An opportunity for DSS to step up

"Over the last several weeks as we’ve searched for answers in the Zahra Baker tragedy, lots of questions have been asked of the Department of Social Services.

After numerous reports from family and friends who said they had seen Zahra verbally abused, slapped and punished by her stepmother Elisa Baker, we all have asked why didn’t DSS intervene, and possibly rescue the 10-year-old girl from her eventual fate.

When Zahra went to school with a black eye, school officials called DSS, according to neighbor Bobby Green of Hudson.

Another neighbor in the same trailer park where Green lives, Corrine Yount, said she could hear Zahra screaming and Elisa yelling at her. “We called DSS on her, too, but they never did anything.”

Did judge overstep in the Zahra Baker case?

Gaither says Poovey had no right to release warrants.

In his order releasing the warrants, Poovey wrote that the public has the right to know what's in them. The district attorney argued that releasing the warrants could jeopardize the case by undermining an ongoing investigation and denying a fair trial to anyone who may be charged in Zahra's death.

But the issue at hand is not whether the information in the warrants should be public or whether their release would mean that the person who killed Zahra could avoid prosecution.

The issue is whether Poovey overstepped his authority when he released the warrants in contradiction to signed orders from four other Superior Court judges.

Grand Jury might not discuss Zahra case Tuesday

CATAWBA COUNTY, N.C. — The Catawba County Grand Jury meets Tuesday, but there is no indication the panel will discuss the Zahra Baker case.

Zahra Baker, 10, disappeared last September. Dismembered remains were found in multiple locations two months later. Investigators turned their case summary over to District Attorney Jay Gaither in December.

Gaither indicated to News 14 Carolina he will wait for the full case before taking it to the Grand Jury.

CALDWELL COUNTY, NC (WBTV) – WBTV has learned that a briefcase has been found that may contain evidence relating to the disappearance of Zahra Baker.

The briefcase was found on Christie Road in Caldwell County Tuesday morning.

Baker is the 10-year-old girl whose remains were found scattered in two locations in Caldwell County last fall. Officials said her body had been dismembered.

A source said the contents found this morning appeared to be bloody clothing.

The briefcase was found deep in the woods beyond the area that had been searched by investigators in November.

The items will be sent to the SBI lab in Raleigh to be analyzed. Only then will they know if the items relate to the case at all.

Elisa and Adam Baker were married in Australia in July 2008. Adam Baker’s daughter, Zahra, was reported missing in October. The 10-year-old girl’s body was dismembered and her remains were discarded.

Court documents obtained by the Observer show Elisa and her former husband of 10 years, Aaron Young, separated in May 2008 and divorced in August 2009 – more than a year after Elisa and Adam Baker’s marriage."

Loggers find items related to Zahra Baker case

CALDWELL COUNTY, N.C. -- Loggers working in Caldwell County Tuesday found a briefcase containing items related to the Zahra Baker case.

The briefcase contained what appeared to be a blanket or clothing related to the 10-year-old who was reported missing in October 2010.

The briefcase was found off Christie Road, which is where investigators found Zahra's prosthetic leg on Oct. 26.

Elisa Baker indicted for bigamy
Felony charge carries 1-year maximum sentence

According to state law, if the Bakers’ marriage is a legal union, Adam would be allowed to testify against Elisa about conversations the pair may have had about his daughter’s death and dismemberment, but he could not be compelled to do so.

If the marriage is invalid because Elisa committed bigamy, the marital privilege law does not apply.

"If Elisa Baker had anything to do with the death of poor Zahra, then what kind of protector was the “innocent until proven guilty” father, Adam Baker.

“There's no way I would do that to my baby,” Adam Baker told WBTV. “There's no way in the world I would hurt my daughter.”

My anxious mind and heart enter each new year of my daughters’ lives with the knowledge that I’m supposed to know more than them. I’m supposed to have them engulfed in safety, inside or outside the walls of my home. The world’s become a scary place. It’s no longer the “Leave It To Beaver” world of the 1950s and 60s for today’s children.

Zahra Baker should be living like a kid, enjoying new experiences that come with each new day of the new year. But a family and community in the North Carolina mountains rang in 2011 with one less loved one.

"I read in Sunday’s paper with disappointment about the disagreement over the authority for warrants being released in the tragic Zahra Baker case.

My disappointment lies in the fact that instead of someone being brought to trial for this horrible tragedy, there is now wrangling about the “legality” on the public release of the warrants. I suppose the wheels of justice in this case will be made even slower now because “someone may have or supposedly overstepped their bounds of authority in reference to the warrants’ release.”

What about the case itself? When is justice ever going to be served? Why has no one been arrested and brought to trial for the death of this little girl? "

Work begins on Zahra memorial


CALDWELL COUNTY,NC (WBTV) – Ground was broken Thursday for a permanent memorial to Zahra Baker, the ten year old girl who was reported missing from Hickory in October, then found dismembered in Caldwell County.

A makeshift memorial has been at the spot on Christie Road in Caldwell County ever since the victim's prosthetic leg and a bone were found nearby.

"This concrete memorial will be something for people to visit for a long time, " said landowner Jake Icenhour.

"It will be here as long as I'm alive, I can assure you of that."

Icenhour and several others were building forms for the concrete that will be poured at the site in the next week or two.
