Shannon Stillwell's attorney Max Schardt will start off the cross-examination of former Inv. Gaither.


Schardt is questioning Gaither about the April 2015 incident, in which Dexter Montgomery was injured.


Schardt is focusing on police reports Gaither had during her time at APD and the fact she is not in possession of those case files anymore. Schardt feels like the defense should have access to those reports.


"We are not allowed to take our case files with us, once you retire. I have no purpose for them," Gaither tells Schardt.




Gaither doesn't want to answer Schardt's questions, at times telling Schardt that she already answer that question.

Everyone is back from lunch. Young 's attorney Brian Steel starts his cross-examination with one of YoungThug's album cover, Super Slimey, which was admitted as evidence during direct examination. Future collaborated on this album.

Gaither testified that she wasn't in the gang unit in 2017, but didn't look or talked about who produced the album.

Gaither said it wasn't relevant enough who drew the image of the album to ask about it.

"My interpretation of it was disrespect," Gaither said about the album cover.Steel is asking a series of question to Gaither about if she has any knowledge that Young or members of YSL had anything to do with artwork.

Steel is going through different Young album covers and asking Gaither if she is familiar with each album cover. Gaither says she is not familiar, as Steel describes the album covers having a snake and different animals.

"Artwork is left up to the interpreter. As far as the gang unit, and the back and forth shootings that we were working, it appeared relevant at that time," Gaither said about the Super Slimey cover.

Steel is now asking Gaither if she knew that Donovan Thomas was with Young during the months before Thomas' death on January 2015.

During another short week in a massive Atlanta RICO trial, an attorney for rapper Young , whose real name is Jeffrey Williams, accused the prosecutor, Adriane Love, of lying to the judge during a sidebar at the bench. Law&Crime’s Jesse Weber @jessecordweber explains.
 
Steel’s questioning is done. Re-direct from Chief Deputy ADA Love includes a question as to why she left APD and go be an investigator with the DeKalb Co. DA office.

Gaither said she left APD because she was no longer happy with the leadership at APD and the direction they were going.She said something similar to the @ajc in 2020.


Before Steel was done questioning Gaither, he went through some email correspondence they had about setting up a meeting in Dec. 2023 before she testify.Although originally agreeing to a meeting, she later cancelled it, per the emails read in court.

Gaither claims there was another time she gave Steel to meet and then she told Steel, she didn't want to meet with him, which is her right.

Before the jury is being brought out, attorneys are arguing over the last question Chief Deputy DA Love asked Gaither about Kenneth Copeland and Shannon Stillwell.

Stillwell's attorney Max Schardt wants the jury to be instructed to disregard that question.Love said it shouldn't be redacted.

The jury has been brought out and Gaither's testimony is continuing.

"I came to the conclusion that the criminal act that YSL committed was considered criminal street gang activity based upon the persons that were involved in the crime," Gaither said before stating that Walter Murphy, Demise McMullen and Kelvin Treadwell were members of YSL.

Gaither said she was not the lead detective on the Donovan Thomas murder, she worked other shootings around the murder and assisted the lead investigation.

"Tough crowd this morning," Steel joked about the fact the state continuously objects to his questions and Glanville sustains the objection.

After seven days of testimony, former APD Investigator Lakea Gaither has been temporarily excused as a witness and can be called back to the stand.

State's next witness is APD officer Tyrone Finley, who investigates burglaries in Zone 1, but has been at the department for more than 15 years.

Finley is testifying about the Lil Wayne bus shooting on April 26, 2015 - Finley was working an extra job at The Compound nightclub during the time of the bus shooting.

This is an incident where the state doesn't have Jimmy Winfrey, who allegedly shot the tour bus, as a witness because Winfrey was arrested in July 2023 for the YSL indictment and has not been offered a plea deal.


Glanville told jurors that they will be paid for the administrative days in March and April.


To accommodate a juror who has a graduation, court will start at noon on May 14.


YoungThug's attorney Keith Adams is doing cross-examination on Officer Finley.


Finley testified that he has heard of Young but doesn't recall seeing him at the Compound nightclub.


Attorney Max Schardt is now questioning Finley.


ADA Atkins is now asking questions on redirect about Winfrey being "a leader of the group" that was there.


Finley has been excused permanently as a witness.


911 Operator Sharon Latners is back on the stand. She has already been called at least four times to testify regarding different 911 calls.Latners is going to now testify about the Lil Wayne Bus shooting.


It appears a juror had a medical emergency, so the cameras have been shut off.


Doubt they will continue on today. Reminder that jurors have Thursday and Friday off.


It will be interesting to see what happens because there are only four alternate jurors remaining, after two trial jurors were previously excused (one after being at the hospital and another after moving to a different county)


To clarify, a total of 18 jurors - 12 trial jurors and 6 alternates - were sworn in back in November. Jurors don't know who is an alternate and who is a trial juror.


Judge is back on the bench.


Glanville told attorneys that a juror "has taken ill" and the court is sending her for "medical treatment”.


Done for the day, but Glanville said he has no idea what is going to happen with the juror and the rest of the week.


Glanville is asking attorneys if there is anything he can take up in the next couple of days outside the presence of the jury.He plans to have a workday tomorrow for attorneys and clients and hope to have an update on the juror then.


Jurors will be excused until Monday May 6.


"We'll hope that your colleague's health improves and we find out exactly what's going on," Glanville told jurors.
