NEWTON, NC (WBTV) - The woman indicted last month in the death and dismemberment of Zahra Baker was scheduled to appear in court Tuesday morning on obstruction of justice and bigamy charges, but the charges were continued to future dates.

Autopsy doesn't show Zahra's cause of death
N.C. chief medical examiner: Doctors are convinced she was killed.

CHAPEL HILL An autopsy didn't show the N.C. medical examiner's office exactly how 10-year-old Zahra Baker died.

But evidence from the whole investigation convinced doctors that the child was killed and her death should be called a homicide, said N.C. chief medical examiner Deborah Radisch.

Last month, Radisch's office ruled that Zahra died as a result of "undetermined homicidal violence," a finding that's rarely called for in North Carolina and other states. She talked about the ruling for the first time in an interview this week, though Radisch would not discuss details of the Hickory girl's death or the investigation.

"Undetermined homicidal violence" is used in cases in which the physical autopsy can't determine a cause of death, Radisch said, "yet the circumstances surrounding the case and the finding of the body and the condition of the body would indicate the manner of death is a homicide."

The ruling can pose problems for prosecutors, because the exact cause of death isn't known. But last summer, the Wake County district attorney's office successfully prosecuted Sherita McNeil in the first-degree murder of her 19-month-old son, even though the state medical examiner's office found the same cause of death in that case.

Elisa Baker’s Attorney Wants Case Moved Out Of Area

Baker’s attorney, Scott Reilly, said he plans to seek changes of venue for the felony cases.

“I can't imagine her getting a fair trial in this area, and I can't think of an area around here where she could get a fair trial,” Reilly said.

He said when Elisa Baker gets her day in court, it should be far away from the county where she's accused of killing and dismembering her stepdaughter. He said he thinks the other felony cases should be moved, too.

“I don't see any way around it, because she's entitled to a fair trial no matter how big or how small,” Reilly said.

Baker, 42, the stepmother of Zahra Baker, was indicted on two counts of obtaining property by false pretense. According to the indictment, Baker went to Hickory Pawn and Gun on Aug. 18, 2010, and pawned a 46-inch TV for $200 — something she didn’t own. The warrant states Baker, “knew she was not entitled to the money because she did not own the television and did not have the authority to pawn it.”

The second indictment states Baker returned to the store, which is on U.S. 70, SW, on Sept. 7. This is just 17 days before investigators believe Zahra died. Baker has been charged with second-degree murder in Zahra’s death.

Riding in Zahra's memory
The Angel Wings Zahra Baker Memorial Ride will be held on April 16.

“I wanted something positive to come out of this,” Boyce said. “I looked at my husband and said, ‘we’re going to do a ride.’”

A biker herself, Boyce now lives in Conover with her husband. She has been planning the Angel Wings Zahra Baker Memorial Ride since she first got the idea in December. Since then, Boyce said the event has taken on a life of its own.

“It’s more than just a ride,” she said. “It’s not a poker run, it’s a memorial ride, touching on all the places this child lived without touching on the negative.”

Zahra Baker's stepmother nearly faints in court

Baker's attorney poured her a cup of water and court bailiffs helped her to a seat. It was unclear what the problem was.

When the hearing resumed, Superior Court Judge Eric Levinson denied the Catawba prosecutor’s attempt to set her obstruction trial for May.

Instead, the delayed hearings on both the obstruction and second-degree murder charges against Baker until June 27

Elisa Baker appears frail as judge sets new court hearing date
On Monday, Baker appeared in court and she was extremely frail. At one point, she was shaking so bad, she had to sit down. She was given some water to drink.

The state asked the judge to set a trial date in May for the obstruction of justice charge, but the prosecution's request was denied.

Meanwhile, the defense said they have not had enough time to prepare. The defense requested having both charges against Baker to be tried at the same time.

Adam Baker Wants To Return To Australia

HICKORY, N.C. -- Adam Baker, the father of 10-year-old Zahra Baker, told Channel 9 on Monday that he wants to go back to Australia.

Before Baker could return, though, he must get his passport back from Hickory police. He turned it over to investigators while they were searching for Zahra, who was reported missing last October. Her remains were found in Caldwell County in November.
