missing in this small city in the foothills of the Blue Ridge Mountains, her family's former home became an impromptu memorial piled with stuffed animals and birthday cards.

Now it sits with its front windows smashed by vandals, while frustrated residents complain that the investigation into her death is taking too long, even as increasingly bizarre and potentially damning revelations about Zahra Baker's stepmother and father pile up.

The case has riveted followers in North Carolina and Australia, where she was born and where her biological mother still lives. She was reported missing on Oct. 9 and last week police confirmed everyone's worst fears: A bone from her body and other suspected remains were found in two remote spots.

Baker asked the court to appoint his attorney, Mark Killian, to represent him on his Catawba County charges.

Killian was assigned to Baker’s case as provisional council on Oct. 28 by North Carolina’s Indigent Defense Services Director and Capital Defender Robert M. Hurley.

Though Baker has not been charged with Zahra’s murder, the case has gained worldwide attention and Killian was assigned the case in the likelihood that Baker will eventually be charged with the crime.

Hurley provisionally assigned Killian to Baker’s case 10 days after he assigned Lisa Dubs to represent Baker’s wife, Elisa Baker, although neither has been charged in Zahra’s death.

Baker was required to fill out an affidavit at the Catawba County Clerk of Court's Office to certify he can't afford to hire a lawyer. According to the affidavit of indigency Baker filled out, he has no monthly income.

He listed no money coming in from employment, welfare, Social Security or his spouse's employment.

Baker has $80 in total assets and liabilities, and he didn't list any other personal assets on the affidavit, which can include vehicles and real estate.

Baker listed his current address as an apartment in Hudson.

Elisa Baker's attorneys visit Hickory home, memorial removed

HICKORY, NC (WBTV) - Attorneys for Elisa Baker were at her former in Hickory home Saturday.

There, they gathered the last of her belongings.

Also Saturday, the front yard memorial, including toys and cards people placed around the tree, is gone.

The tree was cut down, too.

It became a landmark in Hickory.

The property owner says it was time to take down after the home got vandalized last week.

Homeowner says he may bulldoze the house

“Saturday, Coffey was heard telling a small group of people at the house that he is considering bulldozing it. He said repairing the house would not be cost-effective because Hickory police did an estimated $30,000 in damage to the 900-square-foot house when they removed sections of the walls during their search for evidence of what happened to Zahra”.

“He added that he is angry with Hickory police for refusing to post a guard at the property, and he told those gathered at the house that they were in danger, because whoever broke the home’s windows could come back.”

"Coffey is the subject of a new note. This one is written on a piece of heart shaped corrugated cardboard and posted on a stake in front of the Bakers’ former house. It says, “To the home owner, Zahra’s dad and stepmom took away her hopes and dreams. And now you have taken away her memorial from her. Shame on you.”

We can love Zahra without that house

Snip;

"We cannot expect Mark Coffey to maintain the house where Adam and Elisa Baker lived — and the shrine to Zahra Baker — forever.

Coffey, Adam Baker’s former employer, rented the house in northwest Hickory to Baker.

We still do not know for sure if Zahra ever lived there. The details of her last days and death have not been divulged."

Hickory Cops for Tots getting boost from Zahra Memorial

Snipped:

"The owner of the property thought it was time to close the memorial, especially after vandals broke windows in the home and people had been seen wandering around the back yard.

Instead of throwing the items away, everything that was in good shape was taken to the Hickory police Department where it all has been donated to the Cops for Tots program. The program helps needy children in Catawba County every Christmas season."

"Investigators plan to take Thanksgiving Holiday as a needed break from the case. Officials say they are hoping everyone comes back from the long weekend rested and with more ideas on how to proceed.

Investigators say a lot of progress has been made but there is much more to do before any charges would be considered and filed against anyone. "

Gaither says he has no plans to schedule Baker bond hearing

No date has been set for a bond reduction hearing for Elisa Baker.

Attorneys Scott Reilly and Lisa Dubs filed a motion last week seeking a reduction in Elisa’s bond on an obstruction of justice charge. Her bond on the charge, stemming from a fake ransom note she wrote in regard to the disappearance of her stepdaughter Zahra Baker, is $65,000, an amount her attorneys argue is too high for the charge.
