It's interesting to learn that Matthew Foerster was already suspected by the community in the 2004 attack. I guess that's why his eyebrows were described as "bushy" in 2004-5 and they now look plucked.

It sounds like his mom is not in denial today ... at this time, I feel sorry for her. I don't think that she has been oblivious to what her son has been doing and I do wonder why only the father is charged with obstruction, but at the same time, perhaps she was kept in the dark, or maybe she has been in denial and really conflicted, but didn't help her son avoid justice.

It's just that if the son has been missing (police didn't know where he was) since December ... what was she thinking all that time and why didn't she report him missing if she didn't know where he was. How did she know that he was okay ... or did her husband just tell her not to ask questions.

"Media members including CTV reporter Kent Molgat tell Kiss FM, Stephen Foerster's wife and another unidentified man were hostile with a CTV cameraman and a freelance photographer after the appearance.

The media members were trying to get pictures of the pair as they left the courthouse.

Mrs. Foerster allegedly hit the photographer with her purse, then kicked and scratched him.

The man apparently grabbed the camera operator and tried to push him out of the way, but he was not injuried.

The media members dio not plan to pursue charges at this point.

The incident was caught on tape by CTV"

Wow. That's his mom? She's so tiny. She's got to know that DNA doesn't lie and that her son's DNA was found associated with a rape and a murder as well as an earlier assault. Being his mother, I can see why she would want to support him, but she is likely not thinking logically but emotionally. Anyone else who is supporting this guy, I have NO IDEA why. JMO

Mrs Foerster is not only supporting her son, she's physically lashing out at people around her she doesn't know, and so is the young male walking with her (another son?). Her son Matthew is up charges for not keeping his angry hands to himself.

She has given me some insight into life in the Foerster home.

Whoa! A little testy, I'd say. :what:

Think they'd better get used to it. They have Mathew and her husband to thank for the new found fame.

Canadian law has provisions that protect people from having cameras shoved in their faces. The media was in violation of the law by chasing a woman with a camera and microphone. The fact that her son has been charged with a criminal offence is not a reason to harass her.

"The Personal Information Protection and Electronic Documents Act (PIPEDA) addresses the collection, storage and use of personal information by organizations in the private sector. Its provisions apply to information collected, used or disclosed by federally regulated agencies, such as telecommunications companies, ISPs, broadcasters, airlines and banks."

...

"Under the law's guidelines, personal information can be collected about you only as long as it is:

1. Gathered with the knowledge and consent of the consumer
2. Collected for a reasonable purpose
3. Used only for the reasons for which it was gathered
4. Accurate and up to date
5. Open for inspection and correction by the consumer
6. Stored securely"

The collection of DNA and it's use for familial identification is a slipperty slope. If a man is convicted of murder and his grandson happens to be at the scene of a murder 50 years later, should he become a stronger suspect because his grandfather was a convicted murderer? It could happen and this is one of the "privacy" reasons why this is not allowed.

If the grandson is at a location 50 years later where a murder takes place, he needs a good reason to be there. If he has one, great. To me, that would be the natural evolution of trials with DNA evidence - did he make deliveries to the door or go inside and have coffee on a regular basis etc etc.

The key is where was the DNA found at the scene and how many places.

"RCMP have taken the rare step of releasing video of a man charged with the murder of Taylor Van Diest in Armstrong on Halloween night.

The video is of 26-year-old Foerster returning from Ontario".

He is cuffed, and being escorted by an officer.

Police are hoping the video will trigger someone's memory into Foerster's whereabouts the day of the killing

Thanks for that link, dotr. Here is a screen grab from the video.

I know it's small. Sorry about that. Maybe someone else can grab a better image.

You can see though, that, as the media reported, he does look a lot slimmer that in some of the previously provided media pics. Perhaps stress will do that to you. What a shame.

Some in the North Okanagan were shocked when RCMP announced the pair was arrested last week; for months Armstrong residents had been wondering who could have killed “a beautiful, special girl,” according to Van Diest’s friends. Others, who saw the sketch police released last fall of a man with dark eyes and sideburns, were not surprised.
“Well, when the sketch came out ... anybody that knew Matt said that’s who it was, by the sketch,” said Eugene Foisy, a Cherryville director with the Regional District of North Okanagan. He told the CBC Tuesday the sketch artist must have been good.
“When they did make the announcement, we weren’t surprised because they had been looking for him.”

I wonder if the crown will seek dangerous offender status for him - since he may have committed three separate, violent assualts on women - including murder.

Here is the rumored report in Collingwood on how suspect MF was found and apprehended. It is unconfirmed by a media report, so if it necessary to remove it so be it.

MF was staying at a motel in the east end of Collingwood under an assumed name (which I believe has been reported). He was working for a local painter - one needs a SIN to gain employment in Canada. Apparently MF used his real name and SIN with the employer. The RCMP obtained a warrant on a Monday and arrested him the next day by following the SIN, SWAT team included.

Seems the old adage 'you can run but you can't hide' is true. If I needed fake ID I would not have a clue where to go or where to start looking - guess the Foerster's don't either.

Wow, busted by using his SIN #.

Glad to hear it!

Charges against the B.C. man accused of killing 18-year-old Taylor Van Diest in Vernon have been raised to first-degree murder.

Investigators with the RCMP Southeast District Major Crimes Unit and the B.C. Crown prosecutor's office said Thursday that charges against Matthew Foerster have been upgraded from second-degree murder.

Neither the police nor the Crown prosecutor provided information on why the charges were upgraded.

University of B.C. law professor Isabel Grant said there are several criteria that must be met for a first-degree murder charge.

"The ones that strike me as likely relevant [in this case] ... are if the murder takes place during the course of a sexual assault, if the murder takes place during an enforceable confinement and if the murder is planned and deliberate," said Grant.

"Any of those would make it first degree," she said"
