I just had a thought: Maybe The Fifth does not apply the same way in a Civil case as it does in a criminal case? This could be why Zaneida's lawyers may be able to force her to talk. Its just not the same situation or set of rules.

Remember Oj's civil trial? It was a totally different ball game from his criminal trial. He had to take the stand and talk for days.

She can still take the 5th, whether in a criminal or civil case, on anything relating to the lying convictions until her appeal (and any retrial) is over. OJ didn't have any convictions or appeal--that's the difference.

From what you said in the lawyer thread, I'm wondering about something. You indicated that there's not yet anything that we've seen in the couple of videos that are out about Caylee or ZG. So if there was something about Caylee or ZG in another recording or video, that would affect her 5th amendments rights, correct? Unless it was purely therapeutic? I wonder if this is what has her lawyers so nervous. Part of me hopes she was stupid enough to talk about the ZG case or what happened to Caylee in later videos or recordings, and maybe that is why Morgan wants them. I am certain of very few things, but I am certain no Anthony can keep their mouth shut, and FCA cannot exist without a mirror (boyfriend or other) to play to.

I agree it is a good question for attorney's but I don't understand how this in anyway can make FCA compelled to testify against herself. Maybe I am missing something.

I can see how they might use this to get the previous deposition out in the open but that's about it.

ETA: Now that I think about it, that could be what they are after. Always ask for more than you expect to get.......????

I agree. I do not see yet how the release of the videos shows KC has waived her 5th Amendment rights. I thought the reason she pleaded the 5th was to not incriminate herself because she has an open appeal on lying convictions...some of which have to do with lies about ZG. How would her not being in hiding anymore take away her 5th Amendment rights? I can see this as an issue to get the depo released (the one where she was in disguise) because I believe it was sealed for her safey concerns, but if she is out of hiding those concerns are moot.

I see two issues: One is her right to not answer questions related to issues involved in her appeal and two, the fact that she seems to be no longer in hiding.
