Trump's civil fraud ruling has been released — including a heavy fine of more than $350M and a ban on behind a being an officer or director of a New York company for three years.

Judge Engoron bans Don Jr. and Eric Trump from serving as an officer or director of any New York corporation or other legal entity in New York for 3 years

Justice Engeron: The Trump family's "complete lack of contrition and remorse" for their extensive fraud and egregious financial misconduct "borders on pathological."

*Bench Trial continues (Day 49)-JUDGE’S DECISION DUE! (@ 9:30am ET) – NY - New York vs. Donald J. Trump (76/now 77), Donald Trump, Jr. (45) & Eric Trump (38/now 39) & the Trump Organization, Inc. (Allen Weisselberg (75/now 76) & Jeffrey McConney) are being sued by Letitia James, the New York Attorney General, who is leading a civil investigation (which cannot result in criminal charges filed on 9/21/22) & has spent years looking at whether the company committed various acts of fraud over several decades. In the civil case, Ms. James has filed a lawsuit against Trump & two of his children accusing them of "astounding" fraud & deception.
New York is seeking $250 million in financial penalties & asked the court to ban Trump, Donald Trump Jr. & Eric Trump from serving as an officer or director in any corporation registered or licensed in New York. James also requested the court ban the former president & his business from acquiring real estate in New York or from applying for loans from any New York financial institution for five years. James's civil case accuses Trump of lying from 2011 to 2021 about asset values at the Trump Organization, as well as his own net worth, in order to obtain better terms from lenders & insurers.
Lawsuit against: Donald John Trump, Donald Trump, Jr, Eric Trump, Allen Weisselberg, Jeffrey McConney, The Donald J. Trump Revocable Trust, The Trump Organization, Inc., Trump Organization LLC, DJT Holdings LLC, DJT Holinds Managing Memer, Trump Endeavor 12 LLC, 401 North Wabash Venture LLC, Trump Old Post of Fice LLC, 40 Wall Street LLC & Seven Springs LLC.
All charges against Ivanka Trump were dismissed in June, 2023.
Bench Trial began on 10/2/23 & ended on 1/11/24 with closing arguments. Prosecutors rested their case on 11/8/23. Defense began their case on 11/13/23 & ended 12/18/23. Closing arguments were on 1/11/24.
The lawsuit’s remaining 6 counts allege similar acts of fraud (that Trump inflated his assets on statements of financial condition that he submitted to banks & insurers for personal gain).

2/7/24 Update: In a letter submitted to Jude Engoron Wednesday, defense attorney Clifford Robert urged the judge to strictly consider the record from the trial in his final decision, describing his request to provide information about Weisselberg based on a NY Times article "unprecedented, inappropriate & troubling." Citing their ethical obligations, lawyers for the defendants in Trump's civil fraud trial declined to provide details about "rumors of any kind" involving form Trump Organization CFO Weisselberg & urged Judge Engoron to make a decision solely based on the evidence presented at trial. In a separate letter, Alina Habba, who represents Weisselberg in the civil case but is not his criminal defense lawyer -- declined to provide any information about the potential perjury & argued that no further action was needed on the matter. NYAG Letitia James said on Wednesday that the potential perjury-related guilty plea of former Trump Organization CFO Allen Weisselberg should have no bearing on the outcome the civil fraud case against Trump.
2/8/24 Update: Judge Engoron’s response to letter (above) – see post #510, page 26, thread #2. Judge Engoron’s decision will come early to mid-February – a rough estimate.

And banned from doing business in NY for three years, looks like? That amount of time doesn't seem long enough, IMO, but I'll take it.
 
The judge who presided over a civil business fraud trial against Donald Trump and his company has issued his decision in the case.

Judge Arthur Engoron ordered the former president and the Trump Organization to pay over $350 million in damages, and bars Trump "from serving as an officer or director of any New York corporation or other legal entity in New York for a period of three years."

He also continued "the appointment of an Independent Monitor" and ordered "the installation of an Independent Director of Compliance" for the company...

Fully concur. Most big real estate projects take far more than 3 years to complete. He can begin scheming to defraud in 2027 and still essentially be conducting business all the while during his ban.

It's not like a mom and pop restauranter who has to shut down their place for 3 years.

Refusal to Admit Error
The English poet Alexander Pope (1688-1744) first declared, “To err is human, to forgive is divine.” Defendants apparently are of a different mind. After some four years of investigation and litigation, the only error (“inadvertent,” of course) that they acknowledge is the tripling of the size of the Trump Tower Penthouse, which cannot be gainsaid. Their complete lack of contrition and remorse borders on pathological. They are accused only of inflating asset values to make more money. The documents prove this over and over again. This is a venial sin, not a mortal sin. Defendants did not commit murder or arson. They did not rob a bank at gunpoint. Donald Trump is not Bernard Madoff. Yet, defendants are incapable of admitting the error of their ways. Instead, they adopt a “See no evil, hear no evil, speak no evil” posture that the evidence belies.

This Court is not constituted to judge morality; it is constituted to find facts and apply the law. In this particular case, in applying the law to the facts, the Court intends to protect the integrity of the financial marketplace and, thus, the public as a whole. Defendants’ refusal to admit error—indeed, to continue it, according to the Independent Monitor—constrains this Court to conclude that they will engage in it going forward unless judicially restrained.

Indeed, Donald Trump testified that, even today, he does not believe the Trump Organization needed to make any changes based on the facts that came out during this trial.

Do these figures include the interest he has to pay?

I was reading an article yesterday that said trump will also be subject to interest on the amount of the fine.


Whatever the amount, Mr Trump would also have to pay annual interest on that fine, dating back several years to when the alleged offences took place. New York's 9% interest rate means Mr Trump might have to pay an additional nine-figure sum on top of the penalty.

 
Interest is owed in addition to those amounts and accrues on each of those amounts, and on some of them interest is considered to have accrued before the date of this decision.

Except he won’t have the money for any projects, isn’t allowed to get a loan and will have a babysitter that he will have to ask permission to even write a check. The Trump brand is over, and he has zero control over his fraudulent company. Humiliating.

True! But that is ALOT of money. And that’s on top of the huge amount of attorney fees for all the other trials and appeals he’ll be going through for quite a while, the E. Jean Carroll judgement, and not to mention he has a campaign to run & that takes money! Even selling off the properties isn’t going to be that helpful because apparently he’ll have to pay capital gains and supposedly he has mortgages on almost everything. He doesn’t have enough supporters for all that IMO.
