NJ - Multiple Deaths in Mansion Fire, Monmouth County, Colts Neck, 20 Nov 2018 *Arrest*

I'm sorry but this doesn't make any sense.
One fire at 5am results in no visible damage and no injuries or fatalities.
Another fire at Noon results in a burned out mansion, 3 deaths inside, a gunshot victim outside and no survivors.
The only way these were committed by the same person is if they only wanted one house burned and one family dead.
The way I read it, one fire at 5 A.M. the other at 12:30 just after Midnight (was first) or before the 5AM fire - \ A neighbor talked about Susan and Paul and said Paul left the home early in the morning, then returned later on. He didn't say late afternoon, but early morning.

3:33 A.M. Nov. 20th, 2018: (911 Call came in ) Actually if this is correct then; Keith had been shot 5 times and left on the front lawn - so we know this is his time of death!

(sorry, I got confused TOO from the various times given) AM & PM So, if this is brother doing the arson at his own home he has to be there at or near 5A.M. and a neighbor claims he saw him leave that morning early, then come back home.

What's taking so long for Paul Caneiro to go to trial in Colts Neck family murders?​


FREEHOLD - It's coming up on five years since the Caneiro family was slaughtered in their Colts Neck mansion, but the man accused of committing the shocking murders - the brother of one of the victims - still has not gone on trial.

Despite speedy trial provisions in the state's Criminal Justice Reform Act, Paul Caneiro's trial has been delayed for several reasons, among them the suspension of jury trials for a year and a half during the COVID-19 pandemic. Also contributing to the delay was a voluminous amount of evidence the defendant had to review to prepare for his trial.

But now, the one thing standing in the way of Caneiro facing a jury in what has been described as a greed-fueled murder case is a hearing on the admissibility of cutting-edge DNA evidence the state wants to present against him.

Last year, Caneiro's attorneys were wrangling for access to the source code for the technology from which the DNA evidence was derived so that a defense expert could evaluate the reliability of the evidence and possibly challenge it.

Superior Court Judge Joseph W. Oxley, who is presiding over the case, in July ordered the company that owns the proprietary technology to turn over its source code to Caneiro's defense expert to facilitate the evaluation.

But, almost a year later, that expert still has not submitted a report on his evaluation to defense attorney W. Michael Wicke of the Public Defender's Office.

Appearing in court on Monday, Wicke told Oxley he still has not been informed of the date by which the expert plans to give him the report.

"I certainly hope to have dates as soon as possible,'' Wicke said.

"This case is getting older and older, through no fault of your own,'' Oxley responded.

The judge ordered that the defense expert either turn over the report to Wicke by June 26 or provide a certain date when that will be done. Otherwise, Oxley said the expert will have to appear in court in-person before him that day to explain why he can't.

*Status Conference Hearing (@ am ET) – NJ – Keith Martin Caneiro (50), his wife Jennifer Karidis Caneiro (45) & 2 children Jesse (11) & Sophia (8) (Nov. 20, 2018, Colt’s Neck; died prior to fire @ home) – *Paul Jay Caneiro (51/now 55) (bro) arrested (11/20/18), charged (11/29/18), indicted (2/25/19) & arraigned (3/18/19) on 4 counts of murder, 2 counts of felony murder, 2 counts of aggravated arson, possession of a firearm for an unlawful purpose, possession of a knife for an unlawful purpose, unlawful possession of a firearm, unlawful possession of a knife, theft, misapplication of entrusted property & 2 counts of hindering apprehension. Plead not guilty. Held without bond.
*Indicted (7/1/19) with 2nd degree insurance fraud (from 11/6/12 to 7/9/19).
Previously charge with 2 counts of 2nd degree aggravated arson (in connection to fire set @ his Ocean Township home on the same day before fire in Colt’s Neck), and with 4 counts of murder, with possession of a firearm & possession of a weapon for unlawful purpose. Plead not guilty. Held without bond. Paul Caneiro allegedly stole $78,000 from Keith & Jennifer Caneiro. He stole the money sometime between January 2017 & the day of the murders.

1/19/22 Update: The case has been slowed by the COVID-19 pandemic, the sheer volume of evidence collected in the case & the pandemic’s impact on the accused’s ability to review that evidence while being held without bail at the Monmouth County Jail, especially during periods of lockdown due to outbreaks of the virus. At a hearing last week, Caneiro’s attorney, Patrice Bearden, said there are literally terabytes of electronic evidence that have been collected in the case by the prosecution & shared with the defense. Bearden, first assistant deputy public defender for Monmouth County, asked Superior Court Judge Joseph W. Oxley at Wednesday’s hearing to order prosecutors to pinpoint what in the mountains of evidence they intend to use at trial. The state opposed Bearden’s motion. Oxley said he would rule on the request on 2/3/22. Next status hearing on 3/4/22.
3/4/22 Update: Attorneys for Paul Caneiro are planning to challenge the reliability of cutting-edge technology used to analyze the DNA evidence prosecutors allege links him to the murders of his brother, sister-in-law, niece & nephew. At a court conference Friday for the man accused of killing his brother’s family & setting their Colts Neck mansion ablaze in 2018, Patrice Bearden, first assistant deputy public defender for Monmouth County, told Superior Court Judge Joseph W. Oxley she will file a motion asking for a hearing to determine the scientific reliability of a “probabilistic genotyping" computer program that analyzed the DNA evidence linking Caneiro to the crimes. Prosecutors have said the case against Caneiro centers on DNA evidence, ballistics matches & surveillance video. The NJ State Police DNA Lab later reported Sophia’s blood was found on a pair of jeans & a latex glove found in a plastic container in Paul Caneiro’s home. After she & co-counsel Michael Wicke discussed the evidence in Caneiro’s case with their DNA expert, they decided they will challenge it, Bearden told the judge Friday. Judge Oxley instructed the defense team to file their legal brief on the issue by April 1 & for prosecutors to file their response to it by April 29, in advance of a potential hearing on the DNA evidence. Meanwhile, the judge said he plans to review the appellate court decision in the Pickett case. Next hearing on 7/6/22. No trial date has been set.

But the company that owns the technology insists its intellectual property must be protected from competitors, leading to what has been a protracted legal debate about the cloak-and-dagger conditions under which a defense expert will be allowed to examine it. At this point, a hearing on the reliability of the new method that generated the DNA evidence against Caneiro is the only thing standing in the way of setting a trial date for him. As of last week, the Frye hearing had not been scheduled. Status hearing on 6/5/23.

Christopher Decker, deputy first assistant Monmouth County prosecutor, has said the state can proceed to trial without the cutting-edge DNA evidence generated by the STRmix program, but the company that owns the technology, as well as the New Jersey State Police, want a court ruling saying the technology is reliable because the state police now uses it in its DNA lab.

So I wonder what happens if the court rules it's not reliable. Do all the cases where the state police lab analyzed the DNA can tossed out?
