I could be wrong but it doesn’t seem that the collective media is aware that this hearing set for Monday SEPTEMBER 20th is a big damn deal. It’s all about any statements made by Ryan Duke and the notice is buried among other documents.

"OCILLA, GA (WALB) -
Explosive new facts are coming to light through court documents obtained by WALB related to the October 2005 disappearance of Tara Grinstead.

Both the State and attorneys for Ryan Duke filed multiple new motions and demands this week in the case against Duke for the killing of Grinstead.
Duke's attorney also filed 23 previous motions on Aug. 8.

On Thursday, WALB received the documents from the Irwin County Superior Court through an open records request.

One document filed by the public defender's office for Duke is a plea in bar and demurrer to counts two (felony murder), three (felony murder), four (aggravated assault), five (burglary) and six (concealing death of another) of the indictment based upon the statute of limitations....

On Aug. 10, District Attorney Paul Bowden filed a Notice of Jackson-Denno hearing, to be held at 9:30 a.m. on September 20....

There is documentation that BO and RYan were questioned though it is being denied.....there is a list of names...…posted by Philip Holloway on fb "justice for tara grinstead"…..this form also shows that Lott and ANdy and Paulk went with LE to the orchard and found no evidence there but not sure if anyting was ever followed up on

This is called a "Demurer" and it challenges the murder count on the basis that a mere allegation that RD used "his hand to kill Tara Faye Grinstead" - without more specificity - is not legally sufficient. I agree. This has been one of my issues with the indictment all along. Because hands are not automatically considered deadly weapons more detail is needed to put the accused on notice of what he needs to defend against.

"Ashleigh Merchant, who practices in Marietta, told The Atlanta Journal-Constitution on Friday she and her husband, John Merchant, will represent Ryan Alexander Duke. Duke has been charged with murder in the 2005 death of Tara Grinstead, an Irwin County High School teacher and former beauty queen.

Duke, one of Grinstead’s former students, was arrested in February 2017. He remains in jail and has been represented by public defenders.

"We decided to take the case because we believe in his innocence,” Merchant said in text message. “We know Ryan wants his story told and we want to help him tell it. He has been demonized and we want to help the truth come out."...

According to court documents filed last week in Irwin County Superior Court, both Duke and Dukes confessed to the crimes within weeks of Grinstead’s disappearance. In a motion filed in court, Duke’s attorneys claimed investigators dropped the ball on the case. And because it took so long to arrest the suspects, most of the charges should be dropped due to the statute of limitations, the motion states.

A motions hearing is scheduled for Sept. 20 in Ocilla. "

WOW, so they "believe" in his innocence or do they believe in the injustice they feel against him due to the statute of limitiations ? I will assume he is or believes he is innocent...Well, we all know what we all think...….but none know what is being said by Ryan at this juncture all we know is form this that he wants to tell his story...…...have to think on this, just getting around to this, saw it earlier in the news, thanks

Tara Grinstead’s killing: Hearing will determine how case moves forward

"More than 13 years after Tara Grinstead was reported missing — and more than a year after two men were charged in connection with her murder — a court hearing will begin Monday to determine how the case proceeds.

Among the key issues a judge must decide: Whether most charges should be dropped because too much time has passed since the crime, and whether the trial should be moved from Irwin County in South Georgia....

Arguments for the change of venue and the other 32 motions will be heard beginning Monday in the Irwin County courthouse.

Judge Bill Reinhardt, the chief judge of the Tifton Circuit of Georgia, will preside. Duke and his attorneys, along with Irwin County prosecutors, are expected to attend the hearing, which could continue Tuesday. It’s not known whether Reinhardt will immediately rule on the motions."

Duke’s lawyers, Ashleigh Merchant and John B. Merchant III, are also asking for these concessions from the court:

- That the state only have one closing argument to the jury, in which it would only be allowed to rebut the defense arguments

- That the state not be allowed to read the grand jury’s indictment to the jury prior to opening statements

- That Ryan Duke’s friends and family be allowed to witness the trial, or cause be shown why they should not

- That Duke be given a jury list at least 10 days before the trial

- That an investigator be appointed to Duke’s legal team, or money be provided for that purpose

Hearing dates are set for November 26 and 27 in Irwin County Superior Court, where the judge will hear multiple motions filed in his case.
