MINUTE ENTRY

The Court has received Defendant Jodi Arias’ Motion to Strike filed October 26, 2015;
the State’s Response filed November 6, 2015; and Defendant’s Reply filed November 10, 2015.

Oral argument was not requested.

The Court notes that Defendant filed a Motion to Enforce Protective Order with the Arizona Court of Appeals on October 26, 2015. According to the website entry dated December 3, 2015, the Court of Appeals denied the motion. Because Defendant has raised the argument that the Superior Court lacks jurisdiction to enter an order unsealing a minute entry, this Court waited to address the instant motion in an abundance of caution. This Court will treat the Court of Appeals’ ruling as a rejection of that argument..
No good cause appearing,

IT IS ORDERED denying Defendant’s Motion to Strike. :denied:

Dutchess County to Pay Brooklyn Native $7.5 Million for Wrongful Murder Conviction

"The prize for this fight will be $7.5 million, but Dewey Bozella did not win it in a boxing ring.

In 2009, a State Supreme Court judge found that the Brooklyn-born Mr. Bozella had been wrongfully convicted of the murder in 1977 of a 92-year-old woman in Poughkeepsie, N.Y.

During his 26 years in prison Mr. Bozella sharpened his boxing skills, became the light heavyweight champion of Sing Sing and, after his release, won his only professional match in Los Angeles, at age 52..."

Dewey Bozella

"...In 1977, 92-year-old Emma Crapser was murdered in her Poughkeepsie, New York apartment. Police alleged that Crapser walked in on a burglary that was being committed by a then 18-year-old Bozella, who then killed her. In 1983, Bozella was convicted of murder and sentenced to 20 years to life in prison. He continued to claim he was innocent and refused to admit to the crimes he was alleged to have committed, even when in front of the parole board, who denied him parole on four occasions. Bozella contacted the Innocence Project, who agreed to examine his case. When the Innocence Project discovered that there was no DNA evidence remaining to be tested, they referred the case to WilmerHale. Lawyers at WilmerHale discovered new evidence that had been suppressed by prosecutors showing Bozella was in fact innocent and had been framed. Supreme Court Justice James Rooney of Putnam County agreed that the Dutchess County District Attorney had failed to disclose crucial evidence which would have proved Bozella's innocence.[1][4][5] On October 28, 2009, Bozella was finally released from prison after serving 26 years..."

THE SHOOTING GALLERY (warning- some graphic pics)

"In the solitary unit at High Desert State Prison in Nevada, the guards usually follow a simple practice: Never let two inmates out of their cells at once, because you never know what might go wrong. The prison is a massive complex less than an hour from Las Vegas, surrounded by electric fences with razor ribbon and then miles of brush and gravel. In “the hole,” as the solitary unit is known, inmates are isolated for around 23 hours a day—sometimes because they’re being punished, sometimes for their own protection. One evening last November, a 38-year-old corrections officer named Jeff Castro was supervising prisoners as they took turns in the shower cage when two inmates were released into the corridor at the same time..."

WASHINGTON MAN FACES RARE PROSECUTION FOR ONLINE THREATS AGAINST PLANNED PARENTHOOD PARTNER COMPANY

"A Washington man has been charged and is facing rare prosecution for online comments he is alleged to have made, which threatened executives of a California biotech company that processed fetal tissue from Planned Parenthood.

Scott A. Orton, 57, has an extensive record of online intimidation dating back to at least 2009, according to The Guardian. His targets have ranged from fellow commenters to local journalists and city council members to FBI agents. In July, he focused on the executives of StemExpress—a former Planned Parenthood Federation of America (PPFA) partner that provides human specimens to biomedical researchers...

“The world is changing,” he says. “Given the frequency with which these threats can ultimately become a reality…at what point do we say you did or you didn’t have the intent?”

“I think you’re going to see a lot more of this prosecution than you’ve seen before,” he adds.

Orton is next scheduled to appear in court on December 29"

Enemy within: Yemeni with U.S. citizenship plotted to shoot American soldiers and tried to recruit militants to fight for ISIS from his New York pizza shop

"Mufid Elfgeeh, 31, helped arrange travel and funding for ISIS recruits

Yemen-born U.S. citizen put one in touch with an Islamist terrorist in Iraq

He used Twitter, WhatsApp and 23 Facebook accounts to declare jihad

Elfgeeh bought two handguns and silencers that he planned to use to kill returning U.S. soldiers

He purchased a laptop and camera for two FBI agents posing as recruits, as well as paying for a birth certificate and an expedited passport
Pizza shop owner in Rochester, New York, admitted two terror offences...

Elfgeeh pleaded guilty in federal court to two counts of attempting to provide material support to ISIS in a plea agreement that recommends a sentence of just under 22-and-a-half years in prison.

We May Resurrect The Mammoth Sooner Than You Think

The animals could play a key role in slowing climate change.

"Of all the varied and incredible possibilities presented by the controversial new gene-editing technique known as CRISPR-Cas9, perhaps the most intriguing are efforts to bring animals back from extinction. Candidates for de-extinction, as the process is known, include species like the passenger pigeon (the last one died in captivity in 1914), the dodo (last seen in 1662) and the sea cow (1768, a mere 27 years after it had been discovered by Europeans.)

Microsoft’s new Windows 10 upgrade options: ‘Upgrade now’ or ‘Upgrade tonight’ (with clip)

"Ever since Microsoft launched Windows 10 over the summer, Windows 7 and Windows 8.1 users have been pressured to upgrade to the latest version of the operating system. It was relatively innocuous at first, but as months have passed, Microsoft has become increasingly obnoxious. The notifications were all but unavoidable, and now things have truly come to a head...

After bugging users incessantly, forcing them to download 3-5GB files in the background without their knowledge and even going so far as to launch the upgrade service “accidentally” on some computers, Microsoft is now resorting to the same tactics used by spammers and malware creators to push their software.

You can dismiss the message by clicking the “X” button in the top-right corner of the window, but it’s clear that Microsoft is intent on wearing down users until they’d rather upgrade than deal with the notifications..."

Updategate: Microsoft is about to make it even harder to opt out of Windows 10
Soon you'll have to actively stop it

"MICROSOFT HAS FINALLY admitted that it intends to enforce an automatic download of Windows 10 on customers, who can then choose to opt out of installing it. Lucky them...

After a recent spate of reports that customers were getting Windows 10 installed without even being asked, it now appears that this was a practice run for something official...

"Early next year, we expect to be re-categorising Windows 10 as a 'Recommended Update'. Depending on your Windows Update settings, this may cause the upgrade process to automatically initiate on your device.

"Before the upgrade changes the OS of your device, you will be clearly prompted to choose whether or not to continue. And, of course, if you choose to upgrade (our recommendation!) you will have 31 days to roll back to your previous Windows version if you don’t love it."

In other words, from next year your Windows installation will nag you to upgrade to Windows 10, pointing out that it has downloaded the files and it's all ready to go.
Customers on metered connections such as mobile broadband will be able to opt out of this process, a feature that has always been available but that Microsoft has failed to publicise thus far.

We originally broke the story in September that Microsoft is downloading images of Windows 10 to computers whose owners hadn't opted for the upgrade, in some cases taking up 6GB of the hard drive...."

'Free' Windows 10 Has An Expensive Secret

"Do you know what’s the single biggest driver in Windows 10 adoption? That it is Free. Truly, completely, 100% free as long as you own a genuine copy of Windows 7 or Windows 8 Home or Professional. Do you know what’s the second biggest driver of Windows 10 adoption? That it won’t be free after its one year anniversary on July 28th 2016 – so the message is you must be quick.

Except I’m willing to bet Microsoft is pulling a fast one and the whole ‘it’ll get expensive’ argument is a myth. Here’s why…

Hi to everyone! I am finally starting to feel stronger. I went to Gastro Dr. today.he is asking my insurance for permission to receive iron by IV.. this ,
he said will speed up the hemoglobin in my blood. Whites are ok. if they allow it , I will go too the cancer hospital (part of my reg. hospital) for the transfusions. He doesn't rule out removing 13 "of my colon~yes its that bad. Concern is with my breathing..altho' there is a huge change in it since blood transfusions. for the better. I have missed the board so much! there were times I was way too tired
to even sit up. feels good to be back. now I need a good trial to take my mind off blood! wrapped gifts in case I wind up out of here! My first car was a Ford Custom 500, '67 ..Last was a Plymouth Neon '96.. loved it. I never owned a foreign car..had good luck with all we owned, many Chrysler products. Oh II miss my car! My sis in law took me today as Amy had to work. We stopped at Arbys for lunch. felt so good to get out. I hope all are doing well. Niner, prayers for your huz...take care..gramma:HHJP:

:therethere: Please get well gramma and rest up. :blowkiss:

I'll be praying for you, my dear.

This has been the most terrible week we have had in a long time...if getting your car stolen and burned, 2 deaths in the family, I'm fighting off a cold, my sweet friend Nore is facing health issues, Squeakers has decided go through the 'terrible twos' and is teething; he chews and eats anything NOT nailed down and topping it off for the week... Lizzy had emergency surgery Thursday night, poor baby. She is doing fine now, but what a scare we had!

Thursday we went SIL grandmothers funeral, Lizzy was whinny and not feeling good, saying that her ear and head hurt. She got so fussy we left the services and took her home with us. Thinking she had an earache and catching a cold, I gave her kids tylenol and put a warm cloth on her ear. That didn't help, she kept crying more and more and started screaming, I checked her out and blood was coming out of her ear. I knew this was not right. We bundled her up and took her the ER and called her mom at the funeral home. She has tubes in her ears and the right tube had started pushing its way out, but got stuck in ear wax and turned crooked and was tearing her skin off insde her ear. ER called her ear dr and he told them try and take it out. Didn't work and she was screaming something terrible. Ear Dr came in and he could not get it out, so off surgrey she went. While she was in surgery the checked the other ear tube, making sure everything was ok in that ear and cleaned the ear wax out. I have never heard of that happening before when the tubes came out!! She spent the night at the hospital and was released yesterday afternoon. Never want to go through that again!!

Besides all the above...I have never been so far behind in my Christmas baking and candy making....Wonder if I'll ever catch up? I haven't even started!

Niner, praying for your DH and prayers for you, Nore and anyone else who needs prayers for healing or strength get you through.

OMG Coffee- I think you've had enough bad luck this past week. :(

Coffeej.

Here is a link showing the "Bitter Apple Spray" product that is supposed to be able to spray on things to keep dogs from chewing on them.

It didn't work very well for me when I tried it because my dog took a liking to it. LOL
But some reviews from others said it worked for them so I guess its hit or miss.

Most dog stores like Petco would carry this or you could get it online somewhere I bet.

Its supposed to be safe ingredients for the pet, and the good thing is it can be used on lots of things that they would chew on. Furniture, etc. But just be careful if putting on nice furniture in case it may stain it or something. If you are worried about it ruining a particular surface, you could always test it out in a small area first.

The good thing about it is it can also be used if the dog has a sore that he is licking on but be VERY Careful to not spray directly in the sore. You would want to put it NEAR the sore but not directly IN the sore. Because you don't want it to burn or irritate the sore. Since its a spray and if using for sores I would recommend spraying it on a damp washcloth and then dabbing it NEAR the sore. That way you can avoid getting any in the sore.

Anyway just wanted to mention it in case you had never heard of this product that is supposed to keep dogs from chewing on things.

I wanted to add my .02 cents on teething dogs and chewing. I had dog trainers for my 2 German Shepherds, who worked with me from day 1. I learned a lot from them that I never knew before. Cesar Milan has used their dogs when he came to the area for his shows as they are so well trained.

They suggested bones and bully sticks for them to chew. Anything else was off limits and whatever they were chewing was taken away with a firm "No". I also use the "biz" sound from the commercial with a sharp one syllable sound like "et". Commands should be one to two syllables like No, Come, Bring it, Give, Sit etc.

One of the most effective things I learned was the claw. You bend your fingers into a claw and use that on their chest, back, side when saying No. It mimics their mother or other dog reprimanding them. Shhhhht like Cesar says also works for me.

I taught them not to use their teeth when taking things from my hand by using their lips with cheese. They are very gentle and careful and do not place their teeth anywhere on anyone.

Dog training is a continual work in progress. It helps if everyone in the house is on the same page and uses the same commands. My husband and children are still in training on that one. Hope some of this helps as I couldn't believe how much I didn't know about dog behavior and training before.

Good morning to all. Hope your day is a good one.

Kirk Nurmi debuts on KJR To Discuss his New Book & Jodi Arias Trial 12-17 9:30es

Call in to speak with the host (347) 857-2950

http://www.blogtalkradio.com/kingjo...uss-his-new-book-jodi-arias-trial-12-17-930es
--------------------------------------------------------------------------------------------------

Some defense attorney's take on Laurence's book:

Kirk Nurmi’s Roll In The Jodi Arias Mud

"How cool is it that a lawyer can write a tell-all book after his involvement in a huge, high-profile case? Not cool at all, actually. Not that Kirk Nurmi wasn’t rip-roaring to go about how much he hated representing Jodi Arias, how horrible, inappropriate and twisted she was. Was it all that anger that needed to get out? Was it that he wanted to parlay an unpleasant experience into turning himself into a big name? Was it for the money?

Who knows, but in the process, Kirk Nurmi did what a lawyer cannot do. He violated confidentiality...

It doesn’t matter how awful, how horrible, how inappropriate your client was or is. It’s not your story to tell. Kirk Nurmi is a disgrace for having done so. He should be disbarred and the book should be pulled from the shelves and destroyed. A criminal defense lawyer is not entitled to give up his client’s confidences no matter what, and it is an intolerable affront to the profession that Nurmi has done so. There is never an excuse to trash a client, no matter how bad she is. Never."

--

A Disgrace

It appears that at some point the fame finally got to L. Kirk Nurmi, former lawyer for celebrity capital defendant Jodi Arias. After he came out with a tell-all book about representing his famous client called “Trapped with Ms. Arias,” the equivalent of wiping his *advertiser censored* with ER 1.6, Scott Greenfield at Simple Justice got right to the root of the problem:...

I want to feel bad Nurmi, but I just can’t. Even though he apparently has cancer, there’s no serious illness exception to our duty to our clients. If he was on his death bed with the best client story ever, that still doesn’t change a thing. He’s very clearly not in the right field, as a good defense attorney simply doesn’t do the sort of thing he’s doing.

If it’s fame he wants, he should move to LA and wait tables until he gets discovered. Furthering his own agenda at the expense of a client is as unforgivable a crime as a defense attorney can commit."

And from one of the murderer's supporters:

RAISING THE BAR – BUT CERTAINLY NOT IN ARIZONA

"...This is an excerpt from the book Jodi Arias’ defense (and I use the term loosely) attorney wrote, possibly on the back of toilet paper, after he was released from a case he did not win or even remotely tried with professionalism, competence or common sense. I would imagine that this pathetic attempt at redeeming his image or boost his legal career, might eventually cost him more than he bargained for.

I do not know what is in the water in Arizona, but the prosecutor working the same case is also publishing a book, probably available during the Holidays and so handy to offer as the gift that keeps on giving for those eager to spew hatred..."

And this, about JM's book:

PRESS RELEASE

"..." . . . the fact that she was using some of her final words to the judge to attack me, rather than take responsibility, spoke volumes about Arias and her character. This was the vengeful woman who had killed Travis, the woman with whom I had sparred for days on the witness stand, this was the woman I'd convicted of first degree murder." – Juan Martinez, author of CONVICTION: The Untold Story of Putting Jodi Arias Behind Bars...

I listened to Nurmi speak on King Jordan's radio show for the hour and a half. Audio Portions of the trial were played consisting of Martinez questioning ALV and Dr. Samuels. I had forgotten how aggressive sounding Martinez was when he was annoyed lol.

They had some people call in with questions too. Nurmi couldn't answer the ones most of us have questions for because of attorney-client privilege. He also wouldn't answer questions that would be addressed in his next book. He would not say that CMJA is evil as that would be unethical. Some of the questions asked were confusing, not only to me, but to them as well.

Nurmi said he was most proud of a case where a young man was falsely accused of rape. It was proven at trial that the young woman accused the young man so that her strict religious parents would not get angry at her. The jury found the young man not guilty and he was exonerated. I liked hearing that as it gave Nurmi another dimension I had not thought about.

Nurmi said he was 2 chemo treatments away from being cancer free. He went public so that people could say if he could do it so could they. One woman called in and asked a question he could not answer, and also commented that she could not stand him at trial and liked this Nurmi better. I liked this Nurmi better too. He is humanizing himself and basically doing his own public image rehab during these interviews.

When asked what he told CMJA about her social media use and interviews, he could not comment, but we were to infer what we thought he would say. In general, he tells clients not to say another word once they have been arrested or charged.

But before you give in to a particularly difficult family member or curse a failed turkey dinner, there is some good news about this year's holiday stress: You can color your way out of it. Trite as it may sound, taking a coloring break over your winter vacation may be just what the doctor would have ordered...

Print out a few copies of the blank doodle below provided by Hatchette Paperworks, share your art supplies and get going..."

Praying that things will get better for you and yours :blowkiss:

Same here!

I really appreciate the adult coloring book ideas. I just went on Amazon and sent some to my sister for Christmas. What a great idea. Thank you so much!

Adult coloring books seem to be the latest Christmas hot item! I keep seeing articles on them every day.

We had a small flurry of snowflakes last night .... it has all disappeared today. I hear we could have record seeking temps again on Wednesday.... 50's in Michigan for Christmas?

Lots of interesting things posted by our Y/N today!

A Merry Christmas is coming our way.... we are going to my former son-in-law's tomorrow and will get to see my grandkids. I am so excited.

Thanks for listening (I couldn't). I was really interested in what questions the callers would ask, but it seems as if he really couldn't answer much.

Does Laurence really know he will be cancer free from the chemo? Maybe his tumors are shrinking???? I mean, getting chemo doesn't guarantee being cancer free does it?

I do hope he is correct and he does become cancer free.

(I know I am in the minority, but I like Laurence as a person. ) :tomato:

Speaking of snow, I don't know how many other areas have this service, but I found out just this year about "Snow Angels." They're volunteers who will come to your house and dig out your car and shovel your steps, walk, driveway, sidewalk, etc.

In order to sign up, you have to be over 50 and/or have some kind of physical impairment. I got a call last week that my application was approved. They told me I would get a call in advance, and that the volunteers would show up wearing orange vests (so as to be readily identifiable), and that they do not accept tips under any circumstances. I asked if hot chocolate and cookies were okay, and they said yes. :)

A Driver Is Pulled Over By A Cop For Speeding

The policeman approaches the drivers door.

"Is there a problem, Officer?"

The policeman says, "Sir, you were speeding. Can I see your license please?"

The driver responds, "I'd give it to you but I don't have one."

"You don't have one?"

The man responds, "I lost it four times for drink driving."

The policeman is shocked. "I see. Can I see your vehicle registration papers please?"

"I'm sorry, I can't do that."

The policeman says, "Why not?"

"I stole this car."

The officer says, "Stole it?"

The man says, "Yes, and I killed the owner."

At this point the officer is getting irate. "You what?"

"She's in the trunk if you want to see."

The Officer looks at the man and slowly backs away to his car and calls for back up. Within minutes, five police cars show up, surrounding the car. A senior officer slowly

approaches the car, clasping his half-drawn gun.

The senior officer says, "Sir, could you step out of your vehicle please!"

The man steps out of his vehicle. "Is there a problem, sir?"

"One of my officers told me that you have stolen this car and murdered the owner."

"Murdered the owner?"

The officer responds, "Yes, could you please open the trunk of your car please?"

The man opens the trunk, revealing nothing but an empty trunk.

The officer says, "Is this your car sir?"

The man says, "Yes" and hands over the registration papers.

The officer, understandably, is quite stunned. "One of my officers claims that you do not have a driving licence."

The man digs in his pocket revealing a wallet and hands it to the officer. The officer opens the wallet and examines the licence. He looks quite puzzled. "Thank you, sir. One

of my officers told me you didn't have a licence, stole this car, and murdered the owner."

The man replies, "I bet you the lying *advertiser censored* told you I was speeding, too!"

Two Guys Both Lose Their Wives In A Grocery Store

Two guys, one old, one young, are pushing their carts around the grocery store when they collide.

The old guy says to the young guy, "Sorry about that. I'm looking for my wife, and I guess I wasn't paying attention to where I was going."

The young guy says, "That's okay, it's a coincidence. I'm looking for my wife, too. I can't find her and I'm getting a little desperate."

The old guy says, "Well, maybe I can help you find her. What does she look like?"

"Well, she is 27 years old, tall, with red hair, blue eyes, long legs, and is wearing a tank top with short white shorts. What does your wife look like?"

The old guy replies, "It doesn't matter, let's look for yours."

There Was A Shipwreck, And Only Scarlett Johansson And Some Random Guy Survived On A Deserted Island

They didn't know each other before the shipwreck, but he did know who she was.

At the beginning it was hard, but as time passed, this guy learnt how to provide food and shelter, he started taking care of her, and eventually she started caring about him...

after all, there wasn't anybody else on the island.

He eventually built a cabin, had a functioning automatic potable water supply, and all sorts of little clever commodities, all done to make her life easier... it was the most

effort any man had ever done for her, and all the hard work made him fit, she noticed this.

One night after some wildlife attacked and he defended her successfully, getting a few cuts in the process, she threw herself at him and they made love. After that, they

were for all intents and purposes "romantically dating".

But for some reason he started drifting away, something was bothering him. And she noticed.

"Whats wrong?" Scarlett asked. "Nothing..." he would always reply.

She pestered him for a while eventually saying she would do ANYTHING he needed or wanted to make him feel good again, just because she really cared for him a lot, and

even if he wasn't asking, she felt it was the least she owed it to him.

"Really? You'll do anything I'd like?"

"Yes," she said. "Anything!"

"Okay, first i want you to take off your toga and get into this pair of work jeans that somehow washed on the shore."

"Okay..."

"Now put this shirt on please, but first, "tape" your *advertiser censored* so they are flat."

"Wha... Okay, I said I'd do anything," she said lovingly.

"Okay, now take this hat and wear it, but tuck your hair under it."

She was confused, but none the less, she wanted to make him happy. So she tucked her hair under the hat.

"Now I'd like for you to grab this piece of soot and paint yourself a beard and a mustache."

"Okay, if this is what you want," she muttered.

"Now, please, put on these sunglasses, and start walking down the beach. I'll catch up to you in a bit!" he said a bit excited.

She started walking, wondering, doubting herself, just confused about what had just happened. Maybe it wasn't her, maybe it was h- and suddenly the guy grabs her by her

shoulder turns her around and says:

"DUDE!!! You won't believe who I've been sleeping with for the past 6 months!"

Man In Ecstasy

He was in ecstasy, with a huge smile on his face, as his wife moved forward, then backwards, forward, then backwards again, back and forth, back and forth...in and out...in

and out.

It was going on for 10 minutes at this point...

Her heart was pounding...her face was flushed...then she moaned, softly at first, then began to groan louder.

Finally, totally exhausted, she let out an almighty scream and shouted:

"OK, OK! I can't park the damn car! You do it, you smug *advertiser censored*!"

The Pharmacist

One day an old man went into a pharmacy, reached into his pocket and took out a small bottle and a teaspoon, laying them on the counter.

He asked the pharmacist “Could you taste this for me, please”.

The customer being a senior citizen, the pharmacist went along, taking the spoon with a tiny dab of the liquid, putting it in his mouth, swilling the liquid around and with a

grimacing look spitting it into a cup.

“Now, does that taste sweet to you?”asked the old man?

The pharmacist replied “Hell no!”

“Oh, that’s a relief”, said the old man, “The doctor told me to come here to get my urine tested for sugar”.

Shave and a haircut

An old drover walks into a barber shop in Black Stump Crossing, NT, for a shave and a haircut.

He tells the barber he can’t get all his whiskers off because his cheeks are wrinkled from age.

The barber gets a little wooden ball from a cup on the shelf and tells the old drover to put it inside his cheek to spread out the skin.

When he’s finished, the old drover tells the barber that was the cleanest shave he’d had in yonks, but he wanted to know what would have happened if he had accidentally

swallowed that little ball.

The barber replied, “Just bring it back in a couple of days like everyone else does.”
