Eric Molitor and brothers Michael and William Null pleaded not guilty to charges of providing material support for terrorist acts and possessing a firearm while committing a felony.

Brian Higgins pleaded guilty in March to a charge of attempting to provide material support of terrorism, and Shawn Fix pleaded guilty in June to a charge of providing support for an act of terrorism.

Both Higgins and Fix have agreed to testify against the other defendants in a trial that is scheduled to begin on August 23 at 9 a.m.

Jury selection will begin at 8:30 a.m. on August 21 at the Bellaire High School.

BELLAIRE, Mich. -- Prosecutors were preparing Wednesday to present evidence against three men accused of plotting to kidnap Michigan Gov. Gretchen Whitmer in what investigators described as an extremist scheme to ignite a civil war.

Attorneys were scheduled to make opening arguments in the trial of Eric Molitor and brothers William Null and Michael Null, who were among 14 defendants charged weeks before the November 2020 election. Nine have been convicted in state or federal court, including four who pleaded guilty, while two were acquitted.

Eleven women and seven men were selected Monday to serve as circuit court jurors in Republican-leaning Antrim County, a rural area popular with tourists. Whitmer has a vacation home in the Lake Michigan village of Elk Rapids.

ANTRIM COUNTY — On the first day of an expected 15-day trial, defense attorney William Barnett stated defendant Eric Molitor thought the idea to kidnap Michigan Governor Gretchen Whitmer was a “dark joke.”

With Judge Charles Hamlyn presiding, the three defendants are being charged in Antrim County’s 13th Circuit Court with providing material support for a terrorist attack and also possessing an illegal firearm.

Much of what was presented on Wednesday by the state dealt with statements and actions surrounding the defendants' dealings with Fox and Croft.

After referring to one of Croft’s Facebook posts, the state, characterizing the Null brothers and Molitor as anti-government ideologists said, “Their plan didn’t just involve kidnapping, their plan involved a 20 minute free for all gun battle on Birch Lake and the murder of Michigan state troopers who were assigned to protect our governor."

Impola testified for hours, detailing the infiltration of a group of men under investigation in 2020 and their increasingly concerning behavior. According to Michigan Assistant Attorney General William Rollstin, this group was working towards a nationwide civil war.

At the end of the day on Friday, Aug. 25, the prosecution sought to connect the defendants with the sentiments of the ringleaders being expressed on social media and in texts and chats.

The trial will continue at 9 a.m. in the Antrim County Circuit Court on Monday, Aug. 28. The trial is expected to last for nearly two weeks.

ANTRIM COUNTY — An FBI agent who went undercover to infiltrate a militia group accused of plotting to kidnap Gov. Gretchen Whitmer testified in Antrim County's 13th Circuit Court on Thursday and Friday.

His testimony came during the second week of the final trial involving conspirators in the failed scheme. On trial are three defendants, Eric Molitor and twin brothers Bill and Mike Null. All are charged with providing material support for terrorist acts — punishable by up to 20 years in prison — and illegally possessing firearms.

On Thursday, Aug. 31, FBI Special Agent “Undercover Mark” took the stand with presiding Judge Charles Hamlyn limiting media coverage to protect the witness' identity.

For the state, Assistant Michigan Attorney General Phil Jacques questioned Mark as he set the scene for dozens of secretly recorded conversations that were played for the jury. In the audio, discussions of kidnapping the governor and killing law enforcement can be heard. The transcribed exhibits were meant to illustrate the alleged intentions of Molitor and the Null brothers and the increasingly dangerous plans the group was forming.

On Friday, Sept. 1, Bill Null’s attorney Damian Nunzio grilled Undercover Mark during cross examination.

Referring to the field training exercises, Nunzio confirmed with Undercover Mark that going to field training exercises “is not in and of themselves illegal” and that not everyone participating in them knew about the plans to kidnap the governor or was arrested.

On redirect, the state sought to clarify what had been potentially muddled by the defense’s line of questioning that inferred the Null brothers were not aware of why they were in a chosen parking lot during the Elk Rapids surveillance trip and not actively participating as lookouts. Jacques referred back to quotes from Mark's recorded conversations that supported they were knowledgeable of the task and present for the conversations during the Elk Rapids surveillance trip, which included discussions of possibly killing law enforcement that got in the way during the kidnapping.

Friday, Sept. 1, marked the eighth day of what was initially planned to be a 15-day trial. The 18 person jury, consisting of six alternates, have a three day weekend in honor of Labor Day. Court proceedings will commence at 9 a.m. on Tuesday, Sept. 5, in the Antrim County Courthouse in Bellaire.
 
Sounds like the “I didn’t even know” defense is getting holes shot into it by their own admissions.
